Une entreprise qui obtient moins de 75 points sur 100 dispose de trois ans pour se mettre en conformit\u00e9, sous peine d&#8217;une <strong>p\u00e9nalit\u00e9 pouvant atteindre 1 % de sa masse salariale annuelle<\/strong>. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dispositif d&#8217;alerte interne<\/h3>\n\n\n\n<p>Depuis la loi du 21 mars 2022, qui a renforc\u00e9 la loi Sapin II, toute entreprise d&#8217;au moins 50 salari\u00e9s doit disposer d&#8217;une proc\u00e9dure interne de recueil des signalements, effective depuis le 1er septembre 2022.<\/p>\n\n\n\n<p>Le dispositif doit garantir la confidentialit\u00e9 de l&#8217;identit\u00e9 de l&#8217;auteur du signalement et des personnes vis\u00e9es. Apr\u00e8s une premi\u00e8re hausse au 1er janvier, le SMIC horaire brut est pass\u00e9 \u00e0 <strong>12,31 \u20ac<\/strong> depuis le 1er juin 2026, soit <strong>1 867,02 \u20ac brut mensuel<\/strong> pour un temps plein, en raison d&#8217;une inflation sup\u00e9rieure au seuil l\u00e9gal de d\u00e9clenchement. Cette revalorisation automatique, fix\u00e9e par l&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000054126589\" target=\"_blank\" rel=\"noopener nofollow\" data-wpel-link=\"external\">arr\u00eat\u00e9 du 22 mai 2026<\/a>, impose de rev\u00e9rifier imm\u00e9diatement les grilles de classification index\u00e9es sur le SMIC.<\/p>\n\n\n\n<p>Le plafond annuel de la S\u00e9curit\u00e9 sociale (PASS) 2026 est fix\u00e9 \u00e0 <strong>48 060 \u20ac<\/strong>, soit <strong>4 005 \u20ac par mois<\/strong>, selon l&#8217;arr\u00eat\u00e9 du 22 d\u00e9cembre 2025. L&#8217;indemnisation est d\u00e9gressive : 70 % du salaire net le premier mois, 60 % le second, dans la limite du plafond mensuel de la S\u00e9curit\u00e9 sociale, soit 4 005 \u20ac.<\/p>\n\n\n\n<p>Ce cong\u00e9 s&#8217;applique aussi aux enfants n\u00e9s entre le 1er janvier et le 30 juin 2026, avec un d\u00e9lai de prise \u00e9tendu jusqu&#8217;au 31 mars 2027. En 2026, cette obligation est pleinement contr\u00f4l\u00e9e. \u00c0 d\u00e9faut, l&#8217;entreprise s&#8217;expose \u00e0 une <strong>contribution financi\u00e8re calcul\u00e9e<\/strong> sur la masse salariale des 55 ans et plus non couverts par l&#8217;accord.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Partage de la valeur pour les 11-49 salari\u00e9s<\/h3>\n\n\n\n<p>La loi du 29 novembre 2023 \u00e9tend l&#8217;obligation de n\u00e9gocier un dispositif de partage de la valeur (int\u00e9ressement, participation volontaire ou prime de partage de la valeur) aux entreprises de 11 \u00e0 49 salari\u00e9s ayant r\u00e9alis\u00e9 un b\u00e9n\u00e9fice net fiscal d&#8217;au moins 1 % de leur chiffre d&#8217;affaires pendant trois exercices cons\u00e9cutifs. Le <strong>dispositif reste en phase pilote et n&#8217;est, \u00e0 ce stade, assorti d&#8217;aucune sanction en cas de non-respect<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Loi sur la transparence salariale 2026<\/h3>\n\n\n\n<p>La <a href=\"https:\/\/www.bizneo.com\/blog\/fr\/loi-sur-la-transparence-salariale\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">directive europ\u00e9enne 2023\/970<\/a> devait \u00eatre transpos\u00e9e en droit fran\u00e7ais avant juin 2026. Le <strong>d\u00e9bat parlementaire du projet de loi de la transposition<\/strong> ne d\u00e9butera finalement pas avant <strong>septembre 2026<\/strong>. L&#8217;application effictive ne devrait donc intervenir qu&#8217;au plus t\u00f4t fin 2027.<\/p>\n\n\n\n<p>La loi imposera de communiquer une <strong>fourchette de r\u00e9mun\u00e9ration<\/strong> dans les offres d&#8217;emploi, interdira de questionner un candidat sur son salaire actuel, et exigera un reporting pr\u00e9cis des \u00e9carts de r\u00e9mun\u00e9ration <strong>pour les entreprises de 100 salari\u00e9s et plus<\/strong>.
