Este artigo re\u00fane os valores atualizados e como aplic\u00e1-los sem erro.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que \u00e9 trabalho suplementar (horas extraordin\u00e1rias)?<\/h2>\n\n\n\n<p>Trabalho suplementar, tamb\u00e9m conhecido como horas extraordin\u00e1rias, \u00e9 todo o trabalho prestado <strong>fora do hor\u00e1rio normal de trabalho<\/strong> do trabalhador, conforme o <strong>artigo 226.\u00ba do C\u00f3digo do Trabalho<\/strong>. <\/p>\n\n\n\n<p>Aplica-se quando o trabalhador prolonga a jornada para responder a um <strong>acr\u00e9scimo eventual e transit\u00f3rio<\/strong> de atividade ou em casos de <strong>for\u00e7a maior<\/strong>.<\/p>\n\n\n\n<p>N\u00e3o \u00e9 considerado trabalho suplementar a forma\u00e7\u00e3o que substitui trabalho normal, nem o tempo de compensa\u00e7\u00e3o por encerramento da empresa, entre outras exce\u00e7\u00f5es previstas na lei. <\/p>\n\n\n\n<p>O trabalho suplementar tem de ser <strong>pr\u00e9via e expressamente determinado pelo empregador<\/strong>, sob pena de n\u00e3o ser exig\u00edvel o seu pagamento.<\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/codigo-do-trabalho-em-portugal\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>C\u00f3digo do Trabalho em Portugal<\/strong><\/span><br \/>Veja o guia completo.<\/a><\/bzn-info>\n\n\n\n<h3 class=\"wp-block-heading\">Como funciona o trabalho suplementar em Portugal?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Limite di\u00e1rio:<\/strong> at\u00e9 <strong>2 horas<\/strong> por dia normal de trabalho.<\/li>\n\n\n\n<li><strong>Acr\u00e9scimo de pagamento:<\/strong> come\u00e7a em <strong>25%<\/strong> na primeira hora em dia \u00fatil e sobe conforme o dia e o total de horas anuais.<\/li>\n\n\n\n<li><strong>Descanso compensat\u00f3rio:<\/strong> obrigat\u00f3rio quando o trabalho suplementar afeta o descanso di\u00e1rio ou \u00e9 prestado em dia de descanso semanal obrigat\u00f3rio.<\/li>\n\n\n\n<li><strong>Registo:<\/strong> obrigat\u00f3rio e conservado durante <strong>5 anos<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">O trabalhador \u00e9 obrigado a fazer trabalho suplementar?<\/h2>\n\n\n\n<p>Em regra, sim. O C\u00f3digo do Trabalho<strong> estabelece que o trabalhador est\u00e1 obrigado a realizar a presta\u00e7\u00e3o de trabalho suplementar<\/strong>, salvo quando, havendo motivos atend\u00edveis, solicite a sua dispensa. A recusa sem fundamento pode constituir infra\u00e7\u00e3o disciplinar.<\/p>\n\n\n\n<p>A obriga\u00e7\u00e3o n\u00e3o \u00e9 absoluta. O trabalhador pode <strong>recusar de forma leg\u00edtima<\/strong> quando:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tenha <strong>motivos atend\u00edveis<\/strong>, como responsabilidades familiares inadi\u00e1veis ou problemas de sa\u00fade comprovados;<\/li>\n\n\n\n<li>O pedido <strong>viole os limites legais<\/strong> (di\u00e1rios ou anuais) ou os per\u00edodos m\u00ednimos de descanso;<\/li>\n\n\n\n<li>Se trate de um <strong>pedido abusivo ou discriminat\u00f3rio<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>H\u00e1 ainda grupos que est\u00e3o <strong>dispensados<\/strong> de prestar trabalho suplementar por prote\u00e7\u00e3o legal:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trabalhadoras gr\u00e1vidas, pu\u00e9rperas e lactantes;<\/li>\n\n\n\n<li>Trabalhadores com filhos de idade inferior a 12 meses;<\/li>\n\n\n\n<li>Trabalhadores-estudantes;<\/li>\n\n\n\n<li>Menores;<\/li>\n\n\n\n<li>Trabalhadores com defici\u00eancia ou doen\u00e7a cr\u00f3nica, nas condi\u00e7\u00f5es previstas na lei.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Qual o limite de horas extraordin\u00e1rias por dia e por ano em Portugal?<\/h2>\n\n\n\n<p>O C\u00f3digo do Trabalho fixa limites di\u00e1rios e anuais para o trabalho suplementar. Calcular o valor da hora normal<\/h3>\n\n\n\n<p>A f\u00f3rmula prevista na lei \u00e9:<\/p>\n\n\n\n<p>valor da hora = (retribui\u00e7\u00e3o mensal \u00d7 12) \u00f7 (52 \u00d7 per\u00edodo normal de trabalho semanal)<\/p>\n\n\n\n<p>Para um trabalhador que recebe <strong>1.000 euros<\/strong> brutos e cumpre <strong>40 horas semanais<\/strong>:<\/p>\n\n\n\n<p>(1.000 \u00d7 12) \u00f7 (52 \u00d7 40) = 12.000 \u00f7 2.080 = <strong>5,77 euros por hora<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Aplicar o acr\u00e9scimo<\/h3>\n\n\n\n<p>Se esse trabalhador fizer 3 horas suplementares num dia \u00fatil, dentro das primeiras 100 horas do ano:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1.\u00aa hora: 5,77 + 25% = <strong>7,21 euros<\/strong>;<\/li>\n\n\n\n<li>2.\u00aa e 3.\u00aa horas: 5,77 + 37,5% = <strong>7,93 euros<\/strong> cada;<\/li>\n\n\n\n<li>Total: 7,21 + (7,93 \u00d7 2) = <strong>23,07 euros<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Se as mesmas horas forem prestadas num domingo (dia de descanso), <strong>o acr\u00e9scimo \u00e9 de 50% sobre cada hora<\/strong>, e o trabalhador ganha ainda direito a descanso compensat\u00f3rio.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quanto se paga de trabalho suplementar ao s\u00e1bado, domingo e feriado?<\/h2>\n\n\n\n<p>Em Portugal, o <strong>s\u00e1bado<\/strong> costuma ser dia de descanso complementar e o <strong>domingo<\/strong> dia de descanso semanal obrigat\u00f3rio. O trabalho suplementar nesses dias e em feriados segue estas regras:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>At\u00e9 100 horas anuais:<\/strong> acr\u00e9scimo de <strong>50%<\/strong> por cada hora ou fra\u00e7\u00e3o;<\/li>\n\n\n\n<li><strong>A partir da 101.\u00aa hora:<\/strong> acr\u00e9scimo de <strong>100%<\/strong>, ou seja, a hora \u00e9 paga a dobrar;<\/li>\n\n\n\n<li><strong>Descanso compensat\u00f3rio:<\/strong> o trabalho em dia de descanso semanal obrigat\u00f3rio d\u00e1 ainda direito a um dia de descanso compensat\u00f3rio remunerado.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Descanso compensat\u00f3rio: quem tem direito e como funciona?<\/h2>\n\n\n\n<p>O descanso compensat\u00f3rio est\u00e1 no artigo 229.\u00ba do C\u00f3digo do Trabalho e \u00e9 frequentemente esquecido. A sua n\u00e3o concess\u00e3o constitui <strong>contraordena\u00e7\u00e3o muito grave<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Trabalho suplementar que impede o descanso di\u00e1rio:<\/strong> o trabalhador tem direito a descanso compensat\u00f3rio remunerado equivalente \u00e0s horas de descanso em falta, a gozar num dos <strong>3 dias \u00fateis seguintes<\/strong>.<\/li>\n\n\n\n<li><strong>Trabalho em dia de descanso semanal obrigat\u00f3rio:<\/strong> o trabalhador tem direito a <strong>um dia<\/strong> de descanso compensat\u00f3rio remunerado, a gozar num dos <strong>3 dias \u00fateis seguintes<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>A marca\u00e7\u00e3o faz-se por acordo entre as partes e, na falta de acordo, pelo empregador. Um instrumento de regulamenta\u00e7\u00e3o coletiva <strong>pode substituir este regime <\/strong>por redu\u00e7\u00e3o equivalente do tempo de trabalho, pagamento em dinheiro ou ambos.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como funciona o IRS sobre trabalho suplementar?<\/h2>\n\n\n\n<p>O trabalho suplementar \u00e9 rendimento de trabalho dependente e<strong> est\u00e1 sujeito a IRS <\/strong>e a descontos para a Seguran\u00e7a Social. H\u00e1 dois momentos a distinguir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Reten\u00e7\u00e3o na fonte (mensal):<\/strong> aplica-se ao trabalho suplementar uma taxa correspondente a <strong>50% da taxa<\/strong> que incide sobre a retribui\u00e7\u00e3o mensal, desde a primeira hora. \u00c9 uma reten\u00e7\u00e3o reduzida face \u00e0 do sal\u00e1rio base.<\/li>\n\n\n\n<li><strong>Acerto anual de IRS:<\/strong> o valor recebido <strong>soma-se aos restantes rendimentos<\/strong> (englobamento), o que pode elevar o rendimento colet\u00e1vel e, em alguns casos, o <strong>escal\u00e3o de IRS<\/strong>, com impacto no imposto final.<\/li>\n<\/ul>\n\n\n\n<p>Vale informar o trabalhador deste englobamento para evitar surpresas no acerto anual.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O registo de trabalho suplementar \u00e9 obrigat\u00f3rio? E o banco de horas?<\/h2>\n\n\n\n<p>O empregador \u00e9 obrigado a manter o <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/registo-de-ponto\/\" data-wpel-link=\"internal\" target=\"_blank\">registo dos tempos de trabalho<\/a>, com as horas de in\u00edcio e termo e as interrup\u00e7\u00f5es, e a <strong>conserv\u00e1-lo durante 5 anos<\/strong>. <\/p>\n\n\n\n<p>No trabalho suplementar, o registo deve indicar a <strong>data e a hora de in\u00edcio e termo<\/strong>, antes e depois da presta\u00e7\u00e3o.
