Selon la DARES, seuls deux tiers des salari\u00e9s y gardent leur emploi plus d&#8217;un an. Dans ces conditions, g\u00e9rer les fins de contrat manuellement revient \u00e0 multiplier les risques d&#8217;erreur sur chaque solde de tout compte.<\/p>\n\n\n\n<p>Chaque d\u00e9part implique un calcul de cong\u00e9s acquis non pris, une indemnit\u00e9 compensatrice \u00e0 int\u00e9grer dans le <strong>solde de tout compte<\/strong>, et un dossier \u00e0 cl\u00f4turer sans r\u00e9clamation. Avec 50 d\u00e9parts par mois, ce calcul doit \u00eatre automatis\u00e9 pour \u00eatre fiable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ce qui rend ces secteurs diff\u00e9rents des autres<\/h2>\n\n\n\n<p>Les secteurs \u00e0 forte rotation partagent trois caract\u00e9ristiques que les autres secteurs n&#8217;ont pas simultan\u00e9ment. C&#8217;est cette combinaison qui rend leur <strong>gestion RH structurellement plus complexe<\/strong>, ind\u00e9pendamment de la taille de l&#8217;entreprise.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Un pointage sans point fixe<\/h3>\n\n\n\n<p>Dans la restauration, le nettoyage ou l&#8217;\u00e9v\u00e9nementiel, les <strong>salari\u00e9s ne travaillent pas depuis un bureau<\/strong>. Ils pointent sur chantier, en salle, sur un site client ou lors d&#8217;un \u00e9v\u00e9nement. Le pointage physique via badgeuse est souvent impossible ou inadapt\u00e9. <\/p>\n\n\n\n<p>Ce qu&#8217;il faut \u00e0 la place : un <strong>syst\u00e8me de pointage par g\u00e9olocalisation ou via application mobile<\/strong>, qui enregistre l&#8217;heure et le lieu sans d\u00e9pendre d&#8217;un \u00e9quipement fixe sur site. Un planning qui fonctionne lundi peut \u00eatre obsol\u00e8te mercredi.<\/p>\n\n\n\n<p>Ce niveau de variabilit\u00e9 exige un <strong>outil qui g\u00e8re les \u00e9changes de cr\u00e9neaux, les remplacements et les notifications en temps r\u00e9el<\/strong>, sans recr\u00e9er le planning de z\u00e9ro \u00e0 chaque modification. Dans les secteurs \u00e0 haute rotation, les <strong>fins de contrat sont fr\u00e9quentes et r\u00e9guli\u00e8res<\/strong>. L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020826\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">article L. 3141-3 du Code du Travail<\/a>&nbsp;fixe ce droit \u00e0 <strong>2,5 jours ouvrables par mois de travail effectif<\/strong>. Un salari\u00e9 en CDD d&#8217;un mois qui part sans avoir pris ces jours a donc droit \u00e0 une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s, calcul\u00e9e sur la base de son salaire, \u00e0 int\u00e9grer dans son solde de tout compte.<\/p>\n\n\n\n<p>L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033021067\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">article L. 3141-28 du Code du Travail<\/a>&nbsp;pr\u00e9cise les <strong>modalit\u00e9s de calcul de cette indemnit\u00e9 compensatrice<\/strong> : elle est \u00e9gale au dixi\u00e8me de la r\u00e9mun\u00e9ration brute totale per\u00e7ue au cours de la p\u00e9riode de r\u00e9f\u00e9rence, ou au maintien du salaire si ce calcul est plus favorable au salari\u00e9. En pratique, ce calcul d\u00e9pend du contrat, de la dur\u00e9e travaill\u00e9e et des \u00e9ventuelles primes incluses dans la r\u00e9mun\u00e9ration. Le faire manuellement pour chaque d\u00e9part, dans un secteur o\u00f9 les fins de contrat se comptent en dizaines par mois peut g\u00e9n\u00e9rer des erreurs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les obligations l\u00e9gales \u00e0 respecter dans ces secteurs<\/h2>\n\n\n\n<p>Au socle commun applicable \u00e0 toutes les entreprises s&#8217;ajoutent, dans les secteurs \u00e0 forte rotation, <strong>des contraintes conventionnelles<\/strong> qui renforcent les droits des salari\u00e9s.<\/p>\n\n\n\n<p>L&#8217;obligation de d\u00e9compte du temps de travail (art. L. 3171-2 du Code du Travail) s&#8217;applique sans exception, y compris pour les CDD courts et les extras. Le droit aux cong\u00e9s pay\u00e9s (art. La convention collective nationale des h\u00f4tels, caf\u00e9s, restaurants (HCR) pr\u00e9voit des dispositions sp\u00e9cifiques sur les jours de repos, les majorations pour travail le dimanche et les jours f\u00e9ri\u00e9s. <\/p>\n\n\n\n<p>La convention du commerce de d\u00e9tail encadre les conditions de travail \u00e0 temps partiel. Celle du nettoyage pr\u00e9voit des r\u00e8gles particuli\u00e8res sur le calcul du temps de trajet entre sites. Avant de param\u00e9trer les r\u00e8gles dans l&#8217;outil, v\u00e9rifier la convention applicable \u00e0 votre secteur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ce que \u00e7a implique concr\u00e8tement pour les outils RH<\/h2>\n\n\n\n<p>Le <strong>pointage doit fonctionner sans infrastructure fixe <\/strong>: g\u00e9olocalisation pour les \u00e9quipes terrain, application mobile pour les extras, interface web pour les responsables qui supervisent plusieurs sites.
