Desde ent\u00e3o, o direito foi ampliado para diversas categorias al\u00e9m do trabalhador CLT cl\u00e1ssico.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">T\u00eam direito ao 13\u00ba sal\u00e1rio:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trabalhadores com carteira assinada (CLT), incluindo urbanos, rurais e dom\u00e9sticos;<\/li>\n\n\n\n<li>Trabalhadores avulsos com intermedia\u00e7\u00e3o sindical;<\/li>\n\n\n\n<li>Empregados tempor\u00e1rios, proporcionalmente ao per\u00edodo trabalhado;<\/li>\n\n\n\n<li>Jovens aprendizes registrados em contrato de aprendizagem;<\/li>\n\n\n\n<li>Aposentados e pensionistas do INSS.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">N\u00e3o t\u00eam direito ao 13\u00ba sal\u00e1rio:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Aut\u00f4nomos e prestadores de servi\u00e7o como pessoa jur\u00eddica (PJ);<\/li>\n\n\n\n<li>Estagi\u00e1rios, cujo v\u00ednculo \u00e9 regido pela Lei 11.788\/2008, n\u00e3o pela CLT;<\/li>\n\n\n\n<li>MEI sem funcion\u00e1rio registrado.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">A regra dos 15 dias<\/h3>\n\n\n\n<p>Para fins de c\u00e1lculo, <strong>apenas os meses em que o colaborador trabalhou 15 dias ou mais contam como m\u00eas inteiro<\/strong>. O colaborador admitido no dia 14 de um m\u00eas computa aquele m\u00eas; o admitido no dia 16, n\u00e3o. <\/p>\n\n\n\n<p>Essa regra tamb\u00e9m se aplica a afastamentos: meses com menos de 15 dias trabalhados s\u00e3o desconsiderados no c\u00e1lculo proporcional.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como calcular o 13\u00ba sal\u00e1rio?<\/h2>\n\n\n\n<p>A <strong>f\u00f3rmula base do 13\u00ba sal\u00e1rio<\/strong> \u00e9:<\/p>\n\n\n\n<p class=\"has-text-align-center has-ast-global-color-5-color has-ast-global-color-1-background-color has-text-color has-background has-link-color wp-elements-8a2bef679ebe35d4f1bbdf902c49587e\"><strong>Valor bruto = Sal\u00e1rio bruto \u00f7 12 \u00d7 meses trabalhados no ano<\/strong><\/p>\n\n\n\n<p>Para quem trabalhou o ano inteiro, o valor bruto \u00e9 igual ao sal\u00e1rio bruto de dezembro. Para quem entrou durante o ano, o c\u00e1lculo \u00e9 proporcional.<\/p>\n\n\n\n<p><strong>Aten\u00e7\u00e3o:<\/strong> a base de c\u00e1lculo inclui <strong>horas extras habituais, adicionais (noturno, insalubridade, periculosidade) e comiss\u00f5es recorrentes<\/strong>, calculados pela m\u00e9dia dos valores recebidos no ano.
