O que diz a CLT e a S\u00famula 444 do TST<\/h2>\n\n\n\n<p>A escala 12&#215;36 tem amparo legal consolidado em dois documentos:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Art. 59-A da CLT<\/strong> (inclu\u00eddo pela Reforma Trabalhista de 2017): autoriza a jornada 12&#215;36 mediante <strong>acordo individual escrito, conven\u00e7\u00e3o coletiva ou acordo coletivo de trabalho<\/strong>. Antes da Reforma, a ado\u00e7\u00e3o dependia exclusivamente de negocia\u00e7\u00e3o coletiva, o que gerava inseguran\u00e7a jur\u00eddica para empresas que operavam o regime sem amparo sindical.<\/li>\n\n\n\n<li><strong>S\u00famula 444 do TST:<\/strong> reconhece a validade da escala 12&#215;36 e consolida o entendimento de que a <strong>remunera\u00e7\u00e3o mensal j\u00e1 abrange o DSR e os feriados<\/strong>, desde que acordado entre as partes.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">O que mudou na escala 12&#215;36 com a Reforma Trabalhista de 2017?<\/h3>\n\n\n\n<p>Antes de novembro de 2017, a escala 12&#215;36 s\u00f3 era permitida por conven\u00e7\u00e3o ou acordo coletivo. Com a Reforma, <strong>o acordo individual escrito entre empregado e empregador passou a ser suficiente<\/strong> para formalizar o regime.<\/p>\n\n\n\n<p>Isso simplificou a ado\u00e7\u00e3o em empresas de menor porte e em setores sem forte representa\u00e7\u00e3o sindical, mas criou uma responsabilidade adicional para o DP: <strong>o acordo precisa estar documentado<\/strong>. <\/p>\n\n\n\n<p>Empresas que operam a 12&#215;36 sem acordo formalizado est\u00e3o expostas a reclama\u00e7\u00f5es trabalhistas que podem questionar toda a jornada retroativamente.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Intervalo intrajornada na escala 12&#215;36<\/h3>\n\n\n\n<p>O trabalhador em jornada de 12 horas tem direito a <strong>intervalo intrajornada m\u00ednimo de 1 hora<\/strong> para descanso e alimenta\u00e7\u00e3o. O art. 59-A da CLT permite que esse intervalo seja <strong>indenizado em dinheiro<\/strong> se n\u00e3o for concedido, no valor de 50% da hora normal.<\/p>\n\n\n\n<p><em>\u26a0\ufe0f <strong>Aten\u00e7\u00e3o DP:<\/strong> a indeniza\u00e7\u00e3o do intervalo n\u00e3o elimina a obriga\u00e7\u00e3o de conced\u00ea-lo. Em setores como sa\u00fade, onde a continuidade do atendimento pode impossibilitar o intervalo, o DP deve registrar a supress\u00e3o e garantir o pagamento correto, caso contr\u00e1rio o risco de passivo em fiscaliza\u00e7\u00e3o \u00e9 alto.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Feriado, DSR e adicional noturno na escala 12&#215;36: o que o DP precisa calcular?<\/h2>\n\n\n\n<p>Este \u00e9 o bloco onde mais se erra. A 12&#215;36 tem um tratamento diferente da maioria dos outros regimes, e o DP precisa ter clareza sobre tr\u00eas pontos espec\u00edficos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">DSR e feriados j\u00e1 est\u00e3o embutidos no sal\u00e1rio<\/h3>\n\n\n\n<p>O <strong>par\u00e1grafo \u00fanico do art. 59-A da CLT<\/strong> estabelece que a <strong>remunera\u00e7\u00e3o mensal do trabalhador em escala 12&#215;36 j\u00e1 inclui o DSR e os feriados<\/strong>, considerados compensados pela pr\u00f3pria estrutura da jornada.<\/p>\n\n\n\n<p>Na pr\u00e1tica:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O trabalhador <strong>n\u00e3o recebe DSR separado<\/strong>, ao contr\u00e1rio do que ocorre na escala 6&#215;1.<\/li>\n\n\n\n<li>O trabalhador <strong>n\u00e3o tem direito a pagamento em dobro por trabalhar em feriado<\/strong> na regra geral.<\/li>\n\n\n\n<li>O sal\u00e1rio mensal j\u00e1 embute essa compensa\u00e7\u00e3o.<\/li>\n<\/ul>\n\n\n\n<p><strong>Exce\u00e7\u00e3o importante:<\/strong> conven\u00e7\u00f5es coletivas podem prever pagamento adicional por feriado trabalhado. Na escala 12&#215;36 noturna, esse c\u00e1lculo tem uma particularidade que multiplica o erro:<\/p>\n\n\n\n<p>A CLT define a <strong>hora noturna como equivalente a 52 minutos e 30 segundos<\/strong> (a chamada \u00abhora ficta\u00bb). Isso significa que, para fins de c\u00e1lculo do adicional, cada hora real trabalhada no per\u00edodo noturno \u00e9 computada como uma hora inteira de 60 minutos, gerando um n\u00famero de horas noturnas superior ao que o rel\u00f3gio indica.<\/p>\n\n\n\n<p><strong>Por exemplo:<\/strong> um plant\u00e3o das 19h \u00e0s 7h tem 12 horas reais, mas inclui horas entre 22h e 5h.
