{"id":62010,"date":"2026-06-19T13:59:26","date_gmt":"2026-06-19T12:59:26","guid":{"rendered":"https:\/\/www.bizneo.com\/blog\/?p=62010"},"modified":"2026-06-19T13:59:28","modified_gmt":"2026-06-19T12:59:28","slug":"escala-6x1","status":"publish","type":"post","link":"https:\/\/www.bizneo.com\/blog\/pt\/escala-6x1\/","title":{"rendered":"Escala 6&#215;1: como funciona, regras da CLT e o que muda com a PEC"},"content":{"rendered":"\n<p>A <strong>escala 6&#215;1<\/strong> regula a jornada de mais de 22 milh\u00f5es de trabalhadores no Brasil e est\u00e1 no centro do maior debate trabalhista desde a Reforma de 2017. <\/p>\n\n\n\n<p>Varejistas, hospitais e redes de alimenta\u00e7\u00e3o dependem dela para operar 7 dias por semana, e o RH precisa dominar suas regras para n\u00e3o errar no DSR, no registro de ponto e no planejamento da transi\u00e7\u00e3o que est\u00e1 em tramita\u00e7\u00e3o no Senado.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Escala 6&#215;1: o que \u00e9 e como funciona?<\/h2>\n\n\n\n<p>A <strong>escala de trabalho 6&#215;1<\/strong> \u00e9 um regime em que o trabalhador cumpre <strong>6 dias de trabalho consecutivos seguidos de 1 dia de folga<\/strong>, em ciclo rotativo. <\/p>\n\n\n\n<p>N\u00e3o se trata de trabalhar de segunda a s\u00e1bado com folga fixa no domingo: a folga gira ao longo das semanas, conforme o calend\u00e1rio definido pela empresa.<\/p>\n\n\n\n<p>Esse \u00e9 um ponto que gera erro operacional frequente nas empresas: <strong>tratar a folga como fixa quando ela \u00e9 rotativa<\/strong>. A diferen\u00e7a tem implica\u00e7\u00e3o direta no c\u00e1lculo do DSR (Descanso Semanal Remunerado) e no n\u00famero de domingos compensados por m\u00eas.<\/p>\n\n\n\n<p>A escala 6&#215;1 \u00e9 comum em:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Varejo e com\u00e9rcio<\/strong> (shoppings, supermercados, farm\u00e1cias)<\/li>\n\n\n\n<li><strong>Sa\u00fade<\/strong> (hospitais, cl\u00ednicas, laborat\u00f3rios)<\/li>\n\n\n\n<li><strong>Alimenta\u00e7\u00e3o e hospedagem<\/strong> (restaurantes, hot\u00e9is, bares)<\/li>\n\n\n\n<li><strong>Seguran\u00e7a e vigil\u00e2ncia<\/strong><\/li>\n\n\n\n<li><strong>Servi\u00e7os essenciais com opera\u00e7\u00e3o 7 dias por semana<\/strong><\/li>\n<\/ul>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/escala-de-trabalho\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>Escala de Trabalho<\/strong><\/span><br \/>Entenda como montar uma escala eficiente para diferentes jornadas e modelos de equipe.<\/a><\/bzn-info>\n\n\n\n<h2 class=\"wp-block-heading\">Jornada de trabalho na escala 6&#215;1: horas di\u00e1rias, semanais e mensais<\/h2>\n\n\n\n<p>A <strong>carga hor\u00e1ria da escala 6&#215;1<\/strong> \u00e9 fixada pelo art. 58 da CLT em <strong>44 horas semanais<\/strong>. Na pr\u00e1tica, isso se divide em <strong>7 horas e 20 minutos por dia<\/strong> quando distribu\u00edda uniformemente nos 6 dias.<\/p>\n\n\n\n<p>Muitas empresas optam por 8 horas di\u00e1rias de segunda a sexta e 4 horas no sexto dia. Qualquer hora trabalhada al\u00e9m disso \u00e9 <strong>hora extra<\/strong>, sujeita a adicional m\u00ednimo de 50% (ou 100% em domingos e feriados, conforme conven\u00e7\u00e3o coletiva).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Escala 6&#215;1 pela CLT: o que diz a legisla\u00e7\u00e3o<\/h2>\n\n\n\n<p>A escala 6&#215;1 tem amparo legal em dois diplomas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Art. 67 da CLT:<\/strong> determina que o empregado tem direito a repouso semanal remunerado de <strong>24 horas consecutivas<\/strong>, preferencialmente aos domingos. A palavra \u00abpreferencialmente\u00bb \u00e9 o que permite que a folga seja rotativa: ela n\u00e3o precisa cair sempre no domingo.<\/li>\n\n\n\n<li><strong>Lei 605\/1949:<\/strong> regulamenta o <strong>Descanso Semanal Remunerado (DSR)<\/strong>. Estabelece que o trabalhador tem direito a descanso de 24 horas por semana, sem preju\u00edzo de sal\u00e1rio. O DSR \u00e9 pago mesmo quando a folga cai em dia \u00fatil.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Como funciona o DSR na escala 6&#215;1?<\/h3>\n\n\n\n<p>O c\u00e1lculo do DSR na escala 6&#215;1 \u00e9 um dos pontos que mais gera erro no DP. O trabalhador tem direito a 1 dia de descanso por semana. <\/p>\n\n\n\n<p><strong>Esse dia \u00e9 remunerado<\/strong>, n\u00e3o descontado do sal\u00e1rio.<\/p>\n\n\n\n<p>Para calcular o valor do DSR:<\/p>\n\n\n\n<pre class=\"wp-block-verse\"><strong>F\u00f3rmula:<\/strong> Sal\u00e1rio mensal \u00f7 (dias trabalhados no m\u00eas + dias de DSR) \u00d7 dias de DSR<\/pre>\n\n\n\n<p>Ou seja, o DSR j\u00e1 est\u00e1 embutido no sal\u00e1rio mensal do trabalhador em escala 6&#215;1. Para a escala 6&#215;1, esse controle \u00e9 especialmente cr\u00edtico: a folga rotativa precisa ser registrada com precis\u00e3o para garantir a conformidade com o DSR e evitar autua\u00e7\u00f5es da fiscaliza\u00e7\u00e3o do trabalho.<\/p>\n\n\n\n<p>Empresas que n\u00e3o registram corretamente a jornada de trabalhadores em escala rotativa est\u00e3o sujeitas a <strong>multas de R$ 40,25 por empregado n\u00e3o registrado<\/strong> (valor base, sujeito a multiplicadores por reincid\u00eancia, conforme art. 634 da CLT).<\/p>\n\n\n\n<bzn-warning><a href=\"\/blog\/pt\/controle-de-ponto\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>Controle de Ponto <\/strong><\/span><br \/>Entenda como registrar, acompanhar e gerenciar a jornada dos colaboradores de forma simples e eficiente.<\/a><\/bzn-warning>\n\n\n\n<h2 class=\"wp-block-heading\">Vantagens e desvantagens da escala 6&#215;1<\/h2>\n\n\n\n<p>A avalia\u00e7\u00e3o da escala 6&#215;1 depende diretamente do ponto de vista. A mudan\u00e7a est\u00e1 em tramita\u00e7\u00e3o no Congresso Nacional, mas <strong>n\u00e3o foi aprovada definitivamente<\/strong>. <strong>A escala 6&#215;1 segue legal e vigente hoje.<\/strong><\/p>\n\n\n\n<p>O que o RH precisa entender \u00e9 o estado real do processo legislativo, n\u00e3o o que circula nas redes sociais.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">O que foi aprovado na C\u00e2mara dos Deputados<\/h3>\n\n\n\n<p>Em <strong>27 de maio de 2026<\/strong>, a C\u00e2mara dos Deputados aprovou, em dois turnos, a <strong><a href=\"https:\/\/www.camara.leg.br\/proposicoesWeb\/fichadetramitacao?idProposicao=2231756\" rel=\"nofollow noopener\" data-wpel-link=\"external\" target=\"_blank\">PEC 221\/2019<\/a><\/strong>, com <strong>461 votos favor\u00e1veis e 19 contr\u00e1rios<\/strong> no segundo turno. O texto estabelece:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Jornada m\u00e1xima de 40 horas semanais<\/strong> (redu\u00e7\u00e3o das atuais 44h)<\/li>\n\n\n\n<li><strong>2 dias de descanso por semana<\/strong> como regra (escala 5&#215;2)<\/li>\n\n\n\n<li><strong>Sem redu\u00e7\u00e3o salarial:<\/strong> os sal\u00e1rios s\u00e3o mantidos com a jornada menor<\/li>\n\n\n\n<li><strong>Transi\u00e7\u00e3o em dois est\u00e1gios:<\/strong>\n<ul class=\"wp-block-list\">\n<li>60 dias ap\u00f3s promulga\u00e7\u00e3o: escala 5&#215;2 com jornada de 42h semanais<\/li>\n\n\n\n<li>14 meses ap\u00f3s promulga\u00e7\u00e3o: jornada reduz para 40h semanais<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>Ponto cr\u00edtico para o RH:<\/strong> o texto aprovado na C\u00e2mara <strong>n\u00e3o extingue a escala 6&#215;1 completamente<\/strong>.
