Ce mode d&#8217;organisation cr\u00e9e une conviction r\u00e9pandue : le pointage serait une contrainte r\u00e9serv\u00e9e aux secteurs industriels ou \u00e0 la restauration.<\/p>\n\n\n\n<p>L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033516016\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">article L. 3171-2 du Code du Travail<\/a>\u00a0ne pr\u00e9voit <strong>aucune exception sectorielle<\/strong>. Toute entreprise, quelle que soit son activit\u00e9, est tenue de d\u00e9compter le temps de travail de ses salari\u00e9s, en pr\u00e9sentiel comme \u00e0 distance. Comprendre ce que cela implique concr\u00e8tement dans le secteur tech, c&#8217;est \u00e9viter un risque l\u00e9gal souvent sous-estim\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Une obligation l\u00e9gale qui ne conna\u00eet pas d&#8217;exception sectorielle<\/h2>\n\n\n\n<p>L&#8217;article L. 3171-2 du Code du Travail\u00a0impose \u00e0 tout employeur de <strong>d\u00e9compter le temps de travail effectif de chaque salari\u00e9<\/strong>. Ce n&#8217;est pas une position juridiquement d\u00e9fendable : en cas de <strong>contr\u00f4le de l&#8217;Inspection du Travail ou de litige prud&#8217;homal<\/strong>, l&#8217;employeur doit \u00eatre en mesure de produire les donn\u00e9es de d\u00e9compte.<\/p>\n\n\n\n<p>L&#8217;absence de syst\u00e8me expose \u00e0 des <strong>sanctions administratives ou p\u00e9nales<\/strong> appliqu\u00e9es par salari\u00e9 concern\u00e9. Ce qui varie dans le secteur tech, c&#8217;est la configuration de travail et les contrats les plus fr\u00e9quents, deux facteurs qui d\u00e9terminent comment cette obligation se met en oeuvre concr\u00e8tement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le t\u00e9l\u00e9travail structurel, pas occasionnel<\/h3>\n\n\n\n<p>Dans la plupart des secteurs, le t\u00e9l\u00e9travail est une modalit\u00e9 parmi d&#8217;autres. Dans le <strong>secteur technologique<\/strong>, il constitue souvent le mode de travail dominant : full remote, hybride avec deux \u00e0 quatre jours par semaine \u00e0 distance, \u00e9quipes r\u00e9parties sur plusieurs villes ou pays. <\/p>\n\n\n\n<p>Cette <strong>configuration ne modifie pas l&#8217;obligation de d\u00e9compte<\/strong>, mais elle impose que l&#8217;outil utilis\u00e9 soit accessible hors des locaux, sans d\u00e9pendance \u00e0 un r\u00e9seau interne ou \u00e0 une badgeuse physique. Ce <strong>r\u00e9gime d\u00e9roge au d\u00e9compte en heures<\/strong> : ce sont les jours travaill\u00e9s qui sont comptabilis\u00e9s, dans la limite d&#8217;un plafond annuel fix\u00e9 par accord collectif (218 jours par d\u00e9faut).<\/p>\n\n\n\n<p>L&#8217;employeur reste tenu de <strong>suivre le nombre de jours effectivement travaill\u00e9s<\/strong> et de s&#8217;assurer que le salari\u00e9 respecte les repos quotidiens et hebdomadaires. L&#8217;exception concerne les services de support ou d&#8217;astreinte fonctionnant en continu : \u00e9quipes d&#8217;infrastructure, service client 24h\/24, op\u00e9rations critiques. <\/p>\n\n\n\n<p>Dans ce cas uniquement, la <strong>gestion des plannings s&#8217;ajoute au contr\u00f4le horaire simple<\/strong>, avec les m\u00eames contraintes que dans les secteurs industriels (couverture des cr\u00e9neaux, gestion des \u00e9changes, respect des repos entre deux postes). Elle impose un r\u00e9sultat : \u00eatre capable de produire, pour chaque salari\u00e9, les <strong>donn\u00e9es de temps de travail effectif sur une p\u00e9riode donn\u00e9e<\/strong>. Dans le contexte tech, cela se traduit par quatre exigences pratiques.<\/p>\n\n\n\n<p>L&#8217;outil doit \u00eatre <strong>accessible sans pr\u00e9sence physique<\/strong> dans les locaux : application mobile, interface web ou saisie manuelle depuis n&#8217;importe quel poste. Il doit couvrir les deux populations contractuelles dominantes dans le secteur : <strong>salari\u00e9s en horaires classiques<\/strong> (d\u00e9compte en heures) et <strong>cadres en forfait jours<\/strong> (d\u00e9compte en jours).
