A Portaria MTE n\u00ba 1.419\/2024 tornou obrigat\u00f3ria a inclus\u00e3o de <strong>riscos psicossociais<\/strong> no Programa de Gerenciamento de Riscos (PGR) de todas as empresas com regime CLT. <\/p>\n\n\n\n<p>Burnout, ass\u00e9dio e sobrecarga agora integram formalmente o sistema de preven\u00e7\u00e3o. Empresas sem adequa\u00e7\u00e3o est\u00e3o sujeitas a multas de at\u00e9 <strong>R$ 6.708,08 por item<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">O que \u00e9 a NR-1 e qual \u00e9 o seu papel no sistema de seguran\u00e7a do trabalho<\/h3>\n\n\n\n<p>A <strong>Norma Regulamentadora n\u00ba 1 (NR-1)<\/strong> \u00e9 a base de todo o sistema de seguran\u00e7a e sa\u00fade no trabalho no Brasil. <\/p>\n\n\n\n<p>Publicada pelo Minist\u00e9rio do Trabalho e Emprego (MTE) com fundamento na CLT, ela define as regras gerais que empregadores e trabalhadores devem cumprir para garantir um ambiente de trabalho seguro e saud\u00e1vel. Funciona como norma-m\u00e3e: orienta e estrutura todas as demais normas regulamentadoras.<\/p>\n\n\n\n<p>\u00c9 a NR-1 que estrutura o <strong>Gerenciamento de Riscos Ocupacionais (GRO)<\/strong>, que se materializa no <strong>Programa de Gerenciamento de Riscos (PGR)<\/strong>, o documento central de preven\u00e7\u00e3o de cada empresa. O PGR re\u00fane o invent\u00e1rio de riscos, as medidas de controle e o plano de a\u00e7\u00e3o com prazos e respons\u00e1veis definidos.<\/p>\n\n\n\n<p>Antes da atualiza\u00e7\u00e3o de 2024, esse invent\u00e1rio cobria riscos f\u00edsicos, qu\u00edmicos, biol\u00f3gicos e ergon\u00f4micos. A Portaria MTE n\u00ba 1.419\/2024 incluiu uma quinta categoria obrigat\u00f3ria: os <strong>riscos psicossociais<\/strong>. <\/p>\n\n\n\n<p>Na pr\u00e1tica, esses fatores j\u00e1 se traduzem em <strong>absente\u00edsmo<\/strong>, afastamentos por burnout e queda de produtividade. A <strong>Portaria MTE n\u00ba 765\/2025<\/strong> prorrogou o per\u00edodo educativo por mais um ano. <\/p>\n\n\n\n<p>Em mar\u00e7o de 2026, a Comiss\u00e3o Tripartite Parit\u00e1ria Permanente (CTPP) reafirmou a manuten\u00e7\u00e3o do cronograma sem possibilidade de novo adiamento. A fiscaliza\u00e7\u00e3o punitiva come\u00e7ou em <strong>26 de maio de 2026<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que muda na NR-1?<\/h2>\n\n\n\n<p><strong>Riscos psicossociais<\/strong> s\u00e3o fatores relacionados \u00e0 organiza\u00e7\u00e3o do trabalho que comprometem a sa\u00fade mental e emocional dos trabalhadores. O MTE inclui no escopo da NR-1:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ass\u00e9dio moral e sexual<\/strong><\/li>\n\n\n\n<li><strong>Sobrecarga de trabalho e jornadas exaustivas<\/strong><\/li>\n\n\n\n<li><strong>Metas inalcan\u00e7\u00e1veis e press\u00e3o desproporcional<\/strong><\/li>\n\n\n\n<li><strong>Conflitos interpessoais e viol\u00eancia no ambiente de trabalho<\/strong><\/li>\n\n\n\n<li><strong>Burnout e esgotamento ocupacional<\/strong><\/li>\n\n\n\n<li><strong>Aus\u00eancia de suporte da lideran\u00e7a<\/strong><\/li>\n<\/ul>\n\n\n\n<p>As doen\u00e7as emocionais j\u00e1 s\u00e3o a <strong>terceira maior causa de afastamento do trabalho no Brasil<\/strong>, segundo o <a href=\"https:\/\/observaportosst.mpt.mp.br\/\" rel=\"nofollow noopener\" data-wpel-link=\"external\" target=\"_blank\">Observat\u00f3rio de Seguran\u00e7a e Sa\u00fade no Trabalho<\/a>, com dados do INSS. A fonte precisa ser rastre\u00e1vel e datada para servir como evid\u00eancia.<\/li>\n\n\n\n<li><strong>Identifica\u00e7\u00e3o dos perigos<\/strong> Listar os fatores concretos de risco: tipo de jornada, estilo de gest\u00e3o, volume de demandas, exist\u00eancia de canais de escuta e de pol\u00edticas anti-ass\u00e9dio formalizadas.<\/li>\n\n\n\n<li><strong>Avalia\u00e7\u00e3o e classifica\u00e7\u00e3o dos riscos<\/strong> Estimar probabilidade e severidade de cada fator. A metodologia escolhida precisa estar documentada e justificada no pr\u00f3prio PGR.<\/li>\n\n\n\n<li><strong>Invent\u00e1rio de riscos<\/strong> Registrar os riscos identificados com caracter\u00edsticas, trabalhadores expostos e medidas de controle existentes. \u00c9 o documento que o auditor fiscal solicita primeiro em uma autua\u00e7\u00e3o.<\/li>\n\n\n\n<li><strong>Plano de a\u00e7\u00e3o<\/strong> Definir medidas preventivas e corretivas com respons\u00e1vel, prazo e crit\u00e9rio de acompanhamento. A <strong>capacita\u00e7\u00e3o de lideran\u00e7as<\/strong> \u00e9 uma das medidas mais cobradas nessa etapa. O RH segue respons\u00e1vel pela coleta de dados e pelo monitoramento cont\u00ednuo do ambiente de trabalho, independentemente do porte da empresa.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quais s\u00e3o as penalidades por descumprimento da NR-1?<\/h2>\n\n\n\n<p>Empresas com PGR que n\u00e3o inclui os fatores psicossociais est\u00e3o sujeitas a autua\u00e7\u00f5es desde 26 de maio de 2026. As penalidades previstas pela <strong>NR-28<\/strong> incluem:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Multas entre R$ 2.396,35 e R$ 6.708,08 por item<\/strong> autuado, com valores maiores em casos de reincid\u00eancia ou resist\u00eancia \u00e0 fiscaliza\u00e7\u00e3o<\/li>\n\n\n\n<li><strong>Interdi\u00e7\u00e3o de setores<\/strong> em casos de risco grave e iminente<\/li>\n\n\n\n<li><strong>A\u00e7\u00f5es trabalhistas<\/strong> por danos morais e \u00e0 sa\u00fade dos trabalhadores<\/li>\n\n\n\n<li><strong>A\u00e7\u00e3o regressiva do INSS<\/strong> quando afastamentos por doen\u00e7as ocupacionais forem comprovados<\/li>\n<\/ul>\n\n\n\n<p>H\u00e1 ainda um impacto financeiro que a maioria dos gestores n\u00e3o contabiliza: o descumprimento da NR-1 pode elevar o <strong>FAP (Fator Acident\u00e1rio de Preven\u00e7\u00e3o)<\/strong>, o que aumenta o RAT e encarece a folha de pagamento de forma recorrente. Uma autua\u00e7\u00e3o pela Inspe\u00e7\u00e3o do Trabalho abre precedente para a\u00e7\u00e3o regressiva do INSS e para reclama\u00e7\u00f5es trabalhistas de qualquer colaborador que tenha sido afastado por burnout ou ass\u00e9dio nos \u00faltimos anos, independentemente de quando o fato ocorreu. <\/p>\n\n\n\n<p>Empresas que postergaram a adequa\u00e7\u00e3o n\u00e3o est\u00e3o apenas sem PGR: est\u00e3o com passivo acumulado.
