A Autoridade para as Condi\u00e7\u00f5es do Trabalho tem intensificado inspec\u00e7\u00f5es em v\u00e1rios sectores e n\u00e3o avisa antes.<\/p>\n\n\n\n<p>O que define hoje um registo v\u00e1lido \u00e9 o art. 202.\u00ba do C\u00f3digo do Trabalho, refor\u00e7ado pela<a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/lei\/93-2019-124417106\" rel=\"nofollow noopener\" data-wpel-link=\"external\" target=\"_blank\"> Lei n.\u00ba 93\/2019,<\/a> que estendeu a obriga\u00e7\u00e3o ao teletrabalho e exige o registo di\u00e1rio com hora de in\u00edcio e de fim. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que \u00e9 o registo de ponto<\/h2>\n\n\n\n<p>O registo de ponto \u00e9 o processo de documentar os hor\u00e1rios de in\u00edcio, pausas e fim de cada jornada de trabalho. Essa documenta\u00e7\u00e3o \u00e9 a prova formal de que a empresa respeita os <strong>limites do C\u00f3digo do Trabalho<\/strong> em rela\u00e7\u00e3o ao hor\u00e1rio de trabalho e ao pagamento correcto de <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/hora-extra\/\" data-wpel-link=\"internal\" target=\"_blank\">horas extraordin\u00e1rias<\/a>.<\/p>\n\n\n\n<p>Para o gestor ou respons\u00e1vel de RH, <strong>o registo de ponto serve a tr\u00eas prop\u00f3sitos<\/strong>: garantir conformidade legal perante a ACT, fornecer dados precisos para o processamento de sal\u00e1rios e detectar padr\u00f5es de excesso de horas antes que se tornem passivo laboral.<\/p>\n\n\n\n<p>Registo de ponto e <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/controlo-de-ponto\/\" data-wpel-link=\"internal\" target=\"_blank\">controlo de ponto<\/a><strong> n\u00e3o s\u00e3o sin\u00f3nimos<\/strong>. O segundo \u00e9 a gest\u00e3o completa do tempo de trabalho: registo, tratamento, c\u00e1lculo de horas e gera\u00e7\u00e3o de relat\u00f3rios.<\/p>\n\n\n\n<bzn-link><a href=\"https:\/\/hello.bizneo.com\/template\/modelo-controle-ponto\/?utm_content=Opt-in-blog\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>Folha de Ponto<\/strong><\/span><br \/>Descarregue o modelo Excel de registo de ponto para os seus trabalhadores<\/a><\/bzn-link>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que diz o art. 202.\u00ba do C\u00f3digo do Trabalho sobre registo de ponto<\/h2>\n\n\n\n<p>O art. 202.\u00ba do C\u00f3digo do Trabalho determina que todas as empresas s\u00e3o <strong>obrigadas a registar os tempos de trabalho<\/strong> de cada trabalhador, sem qualquer limiar m\u00ednimo de dimens\u00e3o.<\/p>\n\n\n\n<p>A <strong>Lei n.\u00ba 93\/2019<\/strong> refor\u00e7ou esta obriga\u00e7\u00e3o, exigindo o registo di\u00e1rio com hora de in\u00edcio e de fim da jornada, incluindo o teletrabalho.<\/p>\n\n\n\n<p>Os limites que o registo deve monitorizar s\u00e3o: jornada m\u00e1xima de 8h di\u00e1rias e 40h semanais, intervalo obrigat\u00f3rio para refei\u00e7\u00e3o e descanso, e limite de horas extraordin\u00e1rias por ano<strong> fixado por lei<\/strong> ou conven\u00e7\u00e3o colectiva.<\/p>\n\n\n\n<p>Quando a empresa n\u00e3o consegue apresentar registos v\u00e1lidos numa inspec\u00e7\u00e3o da ACT, a infrac\u00e7\u00e3o configura contraordena\u00e7\u00e3o grave. As coimas v\u00e3o de<strong> \u20ac204 a \u20ac2.040<\/strong> nas infrac\u00e7\u00f5es simples e podem atingir <strong>\u20ac9.690<\/strong> por trabalhador nas situa\u00e7\u00f5es mais graves ou de reincid\u00eancia.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">O que a ACT verifica numa inspec\u00e7\u00e3o ao registo de ponto?<\/h3>\n\n\n\n<p>A <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/act-controlo-ponto\/\" data-wpel-link=\"internal\" target=\"_blank\">ACT<\/a> n\u00e3o verifica apenas se existem registos;<strong> verifica como s\u00e3o feitos<\/strong>, onde est\u00e3o guardados, durante quanto tempo e se podem ser auditados. <\/p>\n\n\n\n<p>Um ficheiro Excel sem rastreabilidade ou um papel sem consist\u00eancia <strong>n\u00e3o t\u00eam valor legal <\/strong>s\u00f3lido perante a Autoridade para as Condi\u00e7\u00f5es do Trabalho. A ACT tem intensificado inspec\u00e7\u00f5es em sectores com hor\u00e1rios longos, turnos rotativos e elevado n\u00famero de horas extraordin\u00e1rias.<\/p>\n\n\n\n<bzn-warning><a href=\"\/blog\/pt\/act-controlo-ponto\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span class=\"bzn-info-title\"><strong>Controlo de Ponto e ACT<\/strong> <\/span><br>Obriga\u00e7\u00f5es legais e san\u00e7\u00f5es em Portugal.<\/a><\/br><\/bzn-warning>\n\n\n\n<h2 class=\"wp-block-heading\">Tipos de registo de ponto: manual, electr\u00f3nico e digital<\/h2>\n\n\n\n<p>Os principais tipos incluem m\u00e9todos manuais (folhas de ponto, tamb\u00e9m chamadas folhas de presen\u00e7a) e sistemas eletr\u00f3nicos, como rel\u00f3gios de ponto f\u00edsicos (cart\u00e3o\/biometria) ou softwares\/aplica\u00e7\u00f5es m\u00f3veis. H\u00e1 situa\u00e7\u00f5es em que o registo pode ser dispensado, mas todas exigem amparo contratual ou legal antes de serem aplicadas.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trabalhadores em regime de isen\u00e7\u00e3o de hor\u00e1rio precisam de fazer registo de ponto?<\/h3>\n\n\n\n<p>Em rigor, o art. 202.\u00ba obriga ao registo dos tempos de trabalho<strong> mesmo dos trabalhadores isentos de hor\u00e1rio<\/strong>; a dispensa total \u00e9 rar\u00edssima e contest\u00e1vel em inspec\u00e7\u00e3o. <\/p>\n\n\n\n<p>A recomenda\u00e7\u00e3o pr\u00e1tica da generalidade dos juristas<strong> \u00e9 manter registo tamb\u00e9m para os isentos<\/strong>, ainda que sob regime simplificado.<\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/controlo-de-assiduidade\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span class=\"bzn-info-title\"><strong>Controlo de Assiduidade<\/strong> <\/span><br>Como registar presen\u00e7a e pontualidade em qualquer regime de trabalho.<\/a><\/br><\/bzn-info>\n\n\n\n<h3 class=\"wp-block-heading\">Registo de ponto no teletrabalho: o que diz o C\u00f3digo do Trabalho<\/h3>\n\n\n\n<p>A <strong>Lei n.\u00ba 93\/2019<\/strong> \u00e9 expl\u00edcita: a obriga\u00e7\u00e3o de registo de ponto aplica-se tamb\u00e9m ao teletrabalho. <\/p>\n\n\n\n<p>N\u00e3o existe dispensa autom\u00e1tica por modalidade de trabalho remoto. Em inspec\u00e7\u00e3o, os registos s\u00e3o considerados inv\u00e1lidos e a empresa <strong>passa a responder pelas horas que o trabalhador alegar.<\/strong><\/li>\n\n\n\n<li><strong>N\u00e3o conservar os registos pelo prazo m\u00ednimo de 5 anos:<\/strong> O C\u00f3digo do Trabalho exige a conserva\u00e7\u00e3o dos registos de ponto durante <strong>5 anos<\/strong>. Sem hist\u00f3rico, a empresa fica indefesa em lit\u00edgios que envolvam per\u00edodos anteriores. Sistemas digitais com armazenamento em nuvem resolvem isto automaticamente.<\/li>\n\n\n\n<li><strong>N\u00e3o fazer registo de ponto no teletrabalho<\/strong>: A Lei n.\u00ba 93\/2019 eliminou qualquer ambiguidade: o registo aplica-se ao teletrabalho. Empresas que tratam trabalhadores remotos como dispensados do registo sem suporte contratual e legal espec\u00edfico est\u00e3o em <strong>incumprimento directo.<\/strong><\/li>\n\n\n\n<li><strong>Registar correctamente mas desrespeitar os limites de jornada do C\u00f3digo do Trabalho<\/strong>: O registo prova as horas trabalhadas, mas<strong> n\u00e3o autoriza jornadas acima do limite legal<\/strong>. O primeiro passo \u00e9 <strong>mapear quantos trabalhadores t\u00eam regimes distintos<\/strong>: presencial, teletrabalho, campo ou turnos rotativos. Cada regime exige um m\u00e9todo diferente e o sistema escolhido tem de cobrir todos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Passo 2: Verifique as obriga\u00e7\u00f5es RGPD antes de adoptar biometria ou geolocaliza\u00e7\u00e3o<\/h3>\n\n\n\n<p>Reconhecimento facial e geolocaliza\u00e7\u00e3o s\u00e3o dados pessoais sens\u00edveis ao abrigo do RGPD. Antes de activar estes m\u00e9todos, confirme com o jur\u00eddico que existem bases legais documentadas, que os trabalhadores foram informados e que <strong>o sistema n\u00e3o recolhe dados al\u00e9m do necess\u00e1rio<\/strong> para o registo da jornada. A ACT e a CNPD podem fiscalizar em simult\u00e2neo.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Passo 3: Configure os limites de jornada e horas extraordin\u00e1rias de cada perfil<\/h3>\n\n\n\n<p>Defina toler\u00e2ncias, alertas de proximidade ao limite e regras de banco de horas para cada contrato: hor\u00e1rio fixo, flex\u00edvel ou <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/turnos-de-trabalho\/\" data-wpel-link=\"internal\" target=\"_blank\">turnos de trabalho<\/a>. Em Portugal, o limite anual de horas extraordin\u00e1rias<strong> varia conforme o instrumento de regulamenta\u00e7\u00e3o colectiva<\/strong>, portanto configure o sistema com o valor correcto para a categoria da empresa.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Passo 4: Garanta que o sistema gera registos audit\u00e1veis desde o primeiro dia<\/h3>\n\n\n\n<p>A ACT n\u00e3o avisa antes de inspeccionar. O sistema tem de produzir desde o arranque registos com hora real de in\u00edcio e fim, hist\u00f3rico de altera\u00e7\u00f5es rastre\u00e1vel e assinatura do trabalhador, os tr\u00eas elementos que a Autoridade para as Condi\u00e7\u00f5es do Trabalho <strong>exige para considerar os registos v\u00e1lidos.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Passo 5: Monitorize os primeiros 30 dias com foco nas inconsist\u00eancias<\/h3>\n\n\n\n<p>Os primeiros 30 dias revelam trabalhadores que n\u00e3o <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/picar-ponto\/\" data-wpel-link=\"internal\" target=\"_blank\">picam o ponto<\/a> no intervalo, <strong>perfis mal configurados e alertas a disparar incorrectamente<\/strong>.
