Um erro de verba, um prazo perdido ou uma multa de FGTS mal aplicada pode transformar uma rescis\u00e3o rotineira em uma reclama\u00e7\u00e3o trabalhista.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>O que muda no c\u00e1lculo de rescis\u00e3o conforme o tipo de demiss\u00e3o?<\/strong><\/h2>\n\n\n\n<p>O tipo de rescis\u00e3o define quais verbas s\u00e3o devidas, qual percentual de multa de FGTS se aplica e se h\u00e1 aviso pr\u00e9vio indenizado. O c\u00f3digo errado bloqueia o saque e invalida o seguro-desemprego quando aplic\u00e1vel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Como calcular o saldo de sal\u00e1rio na rescis\u00e3o?<\/strong><\/h2>\n\n\n\n<p>O saldo cobre os dias trabalhados no m\u00eas da demiss\u00e3o, calculados sobre o sal\u00e1rio bruto dividido por 30. \u00c9 a verba mais simples, mas erros de contagem de dias geram autua\u00e7\u00f5es em fiscaliza\u00e7\u00f5es do MTE.<\/p>\n\n\n\n<p><strong>Saldo de sal\u00e1rio = (sal\u00e1rio bruto \/ 30) x dias trabalhados no m\u00eas<\/strong><\/p>\n\n\n\n<p>Se houver horas extras habituais, adicionais ou comiss\u00f5es, a base precisa refletir a m\u00e9dia dos \u00faltimos 12 meses (art. 487, \u00a7 1\u00ba da CLT).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Como calcular o aviso pr\u00e9vio proporcional?<\/strong><\/h2>\n\n\n\n<p>O aviso \u00e9 de 30 dias para at\u00e9 1 ano de empresa, acrescido de 3 dias por ano completo de servi\u00e7o, at\u00e9 o limite de 90 dias (Lei 12.506\/2011, art. 1\u00ba).<\/p>\n\n\n\n<p><strong>Dias de aviso = 30 + (anos completos x 3), limitado a 90 dias<\/strong><\/p>\n\n\n\n<p>Se o aviso for indenizado, o DP tamb\u00e9m recolhe FGTS de 8% sobre esse valor, pois ele integra a remunera\u00e7\u00e3o para fins fundi\u00e1rios (S\u00famula 305 do TST).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Como calcular as f\u00e9rias na rescis\u00e3o CLT?<\/strong><\/h2>\n\n\n\n<p>As f\u00e9rias se dividem em dois blocos com bases e incid\u00eancias tribut\u00e1rias diferentes.<\/p>\n\n\n\n<p><strong>F\u00e9rias vencidas<\/strong> s\u00e3o pagas integralmente com o adicional de 1\/3 constitucional, com incid\u00eancia de INSS e IRRF.<\/p>\n\n\n\n<p><strong>F\u00e9rias proporcionais<\/strong> correspondem aos meses completos do per\u00edodo aquisitivo em curso, acrescidas de 1\/3. N\u00e3o s\u00e3o devidas em caso de justa causa (art. 146, par\u00e1grafo \u00fanico da CLT).<\/p>\n\n\n\n<p><strong>F\u00e9rias proporcionais = (sal\u00e1rio bruto \/ 12) x meses completos do per\u00edodo aquisitivo<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Como calcular o 13\u00ba sal\u00e1rio proporcional na rescis\u00e3o?<\/strong><\/h2>\n\n\n\n<p>O 13\u00ba \u00e9 calculado pelos meses trabalhados no ano, contando o m\u00eas da rescis\u00e3o se o colaborador tiver trabalhado pelo menos 15 dias nele (art. 1\u00ba, \u00a7 1\u00ba da Lei 4.090\/1963).<\/p>\n\n\n\n<p><strong>13\u00ba proporcional = (sal\u00e1rio bruto \/ 12) x meses contados<\/strong><\/p>\n\n\n\n<p>Demiss\u00e3o no dia 20 de outubro: contam 10 meses. No dia 8: contam 9.
