Un mod\u00e8le formalis\u00e9 et relu attentivement reste fortement recommand\u00e9 pour s\u00e9curiser les deux parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Peut-on annuler une promesse d\u2019embauche ?<\/h2>\n\n\n\n<p>Une <strong>promesse d\u2019embauche<\/strong> engageant les deux parties, sa rupture n\u2019est pas sans cons\u00e9quence juridique.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Les cas de rupture autoris\u00e9e<\/h3>\n\n\n\n<p>L\u2019annulation d\u2019une promesse d\u2019embauche reste possible dans certains cas pr\u00e9cis. Elle peut intervenir <strong>d\u2019un commun accord entre l\u2019employeur et le candidat<\/strong>, ou si <strong>une condition suspensive express\u00e9ment pr\u00e9vue<\/strong> ne se r\u00e9alise pas, comme l\u2019obtention d\u2019un dipl\u00f4me ou d\u2019un titre de s\u00e9jour. <\/p>\n\n\n\n<p>Enfin, <strong>un \u00e9v\u00e9nement de force majeure ou un motif l\u00e9gitime impr\u00e9visible<\/strong> (tel que la disparition de l\u2019entreprise) peut \u00e9galement justifier une rupture sans engager la responsabilit\u00e9 de l\u2019employeur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Les risques juridiques en cas de r\u00e9tractation abusive<\/h3>\n\n\n\n<p>En dehors de ces cas sp\u00e9cifiques, une rupture unilat\u00e9rale par l\u2019employeur expose celui-ci \u00e0 plusieurs risques :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le versement de <strong>dommages et int\u00e9r\u00eats<\/strong> pour compenser le pr\u00e9judice subi par le candidat (perte d\u2019opportunit\u00e9s, d\u00e9m\u00e9nagement anticip\u00e9, rupture d\u2019un autre contrat),<\/li>\n\n\n\n<li>dans certains cas, une <strong>requalification en licenciement injustifi\u00e9<\/strong>, notamment si le salari\u00e9 avait d\u00e9j\u00e0 d\u00e9missionn\u00e9 pour rejoindre l\u2019entreprise.<\/li>\n<\/ul>\n\n\n\n<p>La prudence reste donc de mise avant de revenir sur un engagement formalis\u00e9 par une <strong>promesse d\u2019embauche<\/strong> valide.
