Le <strong>Code du Travail<\/strong> distingue les absences express\u00e9ment encadr\u00e9es par la loi, pour lesquelles l&#8217;employeur ne peut pas refuser le cong\u00e9, et celles qui rel\u00e8vent de la politique interne de l&#8217;entreprise.<\/p>\n\n\n\n<p>Pour les \u00e9v\u00e9nements familiaux, les <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006195795\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">articles L3142-1 \u00e0 L3142<\/a>-4 fixent un socle minimal obligatoire, applicable \u00e0 tous les salari\u00e9s quel que soit leur contrat ou leur anciennet\u00e9. Elle d\u00e9pend du motif de l&#8217;absence et des r\u00e8gles en vigueur dans l&#8217;entreprise.<\/p>\n\n\n\n<p>Certaines absences imposent un justificatif formel sans exception :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>L&#8217;arr\u00eat maladie ou accident<\/strong> : le salari\u00e9 doit transmettre son certificat m\u00e9dical \u00e0 l&#8217;employeur dans les 48 heures suivant le d\u00e9but de l&#8217;arr\u00eat, conform\u00e9ment aux r\u00e8gles URSSAF. Pass\u00e9 ce d\u00e9lai, l&#8217;employeur est en droit de contester la prise en charge. <\/li>\n\n\n\n<li><strong>Les cong\u00e9s pour \u00e9v\u00e9nements familiaux<\/strong> : l&#8217;acte officiel correspondant (acte de mariage, acte de naissance, certificat de d\u00e9c\u00e8s) doit \u00eatre fourni pour d\u00e9clencher le droit au cong\u00e9 l\u00e9gal. <\/li>\n\n\n\n<li><strong>Le cong\u00e9 pour enfant malade<\/strong> : un certificat m\u00e9dical attestant la pathologie et la n\u00e9cessit\u00e9 de pr\u00e9sence parentale est requis.<\/li>\n<\/ul>\n\n\n\n<p>Pour les autres absences personnelles, rendez-vous m\u00e9dicaux ponctuels, d\u00e9marches administratives ou obligations familiales ne relevant pas d&#8217;un cong\u00e9 l\u00e9gal, l&#8217;exigence d&#8217;un justificatif d\u00e9pend du r\u00e8glement int\u00e9rieur de l&#8217;entreprise. Le RH a int\u00e9r\u00eat \u00e0 formaliser ces r\u00e8gles par \u00e9crit pour \u00e9viter toute in\u00e9galit\u00e9 de traitement entre salari\u00e9s.<\/p>\n\n\n\n<p>En cas d&#8217;absence non justifi\u00e9e, l&#8217;employeur peut appliquer une retenue sur salaire proportionnelle \u00e0 la dur\u00e9e de l&#8217;absence et engager une proc\u00e9dure disciplinaire.
