La confusion sur les <strong>droits applicables<\/strong> (dur\u00e9e minimale garantie, pouvoir de l&#8217;employeur, r\u00e8gles pour les contrats courts) g\u00e9n\u00e8re des demandes mal orient\u00e9es, des conflits \u00e9vitables et des erreurs administratives en paie.<\/p>\n\n\n\n<p> Ce que la <strong>loi encadre<\/strong> avec pr\u00e9cision : la dur\u00e9e minimale garantie, le r\u00f4le de l&#8217;employeur dans la fixation des dates, et les cas particuliers comme les CDD ou les fermetures d&#8217;entreprise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u2019est-ce que la r\u00e8gle des semaines cons\u00e9cutives obligatoires ?<\/h2>\n\n\n\n<p>Chaque ann\u00e9e, de nombreux salari\u00e9s s\u2019interrogent sur le nombre de semaines cons\u00e9cutives qu\u2019ils peuvent exiger pour leurs <strong>cong\u00e9s d\u2019\u00e9t\u00e9<\/strong>. La confusion vient souvent d\u2019une croyance r\u00e9pandue : celle d\u2019un droit automatique \u00e0 <strong>trois semaines cons\u00e9cutives de vacances estivales<\/strong>.<\/p>\n\n\n\n<p>En r\u00e9alit\u00e9, le <strong>Code du travail<\/strong> pr\u00e9voit bien une protection pour les salari\u00e9s, mais dans des termes pr\u00e9cis. Selon l\u2019article <strong>L3141-17<\/strong>, chaque salari\u00e9 doit b\u00e9n\u00e9ficier d\u2019un <strong>cong\u00e9 principal d\u2019au moins deux semaines cons\u00e9cutives<\/strong> lorsqu\u2019il pose ses <a href=\"\/blog\/fr\/conges\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">cong\u00e9s<\/a> pendant la p\u00e9riode l\u00e9gale. Cette p\u00e9riode dite l\u00e9gale vise \u00e0 permettre aux salari\u00e9s de b\u00e9n\u00e9ficier de leurs cong\u00e9s pendant la saison estivale, tout en laissant une certaine souplesse \u00e0 l&#8217;employeur dans la gestion des dates pr\u00e9cises.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le r\u00f4le de l\u2019employeur dans la planification des cong\u00e9s d\u2019\u00e9t\u00e9<\/h3>\n\n\n\n<p>L\u2019employeur reste ma\u00eetre de l\u2019organisation des <strong>cong\u00e9s estivaux<\/strong>, sous r\u00e9serve de respecter certains principes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fixer les dates de cong\u00e9s en tenant compte des n\u00e9cessit\u00e9s de service<\/strong>, mais \u00e9galement des souhaits des salari\u00e9s.<\/li>\n\n\n\n<li><strong>Consulter le comit\u00e9 social et \u00e9conomique (CSE)<\/strong> lorsqu\u2019il existe, pour avis sur l\u2019ordre des d\u00e9parts.<\/li>\n\n\n\n<li>Respecter un <strong>d\u00e9lai d&#8217;information minimum<\/strong> des salari\u00e9s sur les dates fix\u00e9es : au moins un mois avant le d\u00e9part pr\u00e9vu selon l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020374\" data-wpel-link=\"external\" target=\"_blank\" rel=\"noopener\">L3141-16<\/a>, sauf dispositions conventionnelles plus favorables.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Cas sp\u00e9cifiques fr\u00e9quents<\/h3>\n\n\n\n<p>Dans certaines entreprises, des situations particuli\u00e8res s&#8217;appliquent pendant la <strong>p\u00e9riode estivale<\/strong> :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fermeture annuelle de l&#8217;entreprise<\/strong> pendant les vacances obligatoires d&#8217;\u00e9t\u00e9 (fr\u00e9quent dans l&#8217;industrie, le b\u00e2timent ou les PME).<\/li>\n\n\n\n<li><strong>Roulement des \u00e9quipes<\/strong> pour maintenir une activit\u00e9 minimale.<\/li>\n\n\n\n<li><strong>Mise en place d\u2019un service minimum<\/strong> dans les secteurs o\u00f9 la continuit\u00e9 du service est indispensable.<\/li>\n<\/ul>\n\n\n\n<p>Chaque entreprise peut donc adapter son organisation, \u00e0 condition de rester dans le cadre fix\u00e9 par la loi et les conventions collectives applicables.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cong\u00e9 de fractionnement : quand des jours suppl\u00e9mentaires sont dus<\/h2>\n\n\n\n<p>Lorsque le salari\u00e9 prend une partie de son cong\u00e9 principal en dehors de la p\u00e9riode l\u00e9gale (1er mai \u2013 31 octobre), il peut b\u00e9n\u00e9ficier de jours suppl\u00e9mentaires dits de fractionnement, pr\u00e9vus par l&#8217;article L3141-23 du Code du travail :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>1 jour suppl\u00e9mentaire<\/strong> si le nombre de jours pris hors p\u00e9riode est compris entre 3 et 5 jours ouvrables.<\/li>\n\n\n\n<li><strong>2 jours suppl\u00e9mentaires<\/strong> si ce nombre est \u00e9gal ou sup\u00e9rieur \u00e0 6 jours ouvrables.<\/li>\n<\/ul>\n\n\n\n<p>Ces jours s&#8217;appliquent sauf renonciation \u00e9crite du salari\u00e9 ou disposition contraire d&#8217;un accord collectif. L&#8217;employeur ne peut pas les supprimer unilat\u00e9ralement.<\/p>\n\n\n\n<div id=\"cbox-4lHZzEpMiUZHjpnz\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Est-ce que l\u2019employeur peut imposer les dates de cong\u00e9s d\u2019\u00e9t\u00e9 ?<\/h2>\n\n\n\n<p>Contrairement \u00e0 une id\u00e9e re\u00e7ue, l&#8217;employeur peut effectivement <strong>imposer les dates des cong\u00e9s d&#8217;\u00e9t\u00e9<\/strong>, sous r\u00e9serve de respecter certaines r\u00e8gles strictes encadr\u00e9es par le Code du travail.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le pouvoir d\u2019organisation des cong\u00e9s d\u2019\u00e9t\u00e9 de l\u2019employeur<\/h3>\n\n\n\n<p>L\u2019organisation des <strong>vacances estivales<\/strong> rel\u00e8ve de la responsabilit\u00e9 de l\u2019employeur.
