{"id":54428,"date":"2025-11-12T17:07:58","date_gmt":"2025-11-12T16:07:58","guid":{"rendered":"https:\/\/www.bizneo.com\/blog\/?p=54428"},"modified":"2026-05-05T22:29:12","modified_gmt":"2026-05-05T21:29:12","slug":"pagamento-de-ferias-na-clt","status":"publish","type":"post","link":"https:\/\/www.bizneo.com\/blog\/pt\/pagamento-de-ferias-na-clt\/","title":{"rendered":"Pagamento de f\u00e9rias na CLT: prazo, c\u00e1lculo, encargos e erros que geram passivo"},"content":{"rendered":"\n<p>O <strong>pagamento de f\u00e9rias na CLT<\/strong> envolve prazo, composi\u00e7\u00e3o e encargos espec\u00edficos e os tr\u00eas precisam estar corretos antes de o colaborador sair de f\u00e9rias.<\/p>\n\n\n\n<p>O valor <strong>n\u00e3o se resume ao sal\u00e1rio do m\u00eas<\/strong>. Inclui a m\u00e9dia de vari\u00e1veis dos \u00faltimos 12 meses, o 1\/3 constitucional e os encargos corretos sobre cada verba. <\/p>\n\n\n\n<p>Segundo o TST, erros no c\u00e1lculo de vari\u00e1veis e f\u00e9rias vencidas acumuladas est\u00e3o entre <strong>as principais causas de a\u00e7\u00f5es trabalhistas no Brasil.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que diz a CLT sobre o pagamento de f\u00e9rias<\/h2>\n\n\n\n<p>O direito \u00e0s f\u00e9rias est\u00e1 previsto no Art. 129 da CLT e no Art. 7\u00ba, XVII, da Constitui\u00e7\u00e3o Federal. A cada 12 meses de contrato, ou seja o <strong>per\u00edodo aquisitivo<\/strong>, o colaborador adquire 30 dias corridos de descanso remunerado.<\/p>\n\n\n\n<p>A contagem come\u00e7a na data de admiss\u00e3o,<strong> n\u00e3o no ano civil<\/strong>. Admiss\u00e3o em 15 de mar\u00e7o de 2024 \u2192 per\u00edodo aquisitivo completo em 14 de mar\u00e7o de 2025.<\/p>\n\n\n\n<p>Ap\u00f3s o per\u00edodo aquisitivo, a empresa tem mais 12 meses para conceder as f\u00e9rias: o <strong>per\u00edodo concessivo<\/strong>. F\u00e9rias n\u00e3o concedidas dentro desse prazo geram obriga\u00e7\u00e3o de pagamento em dobro (Art. 137 da CLT). Esse passivo cresce de forma silenciosa em empresas sem controle de vencimentos por colaborador.<\/p>\n\n\n\n<bzn-note><a href=\"\/blog\/pt\/controle-de-ferias\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>Controle de F\u00e9rias<\/strong><\/span><br \/>Automatize sua gest\u00e3o de f\u00e9rias.<\/a><\/bzn-note>\n\n\n\n<h2 class=\"wp-block-heading\">Pagamento de f\u00e9rias em Portugal: o que diz o C\u00f3digo do Trabalho<\/h2>\n\n\n\n<p>Em Portugal, o direito \u00e0s f\u00e9rias \u00e9 regulado pelo C\u00f3digo do Trabalho (Art. 237.\u00ba e seguintes). As diferen\u00e7as estruturais em rela\u00e7\u00e3o \u00e0 CLT s\u00e3o relevantes para empresas que operam nos dois pa\u00edses:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Dura\u00e7\u00e3o:<\/strong> 22 dias \u00fateis por ano, n\u00e3o dias corridos como no Brasil<\/li>\n\n\n\n<li><strong>Subs\u00eddio de f\u00e9rias:<\/strong> verba adicional equivalente \u00e0 remunera\u00e7\u00e3o do per\u00edodo de gozo, paga separadamente, sem equivalente na CLT brasileira<\/li>\n\n\n\n<li><strong>Pagamento:<\/strong> deve ocorrer antes do in\u00edcio das f\u00e9rias, regra similar \u00e0 brasileira mas com base legal distinta<\/li>\n<\/ul>\n\n\n\n<p>O <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/controlo-de-ferias\/\" data-wpel-link=\"internal\" target=\"_blank\">controlo de f\u00e9rias em Portugal<\/a> detalha as obriga\u00e7\u00f5es espec\u00edficas, incluindo regras de marca\u00e7\u00e3o, acumula\u00e7\u00e3o e impacto de aus\u00eancias no direito anual.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prazo para pagamento de f\u00e9rias na CLT: o que diz o Art. 145?<\/h2>\n\n\n\n<p>O Art. 145 da CLT determina que o pagamento das f\u00e9rias deve ser quitado <strong>at\u00e9 2 dias antes do in\u00edcio do per\u00edodo de gozo<\/strong>, incluindo o 1\/3 constitucional e o abono pecuni\u00e1rio, quando houver.<\/p>\n\n\n\n<p>Esse prazo se aplica <strong>a cada per\u00edodo individualmente<\/strong> em caso de fracionamento. Tr\u00eas per\u00edodos fracionados = tr\u00eas datas de pagamento, cada uma 2 dias antes do respectivo in\u00edcio.<\/p>\n\n\n\n<div id=\"cbox-CZ6beVo9FCVwXgDv\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">O que acontece se a empresa n\u00e3o pagar as f\u00e9rias no prazo?<\/h3>\n\n\n\n<p>Duas situa\u00e7\u00f5es com consequ\u00eancias distintas:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Atraso no pagamento do prazo de 2 dias (Art. 145): <\/strong><\/h4>\n\n\n\n<p>O STF declarou <strong>inconstitucional<\/strong> a S\u00famula 450\/TST, que determinava dobra autom\u00e1tica por esse motivo. <\/p>\n\n\n\n<p>Quando as f\u00e9rias foram concedidas dentro do per\u00edodo concessivo, o atraso no pagamento<strong> n\u00e3o gera mais a dobra autom\u00e1tica. <\/strong><\/p>\n\n\n\n<p>A empresa ainda fica exposta a<strong> autua\u00e7\u00f5es administrativas e a\u00e7\u00f5es trabalhistas<\/strong>, mas n\u00e3o pela dobra desse fundamento espec\u00edfico.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>N\u00e3o concess\u00e3o dentro do per\u00edodo concessivo (Art. 137):<\/strong> <\/h4>\n\n\n\n<p>O pagamento em dobro <strong>\u00e9<\/strong> <strong>obrigat\u00f3rio<\/strong>. Se os 12 meses do per\u00edodo concessivo venceram sem que as f\u00e9rias tenham sido concedidas, a dobra \u00e9 devida independentemente de qualquer outro fator.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Aviso de f\u00e9rias: prazo m\u00ednimo de 30 dias antes do in\u00edcio<\/h3>\n\n\n\n<p>O Art. 135 da CLT exige comunica\u00e7\u00e3o formal ao colaborador com <strong>anteced\u00eancia m\u00ednima de 30 dias<\/strong>, por escrito e mediante recibo.<\/p>\n\n\n\n<p>A aus\u00eancia do <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/aviso-de-ferias\/\" data-wpel-link=\"internal\" target=\"_blank\">aviso de f\u00e9rias<\/a> n\u00e3o invalida o pagamento, <strong>mas cria irregularidade formal<\/strong> que pode ser usada em a\u00e7\u00f5es trabalhistas. R$ 2.400 em horas extras no ano = R$ 200 de m\u00e9dia mensal que entra na base de f\u00e9rias.<\/p>\n\n\n\n<p>Empresas que calculam as f\u00e9rias apenas sobre o sal\u00e1rio base acumulam t\u00e9rmino do per\u00edodo aquisitivo, o colaborador <strong>tem direito a <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/como-calcular-ferias-proporcionais\/\" data-wpel-link=\"internal\" target=\"_blank\">f\u00e9rias proporcionais<\/a><\/strong> aos meses completos trabalhados.<\/p>\n\n\n\n<p><strong>F\u00f3rmula:<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow demiss\u00e3o e t\u00e9rmino de contrato por prazo determinado.<\/p>\n\n\n\n<p> Na demiss\u00e3o por justa causa, o colaborador perde as proporcionais do per\u00edodo em curso, mas mant\u00e9m o conforme entendimento da PGFN.<\/p>\n\n\n\n<p>Misturar as rubricas de gozo e abono num mesmo lan\u00e7amento gera recolhimentos incorretos e pode<strong> resultar em autua\u00e7\u00e3o fiscal. <\/strong>O DP precisa parametrizar as rubricas separadamente no sistema de folha.<\/p>\n\n\n\n<p>O IRRF sobre f\u00e9rias \u00e9 calculado <strong>separadamente da remunera\u00e7\u00e3o mensal<\/strong>, aplicando a tabela progressiva do m\u00eas do pagamento. <\/p>\n\n\n\n<p>O FGTS incide \u00e0 al\u00edquota de <strong>8% sobre o bruto das f\u00e9rias gozadas<\/strong> e do 1\/3, depositado no prazo normal da compet\u00eancia.<\/p>\n\n\n\n<p>O <a href=\"https:\/\/www.bizneo.com\/br\/gestao-ferias\/\" data-wpel-link=\"internal\" target=\"_blank\">software de gest\u00e3o de permite converter at\u00e9 1\/3 das f\u00e9rias em dinheiro: o colaborador recebe o valor de 10 dias em esp\u00e9cie e goza os 20 restantes.<\/p>\n\n\n\n<p><strong>Regras operacionais:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pedido feito pelo colaborador at\u00e9 <strong>15 dias antes do fim do per\u00edodo aquisitivo<\/strong><\/li>\n\n\n\n<li>Prazo decadencial \u2014 perdido o prazo, perde-se o direito para aquele per\u00edodo<\/li>\n\n\n\n<li>A empresa n\u00e3o pode recusar pedido feito dentro do prazo<\/li>\n\n\n\n<li>N\u00e3o se aplica a f\u00e9rias coletivas<\/li>\n<\/ul>\n\n\n\n<p><strong>C\u00e1lculo:<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Abono = (Sal\u00e1rio \u00f7 30) \u00d7 10 + 1\/3 sobre os 30 dias integrais<\/p>\n<\/blockquote>\n\n\n\n<p>O 1\/3 incide sobre os <strong>30 dias integrais<\/strong>, mesmo que o colaborador goze apenas 20.
