Ce jour f\u00e9ri\u00e9, souvent associ\u00e9 au repos, est en r\u00e9alit\u00e9 n\u00e9 d\u2019un combat pour de meilleures conditions de travail.<\/p>\n\n\n\n<p>Que signifie vraiment la F\u00eate du Travail ?<strong> Est-elle automatiquement r\u00e9mun\u00e9r\u00e9e ? Tous les salari\u00e9s peuvent-ils s\u2019absenter ? <\/strong>Voici tout ce qu\u2019il faut savoir sur ce jour si particulier du calendrier professionnel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quelle est l\u2019origine de la F\u00eate du Travail ?<\/h2>\n\n\n\n<p>Avant d\u2019\u00eatre un<strong> jour f\u00e9ri\u00e9 en France, le 1er mai<\/strong> est d\u2019abord un symbole international des luttes ouvri\u00e8res. C\u2019est aux \u00c9tats-Unis, \u00e0 la fin du XIXe si\u00e8cle, que tout commence. En 1886, des milliers d\u2019ouvriers manifestent pour obtenir la journ\u00e9e de huit heures. La gr\u00e8ve g\u00e9n\u00e9rale est lanc\u00e9e le 1er mai. Elle d\u00e9bouche sur des affrontements violents, notamment \u00e0 Chicago, o\u00f9 plusieurs travailleurs perdent la vie. Cet \u00e9pisode marquant deviendra un point de ralliement pour les syndicats \u00e0 travers le monde.<\/p>\n\n\n\n<p>En France, la premi\u00e8re c\u00e9l\u00e9bration du <strong>1er mai comme F\u00eate des Travailleurs<\/strong> remonte \u00e0 1891. Ce jour-l\u00e0, dans la ville de Fourmies, une manifestation pacifique tourne au drame : neuf morts, dont plusieurs adolescents, sous les balles des forces de l\u2019ordre. L\u2019\u00e9motion est immense. L\u2019histoire s\u2019ancre.<\/p>\n\n\n\n<p>C\u2019est finalement en 1947 que le gouvernement fran\u00e7ais inscrit le 1er mai dans la loi comme <strong>jour f\u00e9ri\u00e9 ch\u00f4m\u00e9 et pay\u00e9<\/strong>, exclusivement consacr\u00e9 \u00e0 la F\u00eate du Travail. \u00c0 la diff\u00e9rence d\u2019autres jours f\u00e9ri\u00e9s, ce jour-l\u00e0<strong> n\u2019est pas rattach\u00e9 \u00e0 un \u00e9v\u00e9nement religieux ou civil<\/strong>, mais \u00e0 une revendication sociale universelle : la reconnaissance du travail et des droits des salari\u00e9s.<\/p>\n\n\n\n<div id=\"cbox-4lHZzEpMiUZHjpnz\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La F\u00eate du Travail est-elle un jour f\u00e9ri\u00e9 et pay\u00e9 ?<\/h2>\n\n\n\n<p>Le <strong>1er mai<\/strong>, jour de la <strong>F\u00eate du Travail<\/strong>, occupe une place \u00e0 part dans le calendrier fran\u00e7ais. Contrairement aux autres jours f\u00e9ri\u00e9s, sa sp\u00e9cificit\u00e9 est double : <strong>il est \u00e0 la fois f\u00e9ri\u00e9, ch\u00f4m\u00e9 et pay\u00e9 pour tous les salari\u00e9s<\/strong>, quel que soit leur contrat ou leur anciennet\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">F\u00eate du Travail : un jour f\u00e9ri\u00e9 pas comme les autres<\/h3>\n\n\n\n<p>La l\u00e9gislation fran\u00e7aise est tr\u00e8s claire : <strong>le 1er mai est le seul jour f\u00e9ri\u00e9 obligatoirement ch\u00f4m\u00e9 et pay\u00e9<\/strong>, sans condition d\u2019anciennet\u00e9 ou de pr\u00e9sence le jour pr\u00e9c\u00e9dent. Cela signifie que m\u00eame si le salari\u00e9 est en arr\u00eat maladie, en cong\u00e9 maternit\u00e9 ou embauch\u00e9 r\u00e9cemment, il per\u00e7oit sa r\u00e9mun\u00e9ration comme s\u2019il avait travaill\u00e9.<\/p>\n\n\n\n<p>La seule exception ? Les secteurs d\u2019activit\u00e9 <strong>dont la nature ne permet pas l\u2019interruption du travail<\/strong>, comme les h\u00f4pitaux, les transports, les forces de l\u2019ordre ou encore l\u2019h\u00f4tellerie-restauration. Dans ces cas pr\u00e9cis, le travail le 1er mai est autoris\u00e9, mais il ouvre droit \u00e0 <strong>une majoration de salaire<\/strong>, g\u00e9n\u00e9ralement <strong>au moins \u00e9gale au double<\/strong>, sauf dispositions plus favorables pr\u00e9vues par la convention collective.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Jour f\u00e9ri\u00e9 ch\u00f4m\u00e9 ou travaill\u00e9 : quelle diff\u00e9rence ?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Un jour f\u00e9ri\u00e9 ch\u00f4m\u00e9<\/strong> signifie que le salari\u00e9 ne travaille pas, mais reste pay\u00e9.<\/li>\n\n\n\n<li><strong>Un jour f\u00e9ri\u00e9 travaill\u00e9<\/strong>, comme cela peut arriver pour d\u2019autres dates du calendrier, d\u00e9pend souvent d\u2019accords d\u2019entreprise ou de conventions collectives. Ce n\u2019est pas le cas du 1er mai : le ch\u00f4mage est la r\u00e8gle, sauf exception.<\/li>\n<\/ul>\n\n\n\n<p>Cette distinction est essentielle pour bien comprendre les droits li\u00e9s \u00e0 la F\u00eate du Travail. Cela concerne en priorit\u00e9 les services dits \u00ab essentiels \u00bb : <strong>sant\u00e9, s\u00e9curit\u00e9, transports, h\u00f4tellerie-restauration, \u00e9nergie<\/strong>, etc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dans quels cas le travail est-il autoris\u00e9 le 1er mai ?<\/h3>\n\n\n\n<p>L\u2019article L3133-6 du Code du travail autorise le travail le 1er mai <strong>uniquement dans les \u00e9tablissements qui, en raison de la nature de leur activit\u00e9, ne peuvent interrompre leur fonctionnement<\/strong>. C\u2019est le cas des services hospitaliers, des pompiers ou encore des \u00e9tablissements ouverts 7 jours sur 7.<\/p>\n\n\n\n<p>En dehors de ces exceptions, un employeur ne peut pas imposer \u00e0 un salari\u00e9 de venir travailler ce jour-l\u00e0.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Majoration de salaire : une obligation<\/h3>\n\n\n\n<p>Travailler le 1er mai ouvre automatiquement droit \u00e0 une <strong>majoration de salaire<\/strong>. Le minimum l\u00e9gal est une r\u00e9mun\u00e9ration <strong>double<\/strong>, c\u2019est-\u00e0-dire <strong>200 % du taux horaire normal<\/strong>. Certaines conventions collectives peuvent aller au-del\u00e0, en ajoutant un jour de repos compensateur ou une prime suppl\u00e9mentaire.<\/p>\n\n\n\n<p>Ce dispositif est <strong>obligatoire<\/strong>, m\u00eame si le contrat du salari\u00e9 ne pr\u00e9voit rien \u00e0 ce sujet.
