Pour les cadres autonomes en forfait-jour, ce plancher est fix\u00e9 \u00e0 <strong>3 925 \u20ac brut mensuel<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Comment calculer le salaire mensuel minimum<\/h2>\n\n\n\n<p>Multiplier le taux horaire applicable par le nombre d&#8217;heures mensuelles r\u00e9elles. Exemple : un employ\u00e9 Niveau II \u00c9chelon 1 travaillant 39h par semaine doit percevoir au minimum <strong>2 075,32 \u20ac brut mensuel<\/strong> (12,28 \u20ac \u00d7 169 heures).<\/p>\n\n\n\n<p><strong>\u00c0 noter<\/strong> : la v\u00e9rification du respect du minima s&#8217;effectue heure par heure. Certains \u00e9l\u00e9ments sont exclus du calcul, les primes, les avantages en nature, les remboursements de frais et les sommes li\u00e9es \u00e0 la participation n&#8217;entrent pas dans la base de comparaison.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Heures suppl\u00e9mentaires et temps de travail dans le secteur HCR<\/h2>\n\n\n\n<p>Dans le secteur HCR, la dur\u00e9e conventionnelle de travail est fix\u00e9e \u00e0 <strong>39 heures par semaine<\/strong>, contre 35 heures dans le droit commun. Cette sp\u00e9cificit\u00e9 s&#8217;explique par la nature de l&#8217;activit\u00e9 : continuit\u00e9 de service, pics d&#8217;activit\u00e9 le week-end et les jours f\u00e9ri\u00e9s, amplitude horaire structurellement plus large que dans les autres branches. Les \u00e9tablissements HCR recourent fr\u00e9quemment \u00e0 des <a href=\"\/blog\/fr\/types-horaire-de-travail\/\" data-wpel-link=\"internal\" target=\"_blank\">types d&#8217;horaires de travail<\/a> d\u00e9cal\u00e9s qui amplifient le volume d&#8217;heures suppl\u00e9mentaires \u00e0 suivre.<\/p>\n\n\n\n<p>Les heures effectu\u00e9es entre la 36e et la 39e heure font partie de la dur\u00e9e conventionnelle normale. Au-del\u00e0 de 39 heures, les majorations suivantes s&#8217;appliquent conform\u00e9ment \u00e0 l&#8217;avenant n\u00b01 du 13 juillet 2004 (IDCC 1979) :<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Heures suppl\u00e9mentaires<\/strong><\/td><td><strong>Majoration<\/strong><\/td><\/tr><tr><td>4 premi\u00e8res heures (40e \u00e0 43e)<\/td><td>+15 %<\/td><\/tr><tr><td>4 heures suivantes (44e \u00e0 47e)<\/td><td>+25 %<\/td><\/tr><tr><td>Au-del\u00e0<\/td><td>+50 %<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Ces majorations peuvent \u00eatre remplac\u00e9es par un <strong>repos compensateur de remplacement<\/strong>, \u00e0 condition que ce remplacement soit organis\u00e9 au niveau de l&#8217;entreprise dans un d\u00e9lai de 3 mois. Dans ce cas, les taux de repos appliqu\u00e9s sont respectivement de 115 %, 125 % et 150 %.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que l&#8217;employeur doit int\u00e9grer dans le bulletin de paie<\/h3>\n\n\n\n<p>Le bulletin doit faire appara\u00eetre distinctement le <strong>nombre d&#8217;heures suppl\u00e9mentaires effectu\u00e9es<\/strong>, les droits acquis en repos compensateur le cas \u00e9ch\u00e9ant, et les majorations appliqu\u00e9es. L&#8217;employeur est par ailleurs tenu de tenir un registre ou document individuel des horaires r\u00e9els, \u00e9marg\u00e9 par le salari\u00e9 au moins une fois par semaine et consultable par l&#8217;Inspection du Travail \u00e0 tout moment. Ces avantages sont soumis \u00e0 cotisations sociales et \u00e9valu\u00e9s selon des bar\u00e8mes fix\u00e9s par l&#8217;URSSAF, mis \u00e0 jour au 1er janvier 2026.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Repas fourni par l&#8217;employeur<\/h3>\n\n\n\n<p>Pour les salari\u00e9s des h\u00f4tels, caf\u00e9s, restaurants et bars, le repas est \u00e9valu\u00e9 sur la base du <strong>Minimum Garanti (MG)<\/strong>, et non sur la base forfaitaire du cas g\u00e9n\u00e9ral :<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Nombre de repas<\/td><td>Montant 2026<\/td><\/tr><tr><td>1 repas<\/td><td>4,25 \u20ac<\/td><\/tr><tr><td>2 repas<\/td><td>8,50 \u20ac<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Ce montant est d\u00e9duit du salaire brut dans des conditions strictement encadr\u00e9es. Si la participation du salari\u00e9 est inf\u00e9rieure \u00e0 cette \u00e9valuation forfaitaire, la diff\u00e9rence est soumise \u00e0 cotisations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Logement de fonction<\/h3>\n\n\n\n<p>L&#8217;avantage d&#8217;un logement de fonction est \u00e9valu\u00e9 au forfait en fonction de la r\u00e9mun\u00e9ration brute mensuelle du salari\u00e9. L&#8217;employeur peut \u00e9galement opter pour une \u00e9valuation au r\u00e9el \u00e0 la place du forfait, salari\u00e9 par salari\u00e9, avec possibilit\u00e9 de r\u00e9vision en fin d&#8217;exercice.<\/p>\n\n\n\n<p>Point de vigilance : ces avantages en nature sont <strong>exclus de la base de comparaison<\/strong> avec les minima conventionnels HCR. Autrement dit, un employeur ne peut pas les d\u00e9duire pour justifier qu&#8217;il respecte la grille de salaire, ils sont trait\u00e9s s\u00e9par\u00e9ment dans le bulletin de paie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conformit\u00e9 de la paie HCR : ce que l&#8217;employeur doit v\u00e9rifier<\/h2>\n\n\n\n<p>La grille HCR \u00e9volue par avenants successifs, ind\u00e9pendamment du calendrier du SMIC national. Un employeur qui ne suit pas ces mises \u00e0 jour peut se retrouver en infraction sans le savoir, les bulletins sont techniquement \u00e9mis, les salaires vers\u00e9s, mais les montants sont insuffisants au regard des minima en vigueur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Checklist pour contr\u00f4ler correctement chaque bulletin<\/h3>\n\n\n\n<p>Trois v\u00e9rifications sont \u00e0 effectuer syst\u00e9matiquement :<\/p>\n\n\n\n<p><strong>1. Le niveau et l&#8217;\u00e9chelon sont correctement identifi\u00e9s<\/strong> Chaque salari\u00e9 doit \u00eatre class\u00e9 selon la grille de classification HCR (IDCC 1979). Un serveur exp\u00e9riment\u00e9 n&#8217;a pas le m\u00eame minima qu&#8217;un commis d\u00e9butant. Si la classification n&#8217;a pas \u00e9t\u00e9 mise \u00e0 jour depuis l&#8217;embauche, le taux appliqu\u00e9 peut \u00eatre inf\u00e9rieur au minima conventionnel r\u00e9el du poste.<\/p>\n\n\n\n<p><strong>2. La base de comparaison est correcte<\/strong> Pour v\u00e9rifier le respect du minima, seuls certains \u00e9l\u00e9ments entrent dans le calcul : le salaire de base et la r\u00e9mun\u00e9ration des heures suppl\u00e9mentaires et compl\u00e9mentaires. Sont exclus de cette base : les avantages en nature (repas, logement), les primes, les remboursements de frais et les sommes li\u00e9es \u00e0 la participation. Int\u00e9grer ces \u00e9l\u00e9ments dans la comparaison est une erreur fr\u00e9quente qui masque une non-conformit\u00e9 r\u00e9elle.<\/p>\n\n\n\n<p><strong>3. Les majorations heures suppl\u00e9mentaires sont correctement appliqu\u00e9es<\/strong> Au-del\u00e0 de 39 heures, les majorations conventionnelles s&#8217;appliquent par paliers (15 %, 25 %, 50 % selon le volume d&#8217;heures). Si le bulletin ne distingue pas les heures suppl\u00e9mentaires du salaire de base, la v\u00e9rification est impossible, ce qui constitue en soi un manquement aux obligations de l&#8217;employeur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les cons\u00e9quences d&#8217;une non-conformit\u00e9<\/h2>\n\n\n\n<p>Un salari\u00e9 peut r\u00e9clamer le paiement des salaires insuffisants sur les <strong>3 derni\u00e8res ann\u00e9es<\/strong> (article L3245-1 du Code du Travail). Ce d\u00e9lai de prescription court \u00e0 partir du moment o\u00f9 le salari\u00e9 a connaissance du manquement, pas n\u00e9cessairement \u00e0 la date du bulletin incorrect.<\/p>\n\n\n\n<p>En cas de contr\u00f4le URSSAF, les rappels de cotisations sont calcul\u00e9s sur la base des montants non vers\u00e9s, auxquels s&#8217;ajoutent des majorations de retard.
