Le non-respect de l&#8217;OETH repr\u00e9sente environ 4 600 \u20ac par b\u00e9n\u00e9ficiaire manquant. Un Index Egapro non publi\u00e9 expose \u00e0 une p\u00e9nalit\u00e9 pouvant atteindre 1 % de la masse salariale. <\/p>\n\n\n\n<p>Ces sanctions ne concernent pas que les grandes entreprises : elles frappent surtout les PME en croissance rapide, l\u00e0 o\u00f9 l&#8217;\u00e9cart entre le moment o\u00f9 un seuil est franchi et le moment o\u00f9 la <strong>fonction RH<\/strong> le d\u00e9tecte peut durer plusieurs mois. Ces r\u00e8gles ne sont pas conditionn\u00e9es \u00e0 la taille de la structure.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Affichage obligatoire dans les locaux<\/h3>\n\n\n\n<p>La loi impose que certaines informations soient <strong>accessibles \u00e0 tous les salari\u00e9s<\/strong>, dans un lieu visible des locaux. L&#8217;affichage peut \u00eatre physique ou num\u00e9rique, \u00e0 condition d&#8217;\u00eatre accessible en permanence, y compris aux salari\u00e9s sans poste informatique.<\/p>\n\n\n\n<p>Les <strong>mentions obligatoires<\/strong> comprennent : les coordonn\u00e9es de l&#8217;inspection du travail et du m\u00e9decin du travail, les horaires collectifs de travail, les consignes de s\u00e9curit\u00e9 et d&#8217;incendie, les textes sur l&#8217;\u00e9galit\u00e9 de r\u00e9mun\u00e9ration et la lutte contre le harc\u00e8lement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Document unique d&#8217;\u00e9valuation des risques professionnels (DUERP)<\/h3>\n\n\n\n<p>Tout employeur est tenu de r\u00e9diger et de mettre \u00e0 jour le <strong>DUERP<\/strong>, qui recense l&#8217;ensemble des risques pour la <strong>sant\u00e9 et la s\u00e9curit\u00e9<\/strong> dans chaque unit\u00e9 de travail. La mise \u00e0 jour est obligatoire au minimum une fois par an, ou \u00e0 chaque modification significative des conditions de travail.<\/p>\n\n\n\n<p>L&#8217;absence de DUERP expose l&#8217;entreprise \u00e0 une mise en demeure de l&#8217;Inspection du travail et, en cas d&#8217;accident, \u00e0 une requalification en faute inexcusable de l&#8217;employeur.<\/p>\n\n\n\n<div id=\"cbox-nsSgK8Wnagb7v3dP\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Entretien professionnel tous les deux ans<\/h3>\n\n\n\n<p>Chaque salari\u00e9 doit b\u00e9n\u00e9ficier d&#8217;un <strong>entretien professionnel<\/strong> tous les deux ans pour faire le point sur ses perspectives d&#8217;\u00e9volution et ses besoins en <a href=\"\/blog\/fr\/formation-du-personnel\/\" data-wpel-link=\"internal\" target=\"_blank\">formation<\/a>. Un bilan r\u00e9capitulatif est obligatoire tous les six ans. Une solution simple pour rester conforme sans co\u00fbt suppl\u00e9mentaire, \u00e0 condition de bien v\u00e9rifier leur mise \u00e0 jour.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00c0 partir de 11 salari\u00e9s : la mise en place du CSE<\/h2>\n\n\n\n<p>D\u00e8s que l&#8217;effectif atteint 11 salari\u00e9s pendant 12 mois cons\u00e9cutifs, l&#8217;employeur est tenu de mettre en place un Comit\u00e9 Social et \u00c9conomique (CSE). Ce seuil est souvent sous-estim\u00e9, notamment par les entreprises en croissance rapide. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Comment se calcule le seuil de 11 salari\u00e9s ?<\/h3>\n\n\n\n<p>Le seuil se calcule en \u00e9quivalent temps plein (ETP), en tenant compte de l&#8217;ensemble des salari\u00e9s : CDI, CDD, temps partiels au prorata, et int\u00e9rimaires pr\u00e9sents depuis au moins 12 mois continus dans l&#8217;entreprise. Un d\u00e9passement ponctuel ne d\u00e9clenche pas imm\u00e9diatement l&#8217;obligation, le seuil doit \u00eatre maintenu pendant&nbsp;<strong>12 mois cons\u00e9cutifs<\/strong>. Notez que le CSE est l&#8217;une des rares obligations qui ne b\u00e9n\u00e9ficie pas du sursis de 5 ans de la loi PACTE : l&#8217;\u00e9lection doit \u00eatre lanc\u00e9e d\u00e8s le 13\u00e8me mois.<\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/fr\/types-de-contrat-de-travail\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span class=\"bzn-link-info\"><strong>Point d&#8217;attention fr\u00e9quent<\/strong> <\/span>Les CDD de remplacement ne comptent pas dans le calcul. Les int\u00e9rimaires ne sont inclus que si leur pr\u00e9sence est continue sur 12 mois, ce qui est rare en pratique. En cas de doute, se r\u00e9f\u00e9rer \u00e0 la notice URSSAF sur le calcul des effectifs.\n<\/a><\/bzn-info>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que l&#8217;employeur doit organiser<\/h3>\n\n\n\n<p>L&#8217;employeur doit organiser les \u00e9lections des membres du CSE, leur garantir des heures de d\u00e9l\u00e9gation (10 heures\/mois pour les entreprises de 11 \u00e0 49 salari\u00e9s), et mettre \u00e0 disposition un local si l&#8217;effectif d\u00e9passe 49 salari\u00e9s. Le CSE doit \u00eatre consult\u00e9 sur les conditions de travail, la s\u00e9curit\u00e9 et la formation professionnelle.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sanction en l&#8217;absence de CSE<\/h3>\n\n\n\n<p>L&#8217;absence de CSE dans une entreprise de plus de 11 salari\u00e9s constitue un d\u00e9lit d&#8217;entrave, passible de&nbsp;<strong>7 500 \u20ac d&#8217;amende<\/strong>&nbsp;pour la personne morale et d&#8217;un an d&#8217;emprisonnement pour les personnes physiques responsables. Cette obligation, encadr\u00e9e par l&#8217;article L5212-2 du Code du travail, impose un taux minimum de 6 % de l&#8217;effectif moyen annuel. Le quota de 6 % s&#8217;applique d\u00e8s 20 salari\u00e9s (moyenne annuelle). La loi PACTE accorde un d\u00e9lai de 5 ans apr\u00e8s le premier franchissement avant d&#8217;exiger le paiement de la contribution en cas de non-atteinte du quota.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Calcul du quota et modes de remplissage<\/h3>\n\n\n\n<p>L&#8217;obligation se remplit en combinant plusieurs leviers : embauche directe de travailleurs reconnus handicap\u00e9s (RQTH), recours \u00e0 des entreprises du secteur prot\u00e9g\u00e9 (ESAT, EA), accueil de stagiaires handicap\u00e9s. Le tout est d\u00e9clar\u00e9 mensuellement via la D\u00e9claration Sociale Nominative (DSN).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Contribution \u00e0 l&#8217;Agefiph en cas de non-atteinte du quota<\/h3>\n\n\n\n<p>Si l&#8217;entreprise n&#8217;atteint pas le taux de 6 %, elle verse une contribution \u00e0 l&#8217;Agefiph calcul\u00e9e sur le nombre de b\u00e9n\u00e9ficiaires manquants. Le montant annuel peut atteindre&nbsp;<strong>400 fois le SMIC horaire par b\u00e9n\u00e9ficiaire manquant<\/strong>, soit environ 4 600 \u20ac par unit\u00e9 manquante (base 2024). Ce montant est modulable \u00e0 la hausse pour les entreprises n&#8217;ayant aucun travailleur handicap\u00e9 depuis plus de 3 ans. <a href=\"https:\/\/www.agefiph.fr\/employeur\/simulateur_doeth\" type=\"link\" id=\"https:\/\/www.agefiph.fr\/employeur\/simulateur_doeth\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">L&#8217;Agefiph<\/a> dispose d&#8217;un simulateur en ligne \u00e0 consulter.<a href=\"https:\/\/www.legifrance.gouv.fr\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"external\"><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00c0 partir de 50 salari\u00e9s : le tournant r\u00e9glementaire<\/h2>\n\n\n\n<p>Le franchissement du seuil de 50 salari\u00e9s est le palier qui g\u00e9n\u00e8re le plus de nouvelles obligations simultan\u00e9es. Il marque g\u00e9n\u00e9ralement la n\u00e9cessit\u00e9 de structurer ou de renforcer une fonction RH d\u00e9di\u00e9e. Depuis la loi PACTE, la plupart de ces obligations ne deviennent effectives que si le seuil de 50 salari\u00e9s est franchi pendant <strong>5 ann\u00e9es civiles cons\u00e9cutives<\/strong>, offrant un droit \u00e0 l&#8217;erreur aux entreprises en croissance.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">R\u00e8glement int\u00e9rieur : obligation, contenu, proc\u00e9dure<\/h3>\n\n\n\n<p>Le <strong>r\u00e8glement int\u00e9rieur<\/strong> devient obligatoire \u00e0 partir de 50 salari\u00e9s maintenus pendant 12 mois. Il doit pr\u00e9ciser les r\u00e8gles d&#8217;hygi\u00e8ne et de s\u00e9curit\u00e9, les conditions d&#8217;utilisation du mat\u00e9riel professionnel, les sanctions disciplinaires et les comportements prohib\u00e9s (harc\u00e8lement, violence). Toute clause contraire aux libert\u00e9s fondamentales ou discriminatoire est nulle.<\/p>\n\n\n\n<p>Le document doit \u00eatre soumis \u00e0 l&#8217;avis du CSE, puis d\u00e9pos\u00e9 \u00e0 l&#8217;inspection du travail. Il entre en vigueur un mois apr\u00e8s l&#8217;accomplissement de ces formalit\u00e9s. Son absence expose l&#8217;entreprise \u00e0 l&#8217;impossibilit\u00e9 l\u00e9gale d&#8217;appliquer des sanctions disciplinaires.<a href=\"https:\/\/www.legifrance.gouv.fr\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"external\"><\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">N\u00e9gociations annuelles obligatoires (NAO)<\/h3>\n\n\n\n<p>\u00c0 partir de 50 salari\u00e9s, l&#8217;employeur est tenu d&#8217;ouvrir chaque ann\u00e9e des n\u00e9gociations avec les <strong>repr\u00e9sentants syndicaux<\/strong> sur trois blocs principaux : la r\u00e9mun\u00e9ration et le partage de la valeur, l&#8217;\u00e9galit\u00e9 professionnelle et la qualit\u00e9 de vie au travail, la gestion des emplois et des parcours professionnels. Il est calcul\u00e9 sur 5 indicateurs : \u00e9cart de r\u00e9mun\u00e9ration, \u00e9carts d&#8217;augmentations individuelles, \u00e9carts de promotions, retour de cong\u00e9 maternit\u00e9, part des femmes parmi les 10 plus hautes r\u00e9mun\u00e9rations.<\/p>\n\n\n\n<p>Un score inf\u00e9rieur \u00e0&nbsp;<strong>75 points sur 100<\/strong>&nbsp;oblige l&#8217;entreprise \u00e0 d\u00e9finir des mesures correctives et, si le score reste sous 85 points pendant 3 ans cons\u00e9cutifs, \u00e0 publier un plan de rattrapage avec objectifs chiffr\u00e9s. La p\u00e9nalit\u00e9 en cas de non-publication peut atteindre&nbsp;<strong>1 % de la masse salariale<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sant\u00e9 et s\u00e9curit\u00e9 au travail : obligations renforc\u00e9es \u00e0 50 salari\u00e9s<\/h3>\n\n\n\n<p>Au-del\u00e0 du DUERP obligatoire pour toutes les entreprises, les structures de 50 salari\u00e9s doivent int\u00e9grer la sant\u00e9 et la s\u00e9curit\u00e9 dans leur politique sociale. Le CSE est consult\u00e9 sur toutes les questions li\u00e9es aux conditions de travail et aux risques professionnels. L&#8217;entreprise doit \u00e9galement mettre en \u0153uvre un programme annuel de pr\u00e9vention, particuli\u00e8rement dans les secteurs \u00e0 risque.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Obligations RSE \u00e0 partir de 50 salari\u00e9s<\/h3>\n\n\n\n<p>Le franchissement de 50 salari\u00e9s d\u00e9clenche plusieurs obligations RSE concr\u00e8tes : publication de <a href=\"https:\/\/egapro.travail.gouv.fr\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">l&#8217;Index Egapro<\/a> (voir ci-dessus), plans d&#8217;action contre les discriminations, et respect de la loi Pacte qui invite \u00e0 int\u00e9grer les enjeux sociaux et environnementaux dans la gestion courante.
