Elle vise \u00e0 <strong>soutenir le pouvoir d\u2019achat<\/strong> des collaborateurs pendant leurs vacances, mais c\u2019est aussi un <a href=\"\/blog\/fr\/outil-rh\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">outil RH<\/a> qui renforce l\u2019engagement et la fid\u00e9lisation.<\/p>\n\n\n\n<p>On parle parfois de <strong>prime d\u2019\u00e9t\u00e9<\/strong>, mais les deux termes ne sont pas toujours synonymes. La prime d\u2019\u00e9t\u00e9 peut d\u00e9signer une gratification exceptionnelle vers\u00e9e sans lien direct avec les <a href=\"\/blog\/fr\/conges\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">cong\u00e9s<\/a>, tandis que la <strong>prime de vacances<\/strong> est li\u00e9e, elle, \u00e0 une p\u00e9riode de repos.<\/p>\n\n\n\n<p><strong>Toutes les entreprises ne sont pas tenues de verser une prime de vacances.<\/strong> Ce sont g\u00e9n\u00e9ralement les <strong>conventions collectives<\/strong>, les <strong>accords d\u2019entreprise<\/strong> ou les usages qui en d\u00e9terminent l\u2019existence, le montant et les conditions.<\/p>\n\n\n\n<p>Elle peut prendre diff\u00e9rentes formes : pourcentage du salaire, montant fixe, ou encore prime conditionn\u00e9e \u00e0 l\u2019anciennet\u00e9. Dans tous les cas, elle reste <strong>distincte de l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s<\/strong>, qui est obligatoire et d\u00e9j\u00e0 incluse dans la r\u00e9mun\u00e9ration pendant les cong\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La prime de vacances est-elle obligatoire ?<\/h2>\n\n\n\n<p>Contrairement \u00e0 ce que beaucoup de salari\u00e9s pensent, <strong>la prime de vacances n\u2019est pas une obligation l\u00e9gale<\/strong> en France. Elle n\u2019est pas pr\u00e9vue par le Code du travail, sauf mention contraire dans une <strong>convention collective<\/strong>, un <strong>accord d\u2019entreprise<\/strong> ou un <strong>usage \u00e9tabli<\/strong> dans l\u2019entreprise.<\/p>\n\n\n\n<p>Autrement dit, l\u2019employeur n\u2019a aucune obligation de la verser\u2026 \u00e0 moins que le texte qui r\u00e9git votre secteur ou votre entreprise ne l\u2019impose.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Les cas o\u00f9 la prime de vacances est obligatoire<\/h3>\n\n\n\n<p>Certaines conventions collectives incluent noir sur blanc cette obligation. C\u2019est notamment le cas de la <strong>convention Syntec<\/strong>, qui concerne de nombreuses entreprises dans le num\u00e9rique, le conseil ou l\u2019ing\u00e9nierie.<\/p>\n\n\n\n<p>Dans ce cadre, l\u2019article 31 pr\u00e9voit que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La prime de vacances doit repr\u00e9senter au <strong>minimum 10 % de la somme totale per\u00e7ue au titre des cong\u00e9s pay\u00e9s<\/strong>.<\/li>\n\n\n\n<li>Elle doit \u00eatre vers\u00e9e \u00e0 <strong>l\u2019ensemble des salari\u00e9s de l\u2019entreprise<\/strong> concern\u00e9s par la convention, sans condition d\u2019anciennet\u00e9.<\/li>\n<\/ul>\n\n\n\n<p>D\u2019autres branches peuvent aussi pr\u00e9voir des modalit\u00e9s diff\u00e9rentes (montant fixe, conditions d\u2019attribution, etc.). En l\u2019absence de texte officiel, l\u2019employeur est libre d\u2019en fixer les modalit\u00e9s, tant que le principe d\u2019\u00e9galit\u00e9 de traitement est respect\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">M\u00e9thode de calcul classique<\/h3>\n\n\n\n<p>Dans les entreprises couvertes par une convention comme <strong>la Syntec<\/strong>, le calcul de la prime de vacances repose sur une base simple\u202f:<br>elle repr\u00e9sente <strong>10\u202f% de la somme brute per\u00e7ue au titre des cong\u00e9s pay\u00e9s<\/strong>. Cela inclut :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le salaire brut habituel per\u00e7u pendant les cong\u00e9s,<\/li>\n\n\n\n<li>les \u00e9ventuelles primes int\u00e9gr\u00e9es dans la r\u00e9mun\u00e9ration de base.<\/li>\n<\/ul>\n\n\n\n<p>Par exemple, un salari\u00e9 qui touche 2\u202f500\u202f\u20ac bruts de cong\u00e9s pay\u00e9s percevra une prime de vacances de 250\u202f\u20ac.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Calcul dans le cas de la convention Syntec<\/h3>\n\n\n\n<p>La <strong>convention collective Syntec-Cinov<\/strong> pr\u00e9voit que la prime de vacances doit b\u00e9n\u00e9ficier \u00e0 tous les salari\u00e9s (cadres et non-cadres), sans condition d\u2019anciennet\u00e9 ni de pr\u00e9sence minimum.
