Pour les services paie et RH, c&#8217;est la premi\u00e8re question \u00e0 trancher, avant tout calcul. En cas d&#8217;oubli de versement l\u00e0 o\u00f9 la prime est due, le salari\u00e9 peut r\u00e9clamer un rappel sur les\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027566295\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">trois derni\u00e8res ann\u00e9es en vertu de l&#8217;article L.3245-1 du Code du travail<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u2019est-ce que la prime de vacances ?<\/h2>\n\n\n\n<p>La prime de vacances est une <strong>somme vers\u00e9e par l&#8217;employeur \u00e0 l&#8217;occasion des cong\u00e9s pay\u00e9s<\/strong>, g\u00e9n\u00e9ralement en \u00e9t\u00e9. Elle vise \u00e0 compenser la baisse de r\u00e9mun\u00e9ration que certaines m\u00e9thodes de calcul des cong\u00e9s peuvent entra\u00eener, et constitue un\u00a0<a href=\"\/blog\/fr\/outil-rh\/\" data-wpel-link=\"internal\" target=\"_blank\">levier RH<\/a>\u00a0de fid\u00e9lisation.<\/p>\n\n\n\n<p>On la confond parfois avec la\u00a0<strong>prime d&#8217;\u00e9t\u00e9<\/strong>, mais les deux ne sont pas synonymes. La prime d&#8217;\u00e9t\u00e9 peut d\u00e9signer une gratification exceptionnelle sans lien direct avec les\u00a0<a href=\"\/blog\/fr\/conges\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">cong\u00e9s<\/a> pay\u00e9s, tandis que la <strong>prime de vacances<\/strong> est li\u00e9e \u00e0 une p\u00e9riode de repos d\u00e9finie.<\/p>\n\n\n\n<p>Elle reste\u00a0<strong>distincte de l&#8217;indemnit\u00e9 de cong\u00e9s pay\u00e9s<\/strong>, qui est obligatoire et d\u00e9j\u00e0 incluse dans la r\u00e9mun\u00e9ration pendant les cong\u00e9s. Ce sont deux m\u00e9canismes diff\u00e9rents que la paie doit traiter s\u00e9par\u00e9ment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La prime de vacances est-elle obligatoire ?<\/h2>\n\n\n\n<p><strong>Non, le Code du travail n&#8217;impose aucune prime de vacances<\/strong>. L&#8217;obligation na\u00eet d&#8217;une autre source : la <strong>convention collective applicable<\/strong>, un accord d&#8217;entreprise, un usage \u00e9tabli ou une clause du contrat de travail. Son\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/conv_coll\/article\/KALIARTI000044253107\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">article 31, disponible sur L\u00e9gifrance<\/a>, pr\u00e9voit que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La prime doit repr\u00e9senter au minimum\u00a0<strong>10 % de la masse globale des indemnit\u00e9s de cong\u00e9s pay\u00e9s<\/strong>\u00a0acquises sur la p\u00e9riode de r\u00e9f\u00e9rence (du 1er juin au 31 mai).<\/li>\n\n\n\n<li>Elle b\u00e9n\u00e9ficie \u00e0\u00a0<strong>l&#8217;ensemble des salari\u00e9s<\/strong>\u00a0couverts par la convention, sans condition d&#8217;anciennet\u00e9 ni de pr\u00e9sence minimum.<\/li>\n\n\n\n<li>Une partie du montant doit \u00eatre vers\u00e9e entre le\u00a0<strong>1er mai et le 31 octobre<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>D&#8217;autres conventions pr\u00e9voient des obligations similaires avec des modalit\u00e9s propres (industrie pharmaceutique, certaines branches du BTP). En l&#8217;absence de texte, l&#8217;employeur fixe librement les modalit\u00e9s, dans le respect du <strong>principe d&#8217;\u00e9galit\u00e9 de traitement entre salari\u00e9s<\/strong> plac\u00e9s dans une situation comparable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">M\u00e9thode de calcul standard<\/h3>\n\n\n\n<p>Hors convention sp\u00e9cifique, le calcul repose g\u00e9n\u00e9ralement sur un pourcentage appliqu\u00e9 \u00e0 la r\u00e9mun\u00e9ration brute ou \u00e0 l&#8217;indemnit\u00e9 de cong\u00e9s pay\u00e9s. Exemple courant :&nbsp;<strong>10 % du salaire brut per\u00e7u pendant les cong\u00e9s<\/strong>. Pour un salari\u00e9 dont l&#8217;indemnit\u00e9 de cong\u00e9s s&#8217;\u00e9l\u00e8ve \u00e0 2 500 \u20ac bruts, la prime de vacances ressort \u00e0 250 \u20ac.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Calcul dans le cadre de la convention Syntec<\/h3>\n\n\n\n<p>La convention Syntec impose un calcul collectif, pas individuel. L&#8217;employeur calcule\u00a0<strong>10 % de la masse totale des indemnit\u00e9s de cong\u00e9s pay\u00e9s de l&#8217;ensemble des salari\u00e9s<\/strong>\u00a0sur la p\u00e9riode de r\u00e9f\u00e9rence (1er juin N-1 au 31 mai N), puis r\u00e9partit ce montant entre eux au prorata de leur r\u00e9mun\u00e9ration.<\/p>\n\n\n\n<p>Point de vigilance confirm\u00e9 par la jurisprudence : la base de calcul inclut les indemnit\u00e9s des salari\u00e9s ayant quitt\u00e9 l&#8217;entreprise en cours d&#8217;exercice. La plupart des entreprises versent la prime entre juin et juillet, en lien avec les d\u00e9parts en cong\u00e9s. Certaines l&#8217;int\u00e8grent \u00e0 la fiche de paie de juin ; d&#8217;autres la fractionnent sur plusieurs mois. La convention Syntec cadre la p\u00e9riode : une partie doit \u00eatre vers\u00e9e entre le 1er mai et le 31 octobre.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conditions d&#8217;\u00e9ligibilit\u00e9 \u00e0 d\u00e9finir en amont<\/h3>\n\n\n\n<p>Les crit\u00e8res d&#8217;\u00e9ligibilit\u00e9 varient selon la source applicable : pr\u00e9sence effective \u00e0 la date de versement, anciennet\u00e9 minimale, type de contrat (CDI, CDD). Il r\u00e9duit les r\u00e9clamations internes et s\u00e9curise l&#8217;entreprise en cas de contr\u00f4le.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Anticiper pour \u00e9viter les rappels de prime<\/h3>\n\n\n\n<p>Un oubli de versement l\u00e0 o\u00f9 la prime est obligatoire constitue un manquement \u00e0 une obligation conventionnelle. Le salari\u00e9 peut engager une action en rappel de salaire sur les trois derni\u00e8res ann\u00e9es (article L.3245-1 du Code du travail).
