Mais cela ne signifie pas automatiquement qu\u2019il est <strong>ch\u00f4m\u00e9 et pay\u00e9<\/strong> pour tous les salari\u00e9s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Un jour f\u00e9ri\u00e9 ch\u00f4m\u00e9\u2026 sous conditions<\/h3>\n\n\n\n<p>Pour que le <strong>15 ao\u00fbt f\u00e9ri\u00e9 soit pay\u00e9<\/strong>, plusieurs \u00e9l\u00e9ments doivent \u00eatre r\u00e9unis :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le salari\u00e9 doit avoir <strong>au moins trois mois d\u2019anciennet\u00e9<\/strong> dans l\u2019entreprise (sauf disposition conventionnelle plus favorable).<\/li>\n\n\n\n<li>Il ne doit pas avoir <strong>\u00e9t\u00e9 absent sans justification<\/strong> dans les jours pr\u00e9c\u00e9dents ou suivants le jour f\u00e9ri\u00e9.<\/li>\n\n\n\n<li>Le <strong>jour f\u00e9ri\u00e9 ne doit pas tomber un jour habituellement non travaill\u00e9<\/strong> (comme le week-end pour certains contrats).<\/li>\n<\/ul>\n\n\n\n<p>Dans le cas contraire, le salari\u00e9 <strong>n\u2019est pas r\u00e9mun\u00e9r\u00e9<\/strong> ou bien il doit <strong><a href=\"\/blog\/fr\/demande-de-conges\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"internal\">poser un cong\u00e9<\/a> pay\u00e9 ou RTT<\/strong> pour ne pas subir de perte de salaire.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Des r\u00e8gles qui varient selon les conventions collectives<\/h3>\n\n\n\n<p>Les <strong>accords d\u2019entreprise<\/strong> ou <strong>conventions collectives<\/strong> peuvent pr\u00e9voir des conditions plus avantageuses : <strong>r\u00e9mun\u00e9ration sans condition d\u2019anciennet\u00e9<\/strong>, <strong>majoration m\u00eame si le salari\u00e9 ne travaille pas<\/strong>, ou encore <strong>obligation de fermeture de l\u2019\u00e9tablissement<\/strong>.<\/p>\n\n\n\n<p>Il est donc essentiel de consulter la <strong>convention collective applicable<\/strong> pour conna\u00eetre les droits exacts des salari\u00e9s le jour du 15 ao\u00fbt.<\/p>\n\n\n\n<div id=\"cbox-4lHZzEpMiUZHjpnz\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le travail le 15 ao\u00fbt est-il obligatoire ?<\/h2>\n\n\n\n<p>Le <strong>15 ao\u00fbt<\/strong>, bien qu\u2019il s\u2019agisse d\u2019un jour f\u00e9ri\u00e9, <strong>n\u2019est pas automatiquement ch\u00f4m\u00e9<\/strong>. Sauf disposition contraire dans la convention collective ou un accord d\u2019entreprise, <strong>l\u2019employeur peut demander \u00e0 ses salari\u00e9s de travailler<\/strong> ce jour-l\u00e0.
