Un employeur qui confond jours ouvr\u00e9s et jours ouvrables dans le d\u00e9compte des absences s&#8217;expose \u00e0 un rappel de cong\u00e9s et, potentiellement, \u00e0 un contentieux prud&#8217;homal. <\/p>\n\n\n\n<p>La <strong>distinction n&#8217;est pas qu&#8217;une question de terminologie<\/strong> : elle impacte directement le nombre de jours d\u00e9compt\u00e9s, le montant des indemnit\u00e9s de cong\u00e9s pay\u00e9s et la conformit\u00e9 des bulletins de paie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quelle est la diff\u00e9rence entre jours ouvr\u00e9s et jours ouvrables ?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">D\u00e9finition des jours ouvrables<\/h3>\n\n\n\n<p>Un <strong>jour ouvrable<\/strong> correspond \u00e0 tous les jours de la semaine, <strong>sauf<\/strong> le jour de repos hebdomadaire l\u00e9gal (g\u00e9n\u00e9ralement <strong>le dimanche<\/strong>) et les jours f\u00e9ri\u00e9s ch\u00f4m\u00e9s dans l&#8217;entreprise. En pratique, une semaine standard compte <strong>6 jours ouvrables<\/strong> (du lundi au samedi).<\/p>\n\n\n\n<p>C&#8217;est la r\u00e9f\u00e9rence retenue par le Code du Travail pour le calcul l\u00e9gal des cong\u00e9s pay\u00e9s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">D\u00e9finition des jours ouvr\u00e9s<\/h3>\n\n\n\n<p>Un <strong>jour ouvr\u00e9<\/strong> correspond aux jours o\u00f9 <strong>l&#8217;entreprise est effectivement en activit\u00e9<\/strong>. Les jours de repos hebdomadaire et les jours f\u00e9ri\u00e9s ch\u00f4m\u00e9s ne sont pas compt\u00e9s. Pour une entreprise ouverte du lundi au vendredi, la semaine compte <strong>5 jours ouvr\u00e9s<\/strong>.<\/p>\n\n\n\n<p>Les jours ouvr\u00e9s ne sont pas d\u00e9finis par le Code du Travail : c&#8217;est une notion d&#8217;usage, souvent stipul\u00e9e dans le contrat de travail ou la convention collective applicable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Jours calendaires : la troisi\u00e8me notion \u00e0 conna\u00eetre<\/h3>\n\n\n\n<p>Les <strong>jours calendaires<\/strong> correspondent \u00e0 tous les jours de l&#8217;ann\u00e9e sans exception : week-ends, jours f\u00e9ri\u00e9s, dimanches. Une semaine compte toujours 7 jours calendaires. En pratique, la grande majorit\u00e9 des entreprises fran\u00e7aises raisonne en <strong>jours ouvr\u00e9s<\/strong>, ce qui donne <strong>25 jours<\/strong> pour l&#8217;\u00e9quivalent de 5 semaines.<\/p>\n\n\n\n<p>Ces deux bases sont \u00e9quivalentes pour une semaine de travail classique du lundi au vendredi : 30 jours ouvrables = 25 jours ouvr\u00e9s = 5 semaines de cong\u00e9s.
