Mais jusqu\u2019o\u00f9 peuvent-ils aller ? En l&#8217;absence d&#8217;accord collectif, le Code du travail fixe le contingent \u00e0\u00a0<strong>220 heures par an et par salari\u00e9<\/strong>. <\/p>\n\n\n\n<p>Ce seuil peut \u00eatre modifi\u00e9 par une convention collective ou un accord d&#8217;entreprise, \u00e0 la hausse pour r\u00e9pondre aux besoins du secteur, ou \u00e0 la baisse pour prot\u00e9ger les salari\u00e9s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le plafond l\u00e9gal<\/h3>\n\n\n\n<p>Le contingent de 220 heures s&#8217;applique par d\u00e9faut \u00e0 tous les salari\u00e9s soumis \u00e0 la dur\u00e9e l\u00e9gale du travail. Seules les heures de&nbsp;<strong>travail effectif<\/strong>&nbsp;comptent, les absences non assimil\u00e9es \u00e0 du temps de travail effectif (maladie, cong\u00e9s sans solde) ne sont pas d\u00e9duites du contingent mais ne g\u00e9n\u00e8rent pas non plus d&#8217;heures suppl\u00e9mentaires.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prorata pour un salari\u00e9 arriv\u00e9 en cours d&#8217;ann\u00e9e<\/h3>\n\n\n\n<p>Le contingent n&#8217;est <strong>pas proratis\u00e9 automatiquement<\/strong> pour un salari\u00e9 entr\u00e9 en cours d&#8217;ann\u00e9e. Le Code du travail retient le contingent annuel complet. <\/p>\n\n\n\n<p>En pratique, un salari\u00e9 arriv\u00e9 en juillet ne peut pas accumuler 220 heures suppl\u00e9mentaires sur 6 mois, les dur\u00e9es maximales hebdomadaires (48h absolues, 44h en moyenne sur 12 semaines) forment un plafond physique ind\u00e9pendant du contingent.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Heures exclues du contingent<\/h3>\n\n\n\n<p>Certaines heures suppl\u00e9mentaires n&#8217;entrent pas dans le d\u00e9compte du contingent :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les heures effectu\u00e9es lors d&#8217;une situation d&#8217;urgence (sinistre, risque grave) avec l&#8217;autorisation de l&#8217;inspection du travail.<\/li>\n\n\n\n<li>Les heures incluses dans un&nbsp;<strong>repos compensateur de remplacement (RCR)<\/strong>&nbsp;int\u00e9gral, l&#8217;employeur qui remplace le paiement major\u00e9 par un repos \u00e9quivalent les sort du contingent.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Cons\u00e9quences du d\u00e9passement du contingent annuel<\/h2>\n\n\n\n<p>Le d\u00e9passement du contingent n&#8217;est pas interdit, mais il d\u00e9clenche des obligations pr\u00e9cises pour l&#8217;employeur et des droits sp\u00e9cifiques pour les salari\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tableau des obligations selon la taille de l&#8217;entreprise<\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th class=\"has-text-align-left\" data-align=\"left\">Situation<\/th><th class=\"has-text-align-left\" data-align=\"left\">Taille de l&#8217;entreprise<\/th><th class=\"has-text-align-left\" data-align=\"left\">Repos compensateur obligatoire<\/th><\/tr><\/thead><tbody><tr><td>Heures effectu\u00e9es au-del\u00e0 du contingent<\/td><td>Moins de 20 salari\u00e9s<\/td><td><strong>50 %<\/strong>&nbsp;des heures concern\u00e9es<\/td><\/tr><tr><td>Heures effectu\u00e9es au-del\u00e0 du contingent<\/td><td>20 salari\u00e9s et plus<\/td><td><strong>100 %<\/strong>&nbsp;des heures concern\u00e9es<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Obligations de l&#8217;employeur<\/h3>\n\n\n\n<p>En cas de d\u00e9passement du contingent, l&#8217;employeur doit :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Attribuer le&nbsp;<strong>repos compensateur obligatoire<\/strong>&nbsp;en plus de la r\u00e9mun\u00e9ration major\u00e9e des heures suppl\u00e9mentaires.<\/li>\n\n\n\n<li>Informer et consulter le&nbsp;<strong>CSE<\/strong>&nbsp;(Comit\u00e9 Social et \u00c9conomique) si l&#8217;entreprise en dispose.<\/li>\n\n\n\n<li>Respecter les&nbsp;<strong>dur\u00e9es maximales de travail<\/strong>&nbsp;: 48 heures sur une semaine (art. L3121-20), 44 heures en moyenne sur 12 semaines cons\u00e9cutives (art. L3121-22).<\/li>\n<\/ul>\n\n\n\n<p>En cas de non-respect, l&#8217;entreprise s&#8217;expose \u00e0 des sanctions financi\u00e8res et \u00e0 des condamnations aux prud&#8217;hommes. Un responsable qui voit en juillet que son \u00e9quipe a d\u00e9j\u00e0 consomm\u00e9 160 des 220 heures peut ajuster les effectifs ou l&#8217;organisation avant d&#8217;\u00eatre en infraction.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Assurer un suivi rigoureux des heures<\/h3>\n\n\n\n<p>Sans suivi pr\u00e9cis, les <strong>entreprises ne d\u00e9tectent les d\u00e9passements<\/strong> qu&#8217;\u00e0 la cl\u00f4ture de l&#8217;exercice, souvent trop tard pour satisfaire l&#8217;obligation de repos compensateur avant la fin de l&#8217;ann\u00e9e.
