{"id":53274,"date":"2025-11-13T08:45:14","date_gmt":"2025-11-13T07:45:14","guid":{"rendered":"https:\/\/www.bizneo.com\/blog\/?p=53274"},"modified":"2026-05-12T00:09:24","modified_gmt":"2026-05-11T23:09:24","slug":"como-calcular-ferias-proporcionais","status":"publish","type":"post","link":"https:\/\/www.bizneo.com\/blog\/pt\/como-calcular-ferias-proporcionais\/","title":{"rendered":"Como calcular f\u00e9rias proporcionais corretamente pela CLT"},"content":{"rendered":"\n<p><strong>F\u00e9rias proporcionais<\/strong> s\u00e3o calculadas pela f\u00f3rmula <strong>(sal\u00e1rio \u00f7 12) \u00d7 meses trabalhados + 1\/3 constitucional<\/strong>, garantida pela <a href=\"\/blog\/pt\/clt\/\" data-wpel-link=\"internal\" target=\"_blank\">CLT<\/a> para qualquer rescis\u00e3o de contrato. <\/p>\n\n\n\n<p>O direito se aplica quando o colaborador n\u00e3o completou 12 meses no <strong>per\u00edodo aquisitivo<\/strong> atual. Um m\u00eas s\u00f3 conta como avo completo se o colaborador trabalhou ao menos <strong>15 dias<\/strong> nele. Erros no c\u00e1lculo geram diverg\u00eancias na rescis\u00e3o e exp\u00f5em a empresa a reclamat\u00f3rias trabalhistas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que s\u00e3o f\u00e9rias proporcionais e quando se aplicam<\/h2>\n\n\n\n<p><strong>F\u00e9rias proporcionais<\/strong> s\u00e3o o direito ao descanso remunerado calculado em fra\u00e7\u00e3o dos 30 dias de f\u00e9rias integrais, proporcional ao tempo trabalhado no <strong>per\u00edodo aquisitivo<\/strong> em curso. A cada m\u00eas completo de servi\u00e7o, o colaborador acumula <strong>1\/12 avo<\/strong> do total de f\u00e9rias.<\/p>\n\n\n\n<p>O <a href=\"\/blog\/pt\/periodo-aquisitivo-e-concessivo-de-ferias\/\" data-wpel-link=\"internal\" target=\"_blank\"><strong>per\u00edodo aquisitivo e concessivo de f\u00e9rias<\/strong><\/a> s\u00e3o dois ciclos distintos: o primeiro s\u00e3o os 12 meses de trabalho que geram o direito; o segundo s\u00e3o os 12 meses seguintes, durante os quais a empresa deve conceder o descanso. Se n\u00e3o conceder dentro desse prazo, as f\u00e9rias passam a ser devidas <strong>em dobro<\/strong> (art. 137 da CLT).<\/p>\n\n\n\n<p>As f\u00e9rias proporcionais se aplicam nas seguintes situa\u00e7\u00f5es:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Demiss\u00e3o sem justa causa:<\/strong> a empresa paga as f\u00e9rias proporcionais com o adicional de 1\/3.<\/li>\n\n\n\n<li><strong>Pedido de demiss\u00e3o:<\/strong> o colaborador mant\u00e9m o direito, mesmo que a sa\u00edda seja por iniciativa pr\u00f3pria.<\/li>\n\n\n\n<li><strong>T\u00e9rmino de contrato tempor\u00e1rio:<\/strong> o acerto final deve incluir as f\u00e9rias proporcionais acumuladas.<\/li>\n\n\n\n<li><strong><a href=\"\/blog\/pt\/ferias-coletivas\/\" data-wpel-link=\"internal\" target=\"_blank\">F\u00e9rias coletivas<\/a>:<\/strong> colaboradores com menos de 12 meses de casa recebem f\u00e9rias proporcionais ao tempo trabalhado e iniciam novo per\u00edodo aquisitivo ap\u00f3s o retorno (art. 140 da CLT).<\/li>\n<\/ul>\n\n\n\n<p>A diferen\u00e7a entre <strong>f\u00e9rias integrais e proporcionais<\/strong> est\u00e1 no tempo de servi\u00e7o: as integrais s\u00e3o concedidas ap\u00f3s 12 meses completos; as proporcionais cobrem o per\u00edodo restante antes da rescis\u00e3o ou do gozo antecipado.<\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/controle-de-ferias\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>Controle de f\u00e9rias<\/strong><\/span><br \/> Como fazer, regras da CLT e ferramentas.<\/a><\/bzn-info>\n\n\n\n<h2 class=\"wp-block-heading\">Como calcular f\u00e9rias proporcionais passo a passo<\/h2>\n\n\n\n<p>O c\u00e1lculo segue quatro passos fixos. A tabela abaixo apresenta a f\u00f3rmula e um exemplo pr\u00e1tico com sal\u00e1rio de <strong>R$ 3.000,00<\/strong> e <strong>8 meses trabalhados<\/strong>:<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table class=\"has-fixed-layout\"><thead><tr><th>Passo<\/th><th>Opera\u00e7\u00e3o<\/th><th>Exemplo (R$ 3.000 \/ 8 meses)<\/th><\/tr><\/thead><tbody><tr><td><strong>1. Um m\u00eas conta como <strong>avo completo<\/strong> quando o colaborador trabalhou ao menos 15 dias nele, conforme o par\u00e1grafo \u00fanico do art. 146 da CLT. Fra\u00e7\u00f5es iguais ou inferiores a 14 dias n\u00e3o s\u00e3o computadas.<\/p>\n\n\n\n<p><strong>Aviso pr\u00e9vio indenizado:<\/strong> quando a empresa dispensa o colaborador com aviso indenizado, o per\u00edodo correspondente conta como tempo de servi\u00e7o para fins de c\u00e1lculo dos avos (art. 487 da CLT). Para 8 anos de empresa, o aviso pr\u00e9vio pode chegar a 38 dias \u2014 acrescentando mais de 1 avo ao total proporcional.<\/p>\n\n\n\n<div id=\"cbox-CZ6beVo9FCVwXgDv\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">O que entra na base de c\u00e1lculo<\/h3>\n\n\n\n<p>Conforme o <strong>art. 142 da CLT<\/strong>, a base de c\u00e1lculo das f\u00e9rias vai al\u00e9m do sal\u00e1rio fixo. Devem ser inclu\u00eddas <strong>todas as verbas de natureza salarial recebidas com habitualidade<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sal\u00e1rio base:<\/strong> valor fixo registrado em carteira.<\/li>\n\n\n\n<li><strong>Horas extras habituais:<\/strong> m\u00e9dia das horas extras dos \u00faltimos 12 meses (ou dos meses trabalhados, se inferior a 12).<\/li>\n\n\n\n<li><strong>Adicional noturno:<\/strong> m\u00e9dia do per\u00edodo aquisitivo quando pago com habitualidade.<\/li>\n\n\n\n<li><strong>Adicional de insalubridade ou periculosidade:<\/strong> entra na base quando habitual.<\/li>\n\n\n\n<li><strong>Comiss\u00f5es e gratifica\u00e7\u00f5es:<\/strong> m\u00e9dia dos meses do per\u00edodo aquisitivo.<\/li>\n\n\n\n<li><strong>DSR sobre horas extras:<\/strong> o Descanso Semanal Remunerado gerado por horas extras habituais tamb\u00e9m integra a base de c\u00e1lculo das f\u00e9rias (entendimento consolidado do TST).<\/li>\n<\/ul>\n\n\n\n<p><strong>Erro frequente no DP:<\/strong> calcular apenas sobre o sal\u00e1rio fixo quando o colaborador recebe adicionais habituais. A base de c\u00e1lculo do imposto de renda nas f\u00e9rias \u00e9 diferente da base do sal\u00e1rio mensal.<\/li>\n\n\n\n<li><strong>FGTS:<\/strong> n\u00e3o \u00e9 descontado do colaborador, mas a empresa deve recolher <strong>8% sobre o valor bruto<\/strong> das f\u00e9rias proporcionais na rescis\u00e3o.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Como as faltas injustificadas afetam o c\u00e1lculo<\/h2>\n\n\n\n<p>Faltas n\u00e3o justificadas no per\u00edodo aquisitivo reduzem o <strong>total de dias de f\u00e9rias<\/strong> a que o colaborador tem direito, conforme o <strong>art. 130 da CLT<\/strong>:<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table class=\"has-fixed-layout\"><thead><tr><th>Faltas injustificadas no per\u00edodo aquisitivo<\/th><th>Dias de f\u00e9rias devidos<\/th><\/tr><\/thead><tbody><tr><td>At\u00e9 5 faltas<\/td><td><strong>30 dias<\/strong><\/td><\/tr><tr><td>De 6 a 14 faltas<\/td><td><strong>24 dias<\/strong><\/td><\/tr><tr><td>De 15 a 23 faltas<\/td><td><strong>18 dias<\/strong><\/td><\/tr><tr><td>De 24 a 32 faltas<\/td><td><strong>12 dias<\/strong><\/td><\/tr><tr><td>Acima de 32 faltas<\/td><td><strong>Perde o direito<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Como isso afeta o c\u00e1lculo proporcional?<\/strong> A redu\u00e7\u00e3o se aplica antes de calcular os avos. Se o colaborador trabalhou 8 meses e teve 10 faltas injustificadas, o direito cai para 24 dias e o c\u00e1lculo usa 24 como base, n\u00e3o 30.<\/p>\n\n\n\n<p><strong>Exemplo:<\/strong> sal\u00e1rio R$ 3.000, 8 meses trabalhados, 10 faltas injustificadas. Base ajustada: <strong>(3.000 \u00f7 30) \u00d7 24 = R$ 2.400<\/strong>. Proporcional (8\/12): <strong>(2.400 \u00f7 12) \u00d7 8 = R$ 1.600<\/strong>. A diferen\u00e7a de R$ 400 na base representa <strong>R$ 266,67 a menos no acerto<\/strong>, diferen\u00e7a que pode originar a\u00e7\u00e3o trabalhista.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Colaborador com adicional noturno, insalubridade ou periculosidade<\/h3>\n\n\n\n<p>Os adicionais habituais integram a <strong>remunera\u00e7\u00e3o de refer\u00eancia<\/strong> para o c\u00e1lculo, conforme o art. 142 da CLT. Arredondar o valor por avo antes de multiplicar pelos meses gera diferen\u00e7as cumulativas que aparecem no acerto final.<\/p>\n\n\n\n<p><strong>Pr\u00e1tica correta:<\/strong> aplicar a f\u00f3rmula completa em uma \u00fanica opera\u00e7\u00e3o e arredondar apenas o valor final para duas casas decimais.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Aplica\u00e7\u00e3o correta de INSS e IRRF<\/h3>\n\n\n\n<p>O <strong>INSS<\/strong> incide sobre o valor bruto das f\u00e9rias + 1\/3. O <strong>IRRF<\/strong> \u00e9 calculado sobre o valor bruto ap\u00f3s a dedu\u00e7\u00e3o do INSS. A tabela de imposto de renda aplic\u00e1vel \u00e0s f\u00e9rias tem uma l\u00f3gica diferente do sal\u00e1rio mensal \u2014 aplicar a tabela errada gera inconsist\u00eancias fiscais que aparecem na declara\u00e7\u00e3o anual do colaborador.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prazo de pagamento<\/h3>\n\n\n\n<p>De acordo com o <strong>art. 145 da CLT<\/strong>, quando as f\u00e9rias s\u00e3o usufru\u00eddas durante o v\u00ednculo, o pagamento deve ocorrer <strong>at\u00e9 dois dias antes do in\u00edcio do per\u00edodo de descanso<\/strong>.
