Entender o que a lei exige, e o que ela n\u00e3o invalida, \u00e9 o ponto de partida para uma concess\u00e3o sem risco.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que s\u00e3o f\u00e9rias coletivas e como diferem das individuais<\/h2>\n\n\n\n<p>As <strong>f\u00e9rias coletivas<\/strong> s\u00e3o o per\u00edodo de descanso concedido simultaneamente a todos os empregados de uma empresa, de um estabelecimento ou de um setor espec\u00edfico. Para uma vis\u00e3o completa de como estruturar o processo internamente, veja o guia de <a href=\"\/blog\/pt\/controle-de-ferias\/\" data-wpel-link=\"internal\" target=\"_blank\">controle de f\u00e9rias<\/a>.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong> Comunicar o MTE e o sindicato com anteced\u00eancia m\u00ednima de 15 dias.<\/strong> O comunicado deve ser enviado \u00e0 Delegacia Regional do Trabalho (DRT) e ao sindicato da categoria profissional, com as datas de in\u00edcio e fim do per\u00edodo. Microempresas (ME) e Empresas de Pequeno Porte (EPP) s\u00e3o dispensadas da comunica\u00e7\u00e3o ao MTE pelo art. 51, inciso V da LC 123\/2006, mas mant\u00eam a obriga\u00e7\u00e3o com o sindicato.<\/li>\n\n\n\n<li><strong>2. Afixar aviso em todos os postos de trabalho.<\/strong> O comunicado aos empregados deve ser feito no mesmo prazo de 15 dias, com afixa\u00e7\u00e3o nos locais de trabalho, independentemente de quem est\u00e1 ou n\u00e3o abrangido pelas f\u00e9rias.<\/li>\n\n\n\n<li><strong>3. As regras de c\u00e1lculo seguem os mesmos crit\u00e9rios do <a href=\"\/blog\/pt\/pagamento-de-ferias-na-clt\/\" data-wpel-link=\"internal\" target=\"_blank\">pagamento de f\u00e9rias na CLT<\/a>.<\/p>\n\n\n\n<p>O pagamento deve ser feito <strong>at\u00e9 dois dias antes do in\u00edcio do recesso<\/strong>, junto com o comprovante e a anota\u00e7\u00e3o na CTPS. O descumprimento desse prazo implica <strong>multa de R$ 176,03 por empregado prejudicado<\/strong>, valor que dobra em caso de reincid\u00eancia (Portaria MTE n\u00ba 66\/2024).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Como calcular as f\u00e9rias coletivas<\/h3>\n\n\n\n<p><strong>F\u00f3rmula base:<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Sal\u00e1rio mensal \u00f7 30 \u00d7 n\u00famero de dias de f\u00e9rias + 1\/3 sobre o resultado<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Sobre o valor calculado incidem os descontos obrigat\u00f3rios de <strong>INSS e Imposto de Renda<\/strong>, conforme a faixa salarial do empregado.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">F\u00e9rias coletivas proporcionais: como calcular para quem tem menos de um ano<\/h3>\n\n\n\n<p>Empregados com menos de 12 meses de empresa participam das f\u00e9rias coletivas, mas recebem <strong>proporcionalmente ao tempo trabalhado<\/strong> (art. 140 da CLT). Ap\u00f3s o encerramento das coletivas, inicia-se novo per\u00edodo aquisitivo.<\/p>\n\n\n\n<p><strong>F\u00f3rmula proporcional:<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>(Sal\u00e1rio \u00f7 12) \u00d7 meses trabalhados<\/strong> = valor das f\u00e9rias proporcionais<\/p>\n<\/blockquote>\n\n\n\n<p>Se os dias proporcionais forem <strong>insuficientes para cobrir o per\u00edodo das coletivas<\/strong>, a diferen\u00e7a \u00e9 lan\u00e7ada como <strong>licen\u00e7a remunerada<\/strong>, n\u00e3o como f\u00e9rias. O custo permanece o mesmo para a empresa, mas o tratamento no eSocial \u00e9 diferente: f\u00e9rias e licen\u00e7a remunerada t\u00eam rubricas distintas na folha.<\/p>\n\n\n\n<p><strong>Exemplo:<\/strong> u, empregado admitido em 01\/04\/2025 entra em f\u00e9rias coletivas de 10 dias em 01\/12\/2025. Com 8 meses de casa, tem direito a 20 dias proporcionais (2\/3 de 30). Os 10 dias de f\u00e9rias coletivas s\u00e3o descontados desse saldo; restam 10 dias a usufruir. Feriados fora do per\u00edodo n\u00e3o interferem no c\u00e1lculo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quem entra nas f\u00e9rias coletivas e quem fica de fora?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>T\u00eam direito:<\/strong> todos os empregados CLT do setor ou da empresa abrangida, incluindo trabalhadores em contrato de experi\u00eancia e aprendizes com contrato formal.<\/li>\n\n\n\n<li><strong>N\u00e3o s\u00e3o obrigados a participar:<\/strong> estagi\u00e1rios &#8211; a empresa pode inclu\u00ed-los, mas n\u00e3o \u00e9 obrigat\u00f3rio conceder no mesmo per\u00edodo.<\/li>\n\n\n\n<li><strong>Terceirizados:<\/strong> a decis\u00e3o cabe \u00e0 empresa prestadora de servi\u00e7os, n\u00e3o \u00e0 contratante.
