Descumprir os requisitos do art. 134 da <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/clt\/\" data-wpel-link=\"internal\" target=\"_blank\">CLT<\/a> obriga a empresa ao <strong>pagamento em dobro<\/strong> previsto no art. 137, al\u00e9m de expor a fiscaliza\u00e7\u00f5es do MTE e a\u00e7\u00f5es trabalhistas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que s\u00e3o f\u00e9rias fracionadas<\/h2>\n\n\n\n<p><strong>F\u00e9rias fracionadas<\/strong> s\u00e3o a possibilidade legal de dividir os <strong>30 dias de descanso anual<\/strong> em at\u00e9 <strong>tr\u00eas per\u00edodos menores<\/strong>, em vez de conced\u00ea-los em um \u00fanico bloco cont\u00ednuo.<\/p>\n\n\n\n<p>A modalidade foi consolidada pela <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/reforma-trabalhista\/\" data-wpel-link=\"internal\" target=\"_blank\">Reforma Trabalhista de 2017<\/a>, que ampliou o n\u00famero m\u00e1ximo de per\u00edodos de 2 para 3 e flexibilizou as condi\u00e7\u00f5es de uso. <\/p>\n\n\n\n<p>Antes da reforma, <strong>o fracionamento era exce\u00e7\u00e3o<\/strong>. Hoje \u00e9 pr\u00e1tica regular em empresas que precisam alinhar descanso e continuidade operacional.<\/p>\n\n\n\n<p>Para o RH, o fracionamento \u00e9 a ferramenta que permite escalonar f\u00e9rias ao longo do ano, evitar sobreposi\u00e7\u00f5es cr\u00edticas em equipes pequenas e<strong> manter a opera\u00e7\u00e3o<\/strong> sem comprometer o direito ao descanso.<\/p>\n\n\n\n<bzn-note><a href=\"\/blog\/pt\/controle-de-ferias\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>Controle de f\u00e9rias de funcion\u00e1rios<\/strong><\/span><br \/>Automatize sua gest\u00e3o de f\u00e9rias conforme a CLT.<\/a><\/bzn-note>\n\n\n\n<h2 class=\"wp-block-heading\">Regras das f\u00e9rias fracionadas: o que diz o art. 134 da CLT<\/h2>\n\n\n\n<p>O <strong>art. 134 da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/decreto-lei\/del5452.htm\" rel=\"nofollow noopener\" data-wpel-link=\"external\" target=\"_blank\">Consolida\u00e7\u00e3o das Leis do Trabalho<\/a><\/strong> estabelece os par\u00e2metros que toda concess\u00e3o fracionada precisa respeitar. Conhecer essas <strong>regras das f\u00e9rias fracionadas<\/strong> \u00e9 o primeiro passo para evitar autua\u00e7\u00f5es e passivo trabalhista.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">N\u00famero m\u00e1ximo de per\u00edodos<\/h3>\n\n\n\n<p>A divis\u00e3o \u00e9 permitida em <strong>at\u00e9 3 per\u00edodos<\/strong> dentro do mesmo ano aquisitivo. A empresa pode conceder os 30 dias em bloco \u00fanico, em 2 per\u00edodos ou em 3, conforme acordo com o colaborador. A empresa n\u00e3o pode impor a divis\u00e3o e o colaborador n\u00e3o pode exigi-la unilateralmente. O RH costuma propor o cronograma com base na escala da equipe e formalizar o acordo por escrito antes da concess\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como funcionam as f\u00e9rias fracionadas em 3 per\u00edodos na pr\u00e1tica?<\/h2>\n\n\n\n<p>Entender como funcionam as <strong>f\u00e9rias fracionadas<\/strong> em 3 per\u00edodos \u00e9 o que permite ao RH montar um cronograma anual sem conflitos de escala. O concentrado costuma ser adotado quando o colaborador planeja uma viagem mais longa. A combina\u00e7\u00e3o com o fracionamento \u00e9 permitida.<\/p>\n\n\n\n<p>Dos 30 dias de direito, 10 podem ser vendidos como abono. Os <strong>20 dias restantes<\/strong> podem ser gozados em 2 per\u00edodos, respeitando o m\u00ednimo de <strong>14 dias em um deles e 5 no outro<\/strong>.<\/p>\n\n\n\n<p>Na pr\u00e1tica, fica assim: 10 dias convertidos em abono + 15 dias de f\u00e9rias em julho + 5 dias em novembro. Total: 30 dias de direito, com 20 gozados e 10 vendidos. A solicita\u00e7\u00e3o do abono precisa ser feita pelo colaborador <strong>at\u00e9 15 dias antes do t\u00e9rmino do per\u00edodo aquisitivo<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como calcular f\u00e9rias fracionadas passo a passo<\/h2>\n\n\n\n<p>O c\u00e1lculo das <strong>f\u00e9rias fracionadas<\/strong> segue a mesma base das f\u00e9rias integrais, aplicado proporcionalmente a cada per\u00edodo concedido. Atraso nesse pagamento tamb\u00e9m aciona a regra da dobra do art. 137.<\/p>\n\n\n\n<p>O <a href=\"https:\/\/www.bizneo.com\/br\/gestao-ferias\/\" data-wpel-link=\"internal\" target=\"_blank\">software de gest\u00e3o de f\u00e9rias e aus\u00eancias <\/a>da Bizneo HR calcula automaticamente cada per\u00edodo fracionado, incluindo o ter\u00e7o constitucional e o abono pecuni\u00e1rio, e emite alertas autom\u00e1ticos de prazo de pagamento para evitar a dobra.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que acontece se a empresa n\u00e3o cumprir as regras<\/h2>\n\n\n\n<p>O descumprimento do art. 134 n\u00e3o \u00e9 infra\u00e7\u00e3o leve. As consequ\u00eancias s\u00e3o cumulativas e impactam custo, fiscaliza\u00e7\u00e3o e reputa\u00e7\u00e3o.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pagamento em dobro (art. 137 da CLT)<\/h3>\n\n\n\n<p>Quando as f\u00e9rias s\u00e3o concedidas fora do prazo ou em desacordo com as regras de fracionamento, o art. 137 obriga a empresa a pagar o <strong>valor das f\u00e9rias em dobro<\/strong>, incluindo o ter\u00e7o constitucional. Para um sal\u00e1rio de R$ 3.000, a dobra de um per\u00edodo de 15 dias representa um custo extra de <strong>R$ 2.000 por colaborador afetado<\/strong>.<\/p>\n\n\n\n<p>A dobra \u00e9 aplicada mesmo quando o descumprimento \u00e9 involunt\u00e1rio. A inten\u00e7\u00e3o da empresa n\u00e3o exclui a multa.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Multas administrativas do MTE<\/h3>\n\n\n\n<p>A fiscaliza\u00e7\u00e3o do Minist\u00e9rio do Trabalho aplica multa por colaborador irregular, com valor vari\u00e1vel conforme o porte da empresa e a gravidade. Em fiscaliza\u00e7\u00f5es que detectam padr\u00e3o sist\u00eamico, o valor \u00e9 aplicado por cada caso identificado.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Risco de a\u00e7\u00e3o trabalhista<\/h3>\n\n\n\n<p>O colaborador pode ingressar com a\u00e7\u00e3o na Justi\u00e7a do Trabalho para cobrar a dobra, juros e corre\u00e7\u00e3o monet\u00e1ria, com possibilidade de inclus\u00e3o de honor\u00e1rios e dano moral em casos repetidos. O colaborador que recebe uma proposta de fracionamento fora das regras pode <strong>recusar formalmente<\/strong>, <strong>acionar o sindicato<\/strong> ou <strong>registrar reclama\u00e7\u00e3o no MTE<\/strong>.<\/p>\n\n\n<p><bzn-link><a href=\"\/br\/gestao-ferias\/\" id=\"destacado-vacaciones\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-link-title\">Gerencia as f\u00e9rias e licen\u00e7as de sua equipe&#8230;<\/span>Em tempo recorde!<\/a><\/bzn-link><\/p>\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Boas pr\u00e1ticas para gerir f\u00e9rias fracionadas<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Cronograma anual de concess\u00f5es:<\/h3>\n\n\n\n<p>Definir a janela de cada equipe no primeiro trimestre, com revis\u00e3o semestral.
