Lorsqu&#8217;un contrat prend fin avant que ces jours soient sold\u00e9s, vous \u00eates tenu de verser une indemnit\u00e9 compensatrice, faute de quoi vous vous exposez \u00e0 un rappel de salaire pouvant couvrir jusqu&#8217;\u00e0 trois ans d&#8217;arri\u00e9r\u00e9s (article L.1471-1 du <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006195759\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"external\">Code du travail<\/a>).<\/p>\n\n\n\n<div class=\"wp-block-group has-ast-global-color-7-background-color has-background is-layout-constrained wp-container-core-group-is-layout-24567ffd wp-block-group-is-layout-constrained\" style=\"padding-top:var(--wp--preset--spacing--40);padding-right:var(--wp--preset--spacing--40);padding-bottom:var(--wp--preset--spacing--40);padding-left:var(--wp--preset--spacing--40)\">\n<p><strong>En bref :<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>L&#8217;indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s (ICCP)<\/strong> est due \u00e0 tout salari\u00e9 dont le contrat prend fin avec des jours acquis non pris.<\/li>\n\n\n\n<li><strong>Calcul <\/strong>: deux m\u00e9thodes l\u00e9gales (r\u00e8gle du dixi\u00e8me ou maintien de salaire). L&#8217;employeur retient obligatoirement la plus favorable au salari\u00e9.<\/li>\n\n\n\n<li><strong>Versement :<\/strong> \u00e0 la date de fin du contrat, inclus dans le solde de tout compte.<\/li>\n\n\n\n<li><strong>Fiscalit\u00e9 :<\/strong> soumise \u00e0 l&#8217;imp\u00f4t sur le revenu et \u00e0 la CSG\/CRDS (9,7 %), mais exon\u00e9r\u00e9e de cotisations sociales URSSAF.<\/li>\n\n\n\n<li><strong>Depuis la loi du 22 avril 2024 :<\/strong> un salari\u00e9 en arr\u00eat maladie non-professionnelle acquiert 2 jours ouvrables de cong\u00e9s par mois d&#8217;absence, avec droit au report sur 15 mois.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Ce que dit le Code du travail sur les cong\u00e9s pay\u00e9s non pris<\/h2>\n\n\n\n<p>Le droit aux cong\u00e9s pay\u00e9s est encadr\u00e9 par les <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020838\" type=\"link\" id=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020838\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"external\">articles L.3141-1 et suivants du Code du travail<\/a>. Trois principes structurent ce droit.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le cong\u00e9 annuel pay\u00e9 est un droit auquel <strong>le salari\u00e9 ne peut pas renoncer<\/strong>. Il ne peut pas non plus \u00eatre remplac\u00e9 par une compensation financi\u00e8re en cours de contrat, sauf exceptions pr\u00e9vues par la loi.<\/li>\n\n\n\n<li>La <strong>dur\u00e9e l\u00e9gale minimale est de 30 jours civils par ann\u00e9e<\/strong> de r\u00e9f\u00e9rence, ce qui correspond \u00e0 25 jours ouvrables ou 22 jours ouvrables selon la convention collective applicable.<\/li>\n\n\n\n<li>Le <strong>calendrier des cong\u00e9s est fix\u00e9 dans chaque entreprise<\/strong>. L&#8217;employeur doit informer le salari\u00e9 de ses dates au moins deux mois avant le d\u00e9but du cong\u00e9.<\/li>\n<\/ul>\n\n\n\n<p>Les contrats de travail et les conventions collectives peuvent am\u00e9liorer ces minima, mais <strong>jamais les r\u00e9duire<\/strong>. En cas de doute sur les r\u00e8gles applicables \u00e0 votre secteur, consultez votre convention collective.<\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/fr\/gestion-des-conges\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span class=\"bzn-link-title\"><strong>Comment assurer une bonne gestion des cong\u00e9s de vos employ\u00e9s ?<\/strong><\/span> <br>L&#8217;importance d&#8217;une bonne gestion des cong\u00e9s<\/br><\/a><\/bzn-info>\n\n\n\n<h2 class=\"wp-block-heading\">Quand les cong\u00e9s pay\u00e9s non pris doivent-ils \u00eatre indemnis\u00e9s ?<\/h2>\n\n\n\n<p>La r\u00e8gle g\u00e9n\u00e9rale est que <strong>les cong\u00e9s acquis doivent \u00eatre pris, pas pay\u00e9s<\/strong>. Il existe cependant plusieurs situations dans lesquelles vous \u00eates tenu de verser une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Rupture ou fin du contrat de travail<\/h3>\n\n\n\n<p>Les <strong>jours de cong\u00e9s acquis et non pris donnent droit \u00e0 une indemnit\u00e9 compensatrice<\/strong>. Quelle que soit la cause de la rupture : d\u00e9mission, licenciement, rupture conventionnelle, fin de CDD, d\u00e9part en retraite.<\/p>\n\n\n\n<p>Cette <strong>obligation s&#8217;applique sans exception<\/strong> : un salari\u00e9 licenci\u00e9 pour faute grave conserve ce droit, contrairement \u00e0 ce que pr\u00e9voyait l&#8217;ancienne jurisprudence fran\u00e7aise (alignement sur la directive europ\u00e9enne, confirm\u00e9 par la Cour de cassation).<\/p>\n\n\n\n<p>L&#8217;indemnit\u00e9 compensatrice est soumise \u00e0 la CSG\/CRDS (9,7 %) et \u00e0 l&#8217;imp\u00f4t sur le revenu, mais elle est <strong>exon\u00e9r\u00e9e de cotisations sociales URSSAF<\/strong>. Elle doit figurer sur le <a href=\"https:\/\/www.bizneo.com\/blog\/fr\/solde-de-tout-compte\/\" data-wpel-link=\"internal\" target=\"_blank\">solde de tout compte<\/a> et \u00eatre vers\u00e9e \u00e0 la date de fin du contrat.<\/p>\n\n\n\n<p>Sur le plan pratique, l&#8217;ICCP cr\u00e9e un <strong>diff\u00e9r\u00e9 d&#8217;indemnisation ch\u00f4mage<\/strong> : France Travail reporte le versement des allocations d&#8217;un nombre de jours \u00e9quivalent aux cong\u00e9s indemnis\u00e9s, dans la limite de 30 jours. Ce point est \u00e0 anticiper lors des entretiens de d\u00e9part.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Arr\u00eat maladie et cong\u00e9s non pris : ce que change la loi du 22 avril 2024<\/h3>\n\n\n\n<p>La <strong>loi n\u00b0 2024-364 du 22 avril 2024<\/strong> a profond\u00e9ment modifi\u00e9 les droits \u00e0 cong\u00e9s des salari\u00e9s en arr\u00eat maladie non-professionnelle. Deux changements majeurs s&#8217;appliquent depuis lors.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Acquisition de cong\u00e9s pendant l&#8217;arr\u00eat :<\/strong> un salari\u00e9 en arr\u00eat maladie non-professionnelle acquiert d\u00e9sormais 2 jours ouvrables de cong\u00e9s par mois d&#8217;absence, dans la limite de 24 jours ouvrables par an (contre 0 auparavant pour la maladie non-professionnelle).<\/li>\n\n\n\n<li><strong>Droit au report :<\/strong> lorsque le salari\u00e9 ne peut pas prendre ses cong\u00e9s en raison de son arr\u00eat, il <strong>b\u00e9n\u00e9ficie d&#8217;un droit au report sur une p\u00e9riode de 15 mois suivant la reprise du travail<\/strong> ou la fin du contrat. L&#8217;employeur doit informer le salari\u00e9 de ses droits dans un d\u00e9lai d&#8217;un mois apr\u00e8s la reprise.<\/li>\n<\/ul>\n\n\n\n<p>Cette r\u00e9forme cr\u00e9e une <strong>nouvelle obligation de suivi<\/strong> pour le service RH : identifier les cong\u00e9s acquis pendant les arr\u00eats maladie, les communiquer au salari\u00e9 \u00e0 la reprise et les int\u00e9grer dans le calcul de l&#8217;indemnit\u00e9 compensatrice en cas de rupture.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a \u00e0 la retraite apr\u00e8s une <strong>p\u00e9riode d&#8217;incapacit\u00e9 de travail<\/strong> qui l&#8217;a emp\u00each\u00e9 de prendre ses cong\u00e9s, il a droit \u00e0 l&#8217;indemnisation des jours non pris, dans les conditions du droit au report d\u00e9crit ci-dessus. <\/p>\n\n\n\n<p>En revanche, un salari\u00e9 qui prend sa retraite sans avoir \u00e9t\u00e9 en arr\u00eat maladie et qui n&#8217;a pas pris ses cong\u00e9s sur la p\u00e9riode de r\u00e9f\u00e9rence en cours ne peut pas en g\u00e9n\u00e9ral pr\u00e9tendre \u00e0 une indemnisation pour la partie des cong\u00e9s dont il n&#8217;a pas demand\u00e9 la prise avant son d\u00e9part.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tableau r\u00e9capitulatif : dans quels cas indemniser les cong\u00e9s non pris class=\"wp-block-heading\">Comment calculer l&#8217;indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s<\/h2>\n\n\n\n<p>La loi impose d&#8217;appliquer la m\u00e9thode la plus favorable au salari\u00e9 entre deux modes de calcul. Vous ne pouvez pas choisir librement : <strong>vous devez calculer les deux et retenir le r\u00e9sultat le plus \u00e9lev\u00e9.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">M\u00e9thode 1 : la r\u00e8gle du dixi\u00e8me<\/h3>\n\n\n\n<p>L&#8217;indemnit\u00e9 est \u00e9gale au <strong>dixi\u00e8me de la r\u00e9mun\u00e9ration brute totale per\u00e7ue par le salari\u00e9<\/strong> au cours de la p\u00e9riode de r\u00e9f\u00e9rence (du 1er juin de l&#8217;ann\u00e9e pr\u00e9c\u00e9dente au 31 mai de l&#8217;ann\u00e9e en cours, sauf convention collective pr\u00e9voyant une autre p\u00e9riode). On rapporte ensuite ce montant aux jours non pris.<\/p>\n\n\n\n<p><strong>Formule :<\/strong> (R\u00e9mun\u00e9ration brute totale de la p\u00e9riode de r\u00e9f\u00e9rence \u00f7 10) \u00d7 (Jours de cong\u00e9s non pris \u00f7 Jours de cong\u00e9s total acquis)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">M\u00e9thode 2 : la r\u00e8gle du maintien de salaire<\/h3>\n\n\n\n<p>L&#8217;indemnit\u00e9 correspond au <strong>salaire que le salari\u00e9 aurait per\u00e7u<\/strong> s&#8217;il avait effectivement pris ses cong\u00e9s. On divise le salaire mensuel brut (base + primes r\u00e9currentes) par le nombre de jours ouvr\u00e9s du mois, puis on multiplie par le nombre de jours de cong\u00e9s non pris.<\/p>\n\n\n\n<p><strong>Formule :<\/strong> (Salaire mensuel brut \u00f7 Nombre de jours ouvr\u00e9s du mois) \u00d7 Jours de cong\u00e9s non pris<\/p>\n\n\n\n<p>Dans la pratique, la r\u00e8gle du dixi\u00e8me est plus favorable pour les salari\u00e9s ayant per\u00e7u des primes significatives sur la p\u00e9riode. La <strong>r\u00e8gle du maintien de salaire est souvent plus favorable pour les salari\u00e9s avec un salaire de base stable et peu de primes<\/strong>. Votre <a href=\"https:\/\/www.bizneo.com\/blog\/fr\/gestion-paie\/\" data-wpel-link=\"internal\" target=\"_blank\">logiciel de paie<\/a> ou SIRH doit effectuer ce double calcul automatiquement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Exemple chiffr\u00e9<\/h3>\n\n\n\n<p>Un salari\u00e9 quitte l&#8217;entreprise avec 8 jours de cong\u00e9s non pris. Son salaire mensuel brut est de 2 800 \u20ac. La dur\u00e9e du cong\u00e9 ne se calcule pas au prorata du temps de travail journalier.<\/p>\n\n\n\n<p>La diff\u00e9rence porte uniquement sur le montant de l&#8217;indemnit\u00e9 : elle est calcul\u00e9e sur la base du salaire r\u00e9el du salari\u00e9 \u00e0 temps partiel, qui est m\u00e9caniquement inf\u00e9rieur \u00e0 celui d&#8217;un temps plein.
