Afin de d\u00e9terminer comment et quand il est possible de le faire, nous avons pr\u00e9par\u00e9 ce guide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cong\u00e9s pay\u00e9s non pris : qu&#8217;en dit la loi ?<\/h2>\n\n\n\n<p>En France, les <a href=\"https:\/\/www.bizneo.com\/blog\/fr\/conges\/\" data-wpel-link=\"internal\" target=\"_blank\">cong\u00e9s pay\u00e9s<\/a> sont r\u00e9gis par le <strong>Code du travail<\/strong>. <\/p>\n\n\n\n<p>Selon la loi, la p\u00e9riode de cong\u00e9 annuel pay\u00e9, <strong>non rempla\u00e7able par une compensation financi\u00e8re<\/strong>, est celle convenue dans la convention collective ou le contrat individuel. Sa dur\u00e9e ne peut en aucun cas \u00eatre inf\u00e9rieure \u00e0 trente jours civils.<\/p>\n\n\n\n<p>D&#8217;autre part, la ou<strong> les p\u00e9riodes de cong\u00e9 sont fix\u00e9es par accord mutuel <\/strong>entre l&#8217;employeur et le travailleur, conform\u00e9ment aux dispositions des conventions collectives relatives \u00e0 la planification des cong\u00e9s annuels.<\/p>\n\n\n\n<p>Le <strong>calendrier des cong\u00e9s<\/strong> est fix\u00e9 dans chaque entreprise. L&#8217;employ\u00e9 doit \u00eatre inform\u00e9 des dates qui lui correspondent au moins deux mois avant le d\u00e9but du cong\u00e9.<\/p>\n\n\n\n<p>Cela signifie que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le cong\u00e9 annuel pay\u00e9 est <strong>un droit auquel on ne peut renoncer<\/strong> et qui doit \u00eatre pris dans son int\u00e9gralit\u00e9.<\/li>\n\n\n\n<li>La dur\u00e9e du cong\u00e9 annuel pay\u00e9 est fix\u00e9e par la loi en r\u00e9f\u00e9rence \u00e0 l&#8217;ann\u00e9e et ne peut \u00eatre inf\u00e9rieure \u00e0 <strong>30 jours civils<\/strong>. Toutefois, de nombreuses conventions collectives \u00e9tablissent actuellement les cong\u00e9s en jours ouvrables, de sorte que 30 jours civils correspondent \u00e0 <strong>22 jours ouvrables<\/strong>.<\/li>\n\n\n\n<li>Par cons\u00e9quent, en France, chaque travailleur a droit \u00e0 un repos de <strong>2,5 jours civils, soit 1,8 jour ouvrable par mois<\/strong> de travail.<\/li>\n\n\n\n<li>Les contrats de travail et les conventions collectives peuvent \u00e9tendre ces chiffres, mais jamais les r\u00e9duire par rapport au minimum l\u00e9gal.<\/li>\n<\/ul>\n\n\n\n<bzn-info><a href=\"\/blog\/fr\/gestion-des-conges\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span class=\"bzn-link-title\"><strong>Comment assurer une bonne gestion des cong\u00e9s de vos employ\u00e9s ?<\/strong><\/span> <br>L\u2019importance d\u2019une bonne gestion des cong\u00e9s<\/br><\/a><\/bzn-info>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quand et comment r\u00e9mun\u00e9rer des cong\u00e9s pay\u00e9s non pris ?<\/h2>\n\n\n\n<p>Selon notre l\u00e9gislation, les cong\u00e9s annuels sont un droit inali\u00e9nable. En r\u00e8gle g\u00e9n\u00e9rale, cela signifie que les cong\u00e9s ne peuvent \u00eatre ni remplac\u00e9s par de l&#8217;argent ni accumul\u00e9s.<\/p>\n\n\n\n<p>Il existe toutefois <strong>deux exceptions <\/strong>\u00e0 cette r\u00e8gle :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le paiement des cong\u00e9s en cas de<strong> d\u00e9part \u00e0 la retraite<\/strong>.<\/li>\n\n\n\n<li>Le paiement des cong\u00e9s pay\u00e9s en cas de <strong>r\u00e9siliation du contrat<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Dans les deux cas, les cong\u00e9s non pris doivent \u00eatre pay\u00e9s comme s&#8217;il s&#8217;agissait de jours ouvrables, c&#8217;est-\u00e0-dire sur la base du salaire de chaque travailleur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Paiement des cong\u00e9s pour cause de d\u00e9part \u00e0 la retraite<\/h3>\n\n\n\n<p>Il existe deux cas de figure concernant le paiement des cong\u00e9s non pris pour cause de retraite :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si un travailleur prend sa <strong>retraite apr\u00e8s une incapacit\u00e9 de travail <\/strong>qui l&#8217;a emp\u00each\u00e9 de prendre les jours de vacances auxquels il a droit, il aura le droit d&#8217;\u00eatre pay\u00e9 pour le repos non pris.<\/li>\n\n\n\n<li>Le cas des <strong>travailleurs qui prennent leur retraite sans avoir \u00e9t\u00e9 malades<\/strong> est diff\u00e9rent. Cette cat\u00e9gorie de retrait\u00e9s ne peut pr\u00e9tendre au paiement du repos non pris.<\/li>\n<\/ul>\n\n\n\n<div id=\"cbox-4lHZzEpMiUZHjpnz\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Indemnit\u00e9 de cong\u00e9s pay\u00e9s non pris en cas de r\u00e9siliation du contrat<\/h3>\n\n\n\n<p>La <strong>r\u00e9siliation du contrat de travail<\/strong> avant le droit aux vacances pr\u00e9voit \u00e9galement le paiement des jours de vacances non pris, quelle que soit la cause de la r\u00e9siliation.<\/p>\n\n\n\n<p>Dans ce cas, une <strong>compensation financi\u00e8re proportionnelle \u00e0 la p\u00e9riode de cong\u00e9s non pris <\/strong>sera incluse dans le r\u00e8glement correspondant. La raison en est simple :<strong> les travailleurs \u00e0 temps partiel ont les m\u00eames droits que les travailleurs \u00e0 temps plein<\/strong>. Comme indiqu\u00e9 plus haut, la dur\u00e9e des cong\u00e9s est l\u00e9galement fix\u00e9e par rapport \u00e0 l&#8217;ann\u00e9e, et non en fonction de la journ\u00e9e de travail de chaque salari\u00e9.<\/p>\n\n\n\n<p>Seuls les travailleurs \u00e0 temps partiel sont <strong>r\u00e9mun\u00e9r\u00e9s pour les cong\u00e9s non pris en fonction du salaire<\/strong> auquel ils ont droit.
