Esse per\u00edodo m\u00ednimo n\u00e3o \u00e9 apenas uma formalidade legal \u2014 ele existe para <strong>proteger a sa\u00fade<\/strong>, evitar excesso de trabalho e reduzir riscos de acidentes decorrentes de fadiga.<\/p>\n\n\n\n<p>Quando a empresa <strong>n\u00e3o respeita o intervalo interjornada<\/strong>, al\u00e9m de comprometer o bem-estar dos colaboradores, pode ser <strong>obrigada a pagar horas extras<\/strong> e sofrer penalidades. O descanso m\u00ednimo de <strong>11 horas consecutivas entre jornadas<\/strong> evita a fadiga, melhora a concentra\u00e7\u00e3o e reduz o risco de acidentes. Funcion\u00e1rios bem descansados tendem a ser mais produtivos, engajados e menos propensos a erros.<\/p>\n\n\n\n<p>Essa regra <strong>se aplica \u00e0 maioria dos trabalhadores<\/strong>, mas existem exce\u00e7\u00f5es previstas em <strong>acordos ou conven\u00e7\u00f5es coletivas<\/strong>, especialmente para profissionais com escalas diferenciadas \u2014 como <strong>motoristas, vigilantes, profissionais da sa\u00fade ou do transporte ferrovi\u00e1rio<\/strong>. Mesmo nesses casos, deve-se assegurar um tempo m\u00ednimo de recupera\u00e7\u00e3o f\u00edsica entre jornadas.<\/p>\n\n\n\n<p>Al\u00e9m de ser um direito fundamental do colaborador, o intervalo interjornada tamb\u00e9m representa uma <strong>garantia de seguran\u00e7a jur\u00eddica para a empresa<\/strong>. Ambos s\u00e3o fundamentais para a sa\u00fade e a produtividade dos colaboradores.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Diferen\u00e7as principais:<\/h3>\n\n\n\n<figure processos trabalhistas e san\u00e7\u00f5es legais.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">O que diz a lei sobre o intervalo interjornada?<\/h3>\n\n\n\n<p>A <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/clt\/\" data-wpel-link=\"internal\" target=\"_blank\">Consolida\u00e7\u00e3o das Leis do Trabalho (CLT) <\/a>\u00e9 a principal legisla\u00e7\u00e3o trabalhista do Brasil <strong>e abrange diversos aspectos das rela\u00e7\u00f5es de trabalho, incluindo normas sobre a jornada de trabalho.<\/strong> De <a href=\"https:\/\/www.jusbrasil.com.br\/topicos\/10759018\/artigo-66-do-decreto-lei-n-5452-de-01-de-maio-de-1943\" data-wpel-link=\"external\" target=\"_blank\" rel=\"noopener\">acordo com o Artigo 66 da CLT<\/a>, est\u00e1 estabelecido que:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cEntre 2 (duas) jornadas de trabalho haver\u00e1 um per\u00edodo m\u00ednimo de 11 (onze) horas consecutivas para descanso.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Essa norma legal torna o <strong>intervalo interjornada<\/strong> um direito obrigat\u00f3rio para quase todos os trabalhadores celetistas, visando garantir recupera\u00e7\u00e3o adequada entre jornadas.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Aplica\u00e7\u00e3o e obriga\u00e7\u00f5es<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O trabalhador s\u00f3 poder\u00e1 iniciar nova jornada se tiver cumprido o <strong>m\u00ednimo de 11 horas consecutivas<\/strong> de descanso<\/li>\n\n\n\n<li>A regra vale independentemente da modalidade de contrata\u00e7\u00e3o (CLT, tempor\u00e1rio, terceirizado) ou da dura\u00e7\u00e3o da jornada anterior \u2014 mesmo que tenha trabalhado apenas 4 horas.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Consequ\u00eancias do descumprimento<\/h4>\n\n\n\n<p>Se a empresa n\u00e3o conceder esse intervalo, estar\u00e1 sujeita a:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pagamento das horas correspondentes ao per\u00edodo suprimido como <strong>horas extras<\/strong>, com adicional de ao menos 50%.<\/li>\n\n\n\n<li>Responsabilidade trabalhista e possibilidade de a\u00e7\u00e3o por danos causados \u00e0 sa\u00fade do trabalhador ou por jornadas excessivas.<\/li>\n\n\n\n<li>Multas e autua\u00e7\u00f5es por parte da fiscaliza\u00e7\u00e3o do trabalho.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Exce\u00e7\u00f5es previstas<\/h4>\n\n\n\n<p>Algumas categorias espec\u00edficas podem ter regras diferenciadas, desde que previstas em conven\u00e7\u00e3o coletiva ou lei especial, como:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Jornalistas<\/strong>: intervalo m\u00ednimo de <strong>10 horas<\/strong> entre jornadas (Art.\u202f308 da CLT).<\/li>\n\n\n\n<li><strong>Motoristas<\/strong>: podem ter regras pr\u00f3prias de fracionamento de jornada, segundo a <strong>Lei 13.103\/2015<\/strong> (Lei do Motorista) e o <strong>C\u00f3digo de Tr\u00e2nsito Brasileiro<\/strong>.<\/li>\n\n\n\n<li><strong>Ferrovi\u00e1rios e profissionais da sa\u00fade<\/strong>: podem seguir regimes alternativos, definidos por leis espec\u00edficas ou conven\u00e7\u00f5es.<\/li>\n<\/ul>\n\n\n\n<p> <strong>Importante:<\/strong> Em algumas situa\u00e7\u00f5es excepcionais, <strong>o intervalo pode ser reduzido at\u00e9 8 horas<\/strong>, desde que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Haja <strong>acordo ou conven\u00e7\u00e3o coletiva<\/strong> autorizando;<\/li>\n\n\n\n<li>A compensa\u00e7\u00e3o ocorra em at\u00e9 <strong>45 dias<\/strong> (Art.\u202f59-B da CLT, com reda\u00e7\u00e3o da Reforma Trabalhista de
