Na pr\u00e1tica, o c\u00e1lculo correto depende de <strong>qual cen\u00e1rio<\/strong> se aplica: f\u00e9rias integrais, proporcionais, fracionadas, com abono pecuni\u00e1rio ou com m\u00e9dias de vari\u00e1veis e cada um tem f\u00f3rmula e base de incid\u00eancia diferentes.<\/p>\n\n\n\n<p>Um colaborador que recebe horas extras, por exemplo, n\u00e3o tem a base de c\u00e1lculo no sal\u00e1rio nominal da CTPS. Tem na <strong>m\u00e9dia dos \u00faltimos 12 meses<\/strong>, conforme o Art. 142 da CLT. Ignorar isso \u00e9 a origem mais comum de diferen\u00e7as em reclamat\u00f3rias envolvendo f\u00e9rias.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como calcular f\u00e9rias CLT: a f\u00f3rmula base<\/h2>\n\n\n\n<p>Todo c\u00e1lculo de f\u00e9rias CLT parte da mesma base: <strong>sal\u00e1rio bruto do per\u00edodo<\/strong>, acrescido do <strong>1\/3 constitucional<\/strong>, menos os descontos de <strong>INSS e IRRF<\/strong>.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>(Sal\u00e1rio bruto + Sal\u00e1rio bruto \u00f7 3) \u2212 INSS \u2212 IRRF = Valor l\u00edquido das f\u00e9rias<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>O INSS segue a <strong>tabela progressiva vigente<\/strong> (Portaria Interministerial MPS\/MF n\u00ba 13\/2026). A al\u00edquota incide por faixa, n\u00e3o sobre o sal\u00e1rio total. O resultado \u00e9 id\u00eantico ao c\u00e1lculo faixa a faixa, com menos etapas.<\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/controle-de-ferias\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-info-title\"><strong>Como melhorar o controle de f\u00e9rias de seus colaboradores<\/strong><\/span><br>7 vantagens imprescind\u00edveis!<\/a><\/bzn-info>\n\n\n\n<h3 class=\"wp-block-heading\">Como calcular o ter\u00e7o constitucional de f\u00e9rias?<\/h3>\n\n\n\n<p>O <strong>1\/3 constitucional<\/strong> incide sobre o sal\u00e1rio bruto do per\u00edodo de descanso, incluindo a m\u00e9dia de vari\u00e1veis, quando o colaborador recebe horas extras, comiss\u00f5es ou adicionais com habitualidade (<strong>Art. 142 CLT<\/strong>).<\/p>\n\n\n\n<p>A base correta <strong>n\u00e3o \u00e9 o sal\u00e1rio nominal da CTPS<\/strong>. \u00c9 a <strong>remunera\u00e7\u00e3o m\u00e9dia efetivamente recebida<\/strong> nos 12 meses anteriores.<\/p>\n\n\n\n<p>Exemplo: sal\u00e1rio de R$ 2.500 + m\u00e9dia mensal de R$ 400 em horas extras:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Base de c\u00e1lculo das f\u00e9rias: <strong>R$ 2.900<\/strong><\/li>\n\n\n\n<li>Ter\u00e7o constitucional: <strong>R$ 966,67<\/strong><\/li>\n\n\n\n<li>Total bruto antes dos descontos: <strong>R$ 3.866,67<\/strong><\/li>\n<\/ul>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/ferias\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>F\u00e9rias CLT:<\/strong><\/span><br \/>Regras, direitos, per\u00edodos e obriga\u00e7\u00f5es do empregador respondidos em um s\u00f3 lugar.<\/a><\/bzn-info>\n\n\n\n<h2 class=\"wp-block-heading\">Tabela de faltas injustificadas e impacto nos dias de f\u00e9rias<\/h2>\n\n\n\n<p>O <strong>Art. 130 da CLT<\/strong> vincula os dias de f\u00e9rias ao n\u00famero de <strong>faltas injustificadas<\/strong> no per\u00edodo aquisitivo. Agregar os dados mensais sem separar os per\u00edodos \u00e9 um erro frequente que pode reduzir dias de f\u00e9rias indevidamente.<\/p>\n\n\n\n<p>Para o <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/controle-de-ponto\/\" data-wpel-link=\"internal\" target=\"_blank\">controle de ponto<\/a> integrado ao m\u00f3dulo de f\u00e9rias, o tipo de aus\u00eancia alimenta automaticamente o c\u00e1lculo do per\u00edodo aquisitivo correto.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como calcular f\u00e9rias proporcionais?<\/h2>\n\n\n\n<p>As <strong>f\u00e9rias proporcionais<\/strong> correspondem ao direito de quem ainda n\u00e3o completou <strong>12 meses<\/strong> no per\u00edodo aquisitivo atual. <\/p>\n\n\n\n<p>Incidem principalmente em demiss\u00e3o sem justa causa, pedido de demiss\u00e3o e t\u00e9rmino de contrato por prazo determinado. <strong>Na demiss\u00e3o por justa causa, o direito \u00e9 perdido<\/strong> (Art. 146, par\u00e1grafo \u00fanico, CLT).<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>(Sal\u00e1rio bruto \u00f7 12) \u00d7 meses completos trabalhados + 1\/3 sobre esse resultado<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Exemplo: sal\u00e1rio de <strong>R$ 3.000<\/strong>, <strong>8 meses<\/strong> completos trabalhados.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>F\u00e9rias proporcionais: R$ 250 \u00d7 8 = <strong>R$ 2.000<\/strong><\/li>\n\n\n\n<li>Ter\u00e7o constitucional: <strong>R$ 666,67<\/strong><\/li>\n\n\n\n<li>Total bruto: <strong>R$ 2.666,67<\/strong> (sujeito a INSS e IRRF)<\/li>\n<\/ul>\n\n\n\n<p><strong>Tabela de f\u00e9rias proporcionais por m\u00eas trabalhado:<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><thead><tr><th>Meses completos<\/th><th>Dias proporcionais<\/th><\/tr><\/thead><tbody><tr><td>1<\/td><td>2,5<\/td><\/tr><tr><td>2<\/td><td>5<\/td><\/tr><tr><td>3<\/td><td>7,5<\/td><\/tr><tr><td>4<\/td><td>10<\/td><\/tr><tr><td>5<\/td><td>12,5<\/td><\/tr><tr><td>6<\/td><td>15<\/td><\/tr><tr><td>7<\/td><td>17,5<\/td><\/tr><tr><td>8<\/td><td>20<\/td><\/tr><tr><td>9<\/td><td>22,5<\/td><\/tr><tr><td>10<\/td><td>25<\/td><\/tr><tr><td>11<\/td><td>27,5<\/td><\/tr><tr><td>12<\/td><td>30<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Valores fracion\u00e1rios s\u00e3o arredondados para o inteiro mais pr\u00f3ximo. <strong>O entendimento consolidado na jurisprud\u00eancia \u00e9 arredondar sempre para cima.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">F\u00e9rias proporcionais na rescis\u00e3o<\/h3>\n\n\n\n<p>Na rescis\u00e3o, o c\u00e1lculo envolve duas verbas distintas: as <strong>f\u00e9rias proporcionais do per\u00edodo aquisitivo em curso<\/strong> e as <strong>f\u00e9rias vencidas<\/strong> do per\u00edodo anterior, se n\u00e3o foram gozadas. Ambas levam 1\/3 e sofrem INSS e IRRF.<\/p>\n\n\n\n<p>Antes de processar qualquer rescis\u00e3o, o DP deve verificar se h\u00e1 <strong>per\u00edodo aquisitivo anterior com f\u00e9rias n\u00e3o concedidas<\/strong>. Esses dias s\u00e3o devidos em dobro no momento da rescis\u00e3o. <\/p>\n\n\n\n<bzn-info><a href=\"\/blog\/pt\/calculo-de-rescisao-clt\/\" id=\"destacado-post\" target=\"_blank\" rel=\"noopener noreferrer\" data-wpel-link=\"internal\"><span class=\"bzn-note-title\"><strong>C\u00e1lculo de rescis\u00e3o:<\/strong><\/span><br \/>Como calcular f\u00e9rias proporcionais, saldo de sal\u00e1rio, FGTS e INSS na rescis\u00e3o do contrato.<\/a><\/bzn-info>\n\n\n\n<h2 class=\"wp-block-heading\">Vari\u00e1veis que entram na base de c\u00e1lculo das f\u00e9rias<\/h2>\n\n\n\n<p>Para colaboradores com <strong>remunera\u00e7\u00e3o vari\u00e1vel<\/strong>, o <strong>Art. 142 da CLT<\/strong> determina que a base de c\u00e1lculo das f\u00e9rias deve ser a <strong>m\u00e9dia dos valores recebidos nos 12 meses anteriores<\/strong> ao gozo, n\u00e3o apenas o sal\u00e1rio fixo.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Horas extras <\/h3>\n\n\n\n<p>Somar o total pago em <a href=\"https:\/\/www.bizneo.com\/blog\/pt\/hora-extra\/\" data-wpel-link=\"internal\" target=\"_blank\">horas extras<\/a> nos 12 meses e dividir por 12. A m\u00e9dia entra na base junto ao sal\u00e1rio fixo. A CLT exige que o pagamento seja <strong>habitual<\/strong> para integrar a base. Pagamentos espor\u00e1dicos ou por liberalidade n\u00e3o entram.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Adicional noturno <\/strong><\/h3>\n\n\n\n<p>O adicional de <strong>20%<\/strong> sobre a hora noturna (Art. 73 CLT) integra a base quando o colaborador trabalha habitualmente em hor\u00e1rio noturno, mesmo que de forma alternada.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Adicional de insalubridade e periculosidade <\/h3>\n\n\n\n<p>Integram a remunera\u00e7\u00e3o para todos os fins trabalhistas, incluindo f\u00e9rias, conforme <strong>entendimento consolidado do TST<\/strong>.<\/p>\n\n\n\n<p>Omitir essas vari\u00e1veis \u00e9, junto com o erro na tabela de faltas, a causa mais frequente de diferen\u00e7as em reclamat\u00f3rias trabalhistas envolvendo f\u00e9rias.<\/p>\n\n\n\n<div id=\"cbox-CZ6beVo9FCVwXgDv\"><\/div>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Abono pecuni\u00e1rio: como calcular a venda de 10 dias de f\u00e9rias?<\/h2>\n\n\n\n<p>O <strong>abono pecuni\u00e1rio<\/strong> permite converter at\u00e9 <strong>10 dias<\/strong> dos 30 dias de f\u00e9rias em pagamento em dinheiro, gozando os <strong>20 dias restantes<\/strong> (Art. 143 CLT).<\/p>\n\n\n\n<p>A iniciativa \u00e9 <strong>exclusiva do colaborador<\/strong>. A empresa n\u00e3o pode impor nem recusar. O pedido deve ser feito at\u00e9 <strong>15 dias antes do t\u00e9rmino do per\u00edodo aquisitivo<\/strong> (Art. 143, \u00a71\u00ba CLT). Pedidos fora do prazo podem ser recusados.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>(Sal\u00e1rio bruto \u00f7 30) \u00d7 10 dias<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Sobre os dias vendidos <strong>n\u00e3o incide o ter\u00e7o constitucional<\/strong>. O 1\/3 aplica-se apenas sobre os dias efetivamente gozados. O abono tem <strong>natureza indenizat\u00f3ria<\/strong>: n\u00e3o sofre desconto de INSS. A incid\u00eancia de IRRF depende da faixa salarial e deve ser verificada na tabela vigente.<\/p>\n\n\n\n<p>Exemplo: colaborador com sal\u00e1rio de <strong>R$ 4.500<\/strong> que vende 10 dias e goza 20.<\/p>\n\n\n\n<p>Abono (10 dias vendidos):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>(R$ 4.500 \u00f7 30) \u00d7 10 = <strong>R$ 1.500<\/strong> (sem INSS, sem 1\/3)<\/li>\n<\/ul>\n\n\n\n<p>F\u00e9rias gozadas (20 dias):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>(R$ 4.500 \u00f7 30) \u00d7 20 = R$ 3.000 + ter\u00e7o = <strong>R$ 4.000 brutos<\/strong> (sujeito a INSS e IRRF)<\/li>\n<\/ul>\n\n\n\n<p><strong>O pagamento do abono segue o mesmo prazo das f\u00e9rias: at\u00e9 2 dias antes do in\u00edcio do gozo.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prazo de pagamento das f\u00e9rias e consequ\u00eancias do descumprimento<\/h2>\n\n\n\n<p>O <strong>Art. 145 da CLT<\/strong> determina que a empresa deve pagar a remunera\u00e7\u00e3o das f\u00e9rias at\u00e9 <strong>2 dias corridos antes<\/strong> do in\u00edcio do descanso. O atraso configura <strong>infra\u00e7\u00e3o administrativa<\/strong>, sujeita a autua\u00e7\u00e3o pelo MTE.<\/p>\n\n\n\n<p>O que o atraso <strong>n\u00e3o<\/strong> gera: <strong>f\u00e9rias em dobro<\/strong>. O STF, na ADPF 501, invalidou a S\u00famula 450\/TST. Atraso no pagamento \u00e9 infra\u00e7\u00e3o administrativa, n\u00e3o dobra autom\u00e1tica.<\/p>\n\n\n\n<p>A <strong>dobra (Art. 137 CLT)<\/strong> se aplica em um \u00fanico caso: quando a empresa <strong>n\u00e3o concede o gozo<\/strong> das f\u00e9rias dentro do <strong>per\u00edodo concessivo<\/strong>, os 12 meses seguintes ao t\u00e9rmino do per\u00edodo aquisitivo.<\/p>\n\n\n\n<p>O risco real \u00e9 o <strong>vencimento silencioso<\/strong>. Um colaborador com per\u00edodo aquisitivo encerrado em mar\u00e7o e f\u00e9rias n\u00e3o concedidas at\u00e9 mar\u00e7o do ano seguinte<strong> gera direito a f\u00e9rias em dobro<\/strong>, independentemente de comunica\u00e7\u00e3o pr\u00e9via.<\/p>\n\n\n\n<p>Al\u00e9m do pagamento, o DP deve emitir o <strong>aviso de f\u00e9rias com pelo menos 30 dias de anteced\u00eancia<\/strong> (Art. 135 CLT) e arquivar o <strong>recibo assinado<\/strong> antes do in\u00edcio do descanso.
