Sem registros v\u00e1lidos, a S\u00famula 338 do TST inverte o \u00f4nus da prova: presume-se verdadeira a jornada alegada na inicial.<\/p>\n\n\n\n<p>O que conta como v\u00e1lido est\u00e1 no art. 74, \u00a72\u00ba da CLT (obrigat\u00f3rio a partir de 20 funcion\u00e1rios) e na Portaria 671\/2021 do MTE, que regula as modalidades manual, mec\u00e2nica e de ponto digital (REP-C, REP-A, REP-P).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"o-que-e-um-controle-de-ponto\">O que \u00e9 um controle de ponto?<\/h2>\n\n\n\n<p>O controle de ponto \u00e9 o<strong> processo de gest\u00e3o da jornada de trabalho<\/strong>: engloba o tratamento das marca\u00e7\u00f5es, o c\u00e1lculo de horas extras e banco de horas, a gera\u00e7\u00e3o de relat\u00f3rios para o RH e a identifica\u00e7\u00e3o de inconsist\u00eancias antes que virem passivo trabalhista.<\/p>\n\n\n\n<p>Registro de ponto e controle de ponto n\u00e3o s\u00e3o sin\u00f4nimos. O registro \u00e9 a <strong>a\u00e7\u00e3o de documentar cada marca\u00e7\u00e3o de entrada<\/strong>, sa\u00edda e intervalo.
