Custo: <strong>34,5 milh\u00f5es de euros<\/strong> em indeniza\u00e7\u00f5es, originados n\u00e3o pela legisla\u00e7\u00e3o, mas pela aus\u00eancia de um processo que tornasse os conflitos de calend\u00e1rio vis\u00edveis antes de virarem crise.<\/p>\n\n\n\n<p>Para o departamento de RH ou DP brasileiro, o risco \u00e9 diferente, mas igualmente concreto: f\u00e9rias vencidas, pagamento em dobro previsto no&nbsp;<a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/decreto-lei\/del5452.htm\" target=\"_blank\" rel=\"noreferrer noopener\" data-wpel-link=\"external\">art. 137 da CLT<\/a>, autua\u00e7\u00f5es do Minist\u00e9rio do Trabalho e Emprego (MTE) e conflitos que corroem o clima organizacional. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"a-importancia-do-controle-de-ferias\">O que \u00e9 controle de f\u00e9rias de funcion\u00e1rios<\/h2>\n\n\n\n<p>O controle de f\u00e9rias de funcion\u00e1rios&nbsp;\u00e9 o processo estrat\u00e9gico de planejamento, registro e gest\u00e3o dos per\u00edodos de descanso remunerado dos colaboradores, <strong>garantindo o cumprimento da CLT <\/strong>(ex: evitar f\u00e9rias vencidas) e a continuidade operacional da empresa. <\/p>\n\n\n\n<p>Geralmente realizado pelo RH, envolve monitorar datas de admiss\u00e3o, per\u00edodos aquisitivos (12 meses de trabalho) e concessivos (prazo para tirar f\u00e9rias).<\/p>\n\n\n\n<p>O controle de f\u00e9rias garante tr\u00eas coisas ao mesmo tempo: a empresa cumpre a CLT, nenhum setor fica descoberto durante os picos sazonais, e cada colaborador planeja o descanso com previsibilidade de pelo menos 30 dias.<\/p>\n\n\n\n<p>O controle de f\u00e9rias se diferencia da simples escala de aus\u00eancias porque envolve obriga\u00e7\u00f5es legais com prazos e penalidades definidos: o empregador tem responsabilidade ativa de conceder as f\u00e9rias dentro do per\u00edodo concessivo, comunicar com anteced\u00eancia m\u00ednima de 30 dias e pagar o adicional de um ter\u00e7o antes do in\u00edcio do descanso. A falta de controle pode levar ao p<strong>agamento em dobro<\/strong> das f\u00e9rias e multas trabalhistas.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Gest\u00e3o de Fluxo de Caixa<\/strong><\/h3>\n\n\n\n<p>Permite ao departamento financeiro<strong> provisionar os custos antecipados<\/strong> (f\u00e9rias + 1\/3 constitucional) e o pagamento at\u00e9 dois dias antes do in\u00edcio do descanso, evitando surpresas no caixa.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que diz a legisla\u00e7\u00e3o sobre o controle de f\u00e9rias de funcion\u00e1rios?<\/h2>\n\n\n\n<p>As regras est\u00e3o nos arts. 129 a 153 da CLT. O gestor de RH precisa dominar ao menos cinco pontos que determinam se a empresa est\u00e1 exposta ou protegida.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Per\u00edodo aquisitivo e per\u00edodo concessivo<\/h3>\n\n\n\n<p>O colaborador adquire o direito a f\u00e9rias ap\u00f3s 12 meses de v\u00ednculo empregat\u00edcio &#8211; esse \u00e9 o&nbsp;<strong>per\u00edodo aquisitivo<\/strong>. <\/p>\n\n\n\n<p>A empresa tem os 12 meses seguintes para conced\u00ea-las: esse \u00e9 o&nbsp;<strong>per\u00edodo concessivo<\/strong>&nbsp;(art. 134 CLT). Se o per\u00edodo concessivo se encerrar sem que as f\u00e9rias tenham sido concedidas, a empresa paga em dobro e pode ser autuada pelo MTE. <\/p>\n\n\n\n<p>O eSocial cruza automaticamente a data de admiss\u00e3o com os registros de afastamento: quando detecta dois per\u00edodos sem concess\u00e3o, <strong>sinaliza para a fiscaliza\u00e7\u00e3o do trabalho.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fracionamento de f\u00e9rias<\/h3>\n\n\n\n<p>Desde a Reforma Trabalhista de 2017, o art. 134, \u00a71\u00ba da CLT permite dividir as f\u00e9rias em at\u00e9&nbsp;<strong>3 per\u00edodos<\/strong>, desde que o colaborador concorde expressamente e que um deles tenha no m\u00ednimo 14 dias corridos. <\/p>\n\n\n\n<p>Os demais n\u00e3o podem ser inferiores a 5 dias corridos cada. O pagamento, que inclui o&nbsp;<strong>adicional constitucional de um ter\u00e7o<\/strong>, deve ser feito at\u00e9 2 dias antes do in\u00edcio do descanso. <\/p>\n\n\n\n<p>O colaborador pode<strong> converter at\u00e9 1\/3 dos dias em abono pecuni\u00e1rio<\/strong> se solicitar com anteced\u00eancia m\u00ednima de 15 dias. Todas essas movimenta\u00e7\u00f5es precisam ser registradas no eSocial (eventos S-2230, S-1200, S-1210) dentro dos prazos estabelecidos.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"passo-a-passo\">Passo a passo para fazer o controle de f\u00e9rias corretamente<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1. Mapeie o saldo individual de cada funcion\u00e1rio<\/h3>\n\n\n\n<p>O ponto de partida \u00e9 ter, para cada colaborador: <strong>data de admiss\u00e3o, data de in\u00edcio e t\u00e9rmino do per\u00edodo aquisitivo vigente<\/strong>, n\u00famero de faltas injustificadas no per\u00edodo e saldo de dias dispon\u00edveis. <\/p>\n\n\n\n<p>Sem esse levantamento atualizado, <strong>qualquer calend\u00e1rio constru\u00eddo a partir da\u00ed ser\u00e1 impreciso<\/strong>. Em equipes com mais de 20 pessoas, esse mapeamento manual em planilha<strong> consome em m\u00e9dia 8 a 12 horas por m\u00eas<\/strong> e \u00e9 a principal fonte de erros de c\u00e1lculo que geram passivo trabalhista.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Defina e comunique a pol\u00edtica interna de f\u00e9rias<\/h3>\n\n\n\n<p>Uma<strong> pol\u00edtica de f\u00e9rias clara<\/strong> define as regras antes que os conflitos aconte\u00e7am: janelas de per\u00edodo em que as f\u00e9rias n\u00e3o podem ser solicitadas (fechamentos cont\u00e1beis, picos sazonais), crit\u00e9rios de prioridade quando dois colaboradores pedem o mesmo per\u00edodo, prazo m\u00ednimo para solicita\u00e7\u00e3o e como o fracionamento ser\u00e1 tratado. <\/p>\n\n\n\n<p>Essa pol\u00edtica<strong> precisa estar acess\u00edvel a todos os colaboradore<\/strong>s e ser consistentemente aplicada. Pol\u00edticas aplicadas de forma desigual geram percep\u00e7\u00e3o de favoritismo e s\u00e3o um dos principais fatores que alimentam pedidos de demiss\u00e3o.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Monte o calend\u00e1rio por setor com bloqueios preventivos<\/h3>\n\n\n\n<p>Com os saldos individuais mapeados e a pol\u00edtica definida, o gestor de cada setor <strong>configura as janelas de aprova\u00e7\u00e3o:<\/strong> quais per\u00edodos t\u00eam bloqueio total (ningu\u00e9m pode sair), quais t\u00eam limite de aus\u00eancias simult\u00e2neas e quais s\u00e3o livres. <\/p>\n\n\n\n<p>Esse calend\u00e1rio precisa considerar os&nbsp;<a href=\"https:\/\/www.bizneo.com\/blog\/pt\/turnos-de-trabalho\/\" data-wpel-link=\"internal\" target=\"_blank\">turnos de trabalho<\/a>&nbsp;e a&nbsp;escala de trabalho&nbsp;de cada equipe, principalmente em <strong>empresas com opera\u00e7\u00e3o cont\u00ednua<\/strong>, onde a aus\u00eancia de um colaborador afeta a cobertura de um turno inteiro.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Treine gestores para reorganizar demandas durante as aus\u00eancias<\/h3>\n\n\n\n<p><strong>O controle de f\u00e9rias n\u00e3o termina na aprova\u00e7\u00e3o:<\/strong> inclui garantir que o trabalho do colaborador ausente seja distribu\u00eddo ou coberto sem sobrecarregar o restante da equipe. <\/p>\n\n\n\n<p>Gestores que n\u00e3o planejam a redistribui\u00e7\u00e3o com anteced\u00eancia criam dois problemas simult\u00e2neos: queda de produtividade de quem fica e retorno dif\u00edcil de quem voltou. <\/p>\n\n\n\n<p>Uma pr\u00e1tica eficaz \u00e9 definir, no momento da aprova\u00e7\u00e3o, <strong>quem assume cada responsabilidade cr\u00edtica durante a aus\u00eancia<\/strong>, documentado, n\u00e3o apenas combinado verbalmente.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Registre tudo no eSocial dentro dos prazos<\/h3>\n\n\n\n<p>Todas as movimenta\u00e7\u00f5es de f\u00e9rias devem ser lan\u00e7adas no eSocial: o evento S-2230 registra o afastamento tempor\u00e1rio; o S-1200 e S-1210 cobrem o pagamento e o abono. <\/p>\n\n\n\n<p>Manter esses registros consistentes <strong>protege a empresa em auditorias do MTE <\/strong>e em reclama\u00e7\u00f5es trabalhistas, onde o \u00f4nus da prova sobre a concess\u00e3o de f\u00e9rias recai sobre o empregador.
